Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. ELIMINATION OF MEDICARE PART D LATE EN-

ROLLMENT
PENALTY
FOR
MARIA
ROSE

VERSACE; COMPENSATION FOR PAST PEN-
5
ALTIES.

(a) ELIMINATION
OF PENALTY.—With respect to
7
each month beginning on or after the date of the enact-
8
ment of this Act, no increase in the monthly beneficiary
9
premium established under subsection (a) of section
10
1860D–13 of the Social Security Act (42 U.S.C. 1395w–

113) shall be made under subsection (b) of such section

for Maria Rose Versace.

(b) COMPENSATION FOR PAST PENALTIES.—
3
(1) IN GENERAL.—Not later than 30 days after
4
the date of the enactment of this Act, the Secretary
5
of Health and Human Services shall pay to Maria
6
Rose Versace an amount equal to the sum of each
7
increase described in subsection (a) made under sec-
8
tion 1860D–13(b) of the Social Security Act (42
9
U.S.C. 1395w–113(b)) applicable to Maria Rose
10
Versace for months beginning prior to the date of
11
the enactment of this Act.

(2) APPROPRIATION.—There are appropriated
13
to the Secretary of Health and Human Services such
14
sums as may be necessary to make the payment de-
15
scribed in paragraph (1).
