A BILL
To amend the Worker Adjustment and Retraining Notifica-
tion Act to provide a notice requirement regarding
offshoring.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Offshoring Notification
4
Act’’.
5
SEC. 2. DEFINITION.
6
Section 2(a) of the Worker Adjustment and Retrain-
7
ing Notification Act (29 U.S.C. 2101) is amended—
8
(1) in paragraph (7), by striking ‘‘and’’ at the
9
end;

(2) in paragraph (8), by striking the period and

inserting ‘‘; and’’; and
2
(3) by adding at the end the following:

‘‘(9) the term ‘United States’ includes each of
4
the 50 States, the District of Columbia, the Republic
5
of the Marshall Islands, the Federated States of Mi-
6
cronesia, and the Republic of Palau, and each terri-
7
tory or possession of the United States.’’.

SEC. 3. NOTICE.

Section 3 of the Worker Adjustment and Retraining
10
Notification Act (29 U.S.C. 2102(a)) is amended—
11
(1) by redesignating subsections (b), (c), and
12
(d) as subsections (c), (d), and (e), respectively; and
13
(2) by inserting after subsection (a) the fol-
14
lowing:

‘‘(b) OFFSHORING INFORMATION.—The notice shall
16
contain information stating—
17
‘‘(1) whether the employer plans to continue
18
producing the good or providing the service that the
19
affected employees have been producing or pro-
20
viding; and
21
‘‘(2) if so, whether the production or provision
22
will be performed for the employer, by employees or
23
contractors outside the United States.’’.
