Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Student and Student 4 Athlete Opioid Misuse Prevention Act’’. 5 SEC. 2. GRANTS FOR STUDENT AND STUDENT ATHLETE 1 OPIOID MISUSE PREVENTION. 2 ‘‘(a) AUTHORITY.—The Assistant Secretary, in con- 3 sultation with the Secretary of Education, may make 4 grants to, and enter into contracts and cooperative agree- 5 ments with, public and nonprofit private entities, including 6 States and drug-free community coalitions, to enable such 7 entities— 8 ‘‘(1) to carry out school-based programs con- 9 cerning the dangers of the misuse of and addiction 10 to prescription opioids, related drugs, and other pre- 11 scribed drugs commonly used in pain management 12 or injury recovery, including initiatives that give stu- 13 dents the responsibility to create their own anti-drug 14 abuse education programs for their schools; 15 ‘‘(2) to carry out community-based misuse and 16 addiction prevention programs relating to prescrip- 17 tion opioids, related drugs, and other prescription 18 drugs commonly used in pain management or injury 19 recovery, including youth sports organizations; and 20 ‘‘(3) to carry out school, collegiate, and commu- 21 nity-based engagement of youth, high school, or col- 22 legiate athletic and recreation programs and associa- 23 tions concerning the dangers of the misuse of and 24 addiction to prescription opioids, related drugs, and 25 other prescription drugs commonly used in pain 26 VerDate Sep 11 2014 05:58 Jan 22, 2020 Jkt 099200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S3222.IS S3222 kjohnson on DSK79L0C42PROD with BILLS 3 •S 3222 IS management or injury recovery, including initiatives 1 that give student athletes the responsibility to create 2 their own anti-drug abuse education programs for 3 their schools. 4 ‘‘(b) USE OF FUNDS.—Amounts made available 5 under a grant, contract, or cooperative agreement under 6 subsection (a) shall be used for planning, establishing, or 7 administering prevention programs relating to prescrip- 8 tion opioid, related drugs, and other drugs commonly used 9 in pain management or injury recovery. 10 ‘‘(c) USE OF FUNDS.—Amounts provided to an entity 11 under this section may be used— 12 ‘‘(1) to carry out school-based programs that 13 are focused on school districts with high or increas- 14 ing rates of misuse of and addiction to prescription 15 and nonprescription opioids, and targeted at popu- 16 lations that are most at risk to start misusing such 17 drugs; 18 ‘‘(2) to carry out community-based prevention 19 programs that are focused on populations within the 20 community that are most at risk for misuse of and 21 addiction to prescription and nonprescription 22 opioids; 3 ‘‘(4) to carry out community-based programs 4 that are focused on youth athletes and the risk of 5 misuse of and addiction to prescription and non- 6 prescription opioids as part of injury recovery and 7 pain management; 8 ‘‘(5) to carry out collegiate-based programs that 9 are focused on collegiate athletes, including club 10 sports and recreation sports, and the risk for misuse 11 of and addiction to prescription and nonprescription 12 opioids as part of injury recovery and pain manage- 13 ment; 14 ‘‘(6) to assist local government entities to con- 15 duct appropriate prevention activities relating to 16 youth and the risk for misuse of and addiction to 17 prescription and nonprescription opioids as part of 18 injury recovery and pain management; and 19 ‘‘(7) to train and educate State and local offi- 20 cials; youth athletics organizers and coaches; school 21 administrators, teachers, athletic directors, coaches, 22 and athletic trainers; collegiate administrators, ath- 23 letic directors, directors of campus recreation, coach- 24 es, athletic trainers, and campus-based medical pro- 25 VerDate Sep 11 2014 05:58 Jan 22, 2020 Jkt 099200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\S3222.IS S3222 kjohnson on DSK79L0C42PROD with BILLS 5 •S 3222 IS viders, on the signs of misuse of prescription and 1 nonprescription opioids and the options for treat- 2 ment and prevention of such misuse. 3 ‘‘(d) ALLOCATION AND REPORT.— 4 ‘‘(1) PREVENTION PROGRAM ALLOCATION.— 5 Not more than $500,000 of the amount appro- 6 priated in each fiscal year to carry out this section 7 shall be made available to the Assistant Secretary, 8 acting in consultation with other Federal agencies, 9 to support and conduct periodic analyses and evalua- 10 tions of effective prevention programs for misuse of 11 and addiction to opioids, related drugs, and other 12 drugs commonly used for pain management and the 13 development of appropriate strategies for dissemi- 14 nating information about and implementing such 15 programs. 16 ‘‘(2) REPORT.—The Assistant Secretary shall 17 annually prepare and submit to the Committee on 18 Health, Education, Labor, and Pensions, the Com- 19 mittee on the Judiciary, and the Committee on Ap- 20 propriations of the Senate, and the Committee on 21 Energy and Commerce, the Committee on the Judi- 22 ciary, and the Committee on Appropriations of the 23 House of Representatives, a report on the prevention 24 programs and development of strategies described in 25 VerDate Sep 11 2014 05:58 Jan 22, 2020 Jkt 099200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6201 E:\BILLS\S3222.IS S3222 kjohnson on DSK79L0C42PROD with BILLS 6 •S 3222 IS paragraph (1), containing, as appropriate, the re- 1 sults of the analyses and evaluations conducted 2 under paragraph (1). 3 ‘‘(e) AUTHORIZATION OF APPROPRIATIONS.—There 4 is authorized to be appropriated to carry out this section— 5 ‘‘(1) $10,000,000 for fiscal year 2021;
