A BILL
To amend title 18, United States Code, to provide a penalty
for assault or homicide committed by certain State or
local law enforcement officers, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Police Accountability
4
Act of 2020’’.

SEC. 2. ASSAULT OR HOMICIDE BY CERTAIN STATE OR

LOCAL LAW ENFORCEMENT OFFICERS.

(a) IN GENERAL.—Chapter 1 of title 18, United
3
States Code, is amended by adding at the end the fol-
4
lowing:
5
‘‘§ 28. Assault or homicide by certain State or local
6
law enforcement officers
7
‘‘(a) OFFENSE.—Whoever, being a State or local law
8
enforcement officer in a public agency which receives Fed-
9
eral funding under subpart 1 of part E of title I of the
10
Omnibus Crime Control and Safe Streets Act of 1968 (42
11
U.S.C. 3750 et seq.) engages in any conduct in the line
12
of duty that, were the conduct to occur in the special mari-
13
time and territorial jurisdiction of the United States,
14
would constitute an offense under section 1111 or 1112
15
shall be punished as is provided for that offense under
16
such section.

‘‘(b) DEFINITION.—In this section—
18
‘‘(1) the term ‘State or local law enforcement
19
officer’ means an employee of a State or local gov-
20
ernment—
21
‘‘(A) who has statutory authority to make
22
arrests or apprehensions;
23
‘‘(B) who is authorized by the agency of
24
the employee to carry firearms; and
25
‘‘(C) whose duties are primarily—

‘‘(i) engagement in or supervision of
1
the prevention, detection, investigation, or
2
prosecution of, or the incarceration of any
3
person for, any violation of law; or
4
‘‘(ii) the protection of Federal, State,
5
local,
or
foreign
government
officials
6
against threats to personal safety; and
7
‘‘(2) the term ‘State or local government’
8
means the government—
9
‘‘(A) of a State, the District of Columbia,
10
the Commonwealth of Puerto Rico, or any other
11
territory or possession of the United States; or
12
‘‘(B) of a political subdivision of such a
13
State, District, Commonwealth, territory or
14
possession.’’.

(b) CLERICAL AMENDMENT.—The table of sections
16
at the beginning of chapter 1 of title 18, United States
17
Code, is amended by adding at the end the following new
18
item:
19
‘‘28. Assault or homicide by certain State or local law enforcement officers.’’.
