Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Public Health Emer- 4 gency Fund Act’’. 5 SEC. 2. SUPPLEMENTAL APPROPRIATION FOR THE PUBLIC 6 HEALTH EMERGENCY FUND. 7 (a) APPROPRIATION.—There is appropriated, out of 8 any money in the Treasury not otherwise appropriated, 9 VerDate Sep 11 2014 02:12 Jan 31, 2020 Jkt 099200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H5723.IH H5723 kjohnson on DSK79L0C42PROD with BILLS 2 •HR 5723 IH for an additional amount for carrying out section 319(a) 1 of the Public Health Service Act, $5,000,000,000, to be 2 available until expended. Such amount shall be deposited 3 into the Fund established under section 319(b) of such 4 Act. 5 (b) EMERGENCY DESIGNATION.—The amount made 6 available by subsection (a)— 7 (1) is designated by Congress as an emergency 8 requirement pursuant to section 251(b)(2)(A)(i) of 9 the Balanced Budget and Emergency Deficit Control 10 Act of 1985; and 11 (2) shall be available only if the President sub- 12 sequently so designates such amount. 13 (c) DEPOSIT IN STRATEGIC NATIONAL STOCKPILE.— 14 The activities under section 319(a) of the Public Health 15 Service Act that are funded under this section may include 16 the acquisition of products for deposit into the strategic 17 national stockpile maintained under section 319F–2 of 18 such Act. 19 SEC. 3.
