Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Native Behavioral 4 Health Access Improvement Act of 2019’’. 5 SEC. 2. SPECIAL BEHAVIORAL HEALTH PROGRAM FOR 1 INDIANS. 2 ‘‘(a) IN GENERAL.—The Director of the Indian 3 Health Service, in coordination with the Assistant Sec- 4 retary for Mental Health and Substance Use, shall award 5 grants for providing services in accordance with subsection 6 (b) for the prevention and treatment of mental health and 7 substance use disorders. 8 ‘‘(b) SERVICES THROUGH INDIAN HEALTH FACILI- 9 TIES.—For purposes of subsection (a), services are pro- 10 vided in accordance with this subsection if the services are 11 provided through any of the following entities: 12 ‘‘(1) The Indian Health Service. 13 ‘‘(2) An Indian health program operated by an 14 Indian tribe or tribal organization pursuant to a 15 contract, grant, cooperative agreement, or compact 16 with the Indian Health Service pursuant to the In- 17 dian Self-Determination and Education Assistance 18 Act (25 U.S.C. 5301 et seq.). 19 ‘‘(3) An urban Indian health program operated 20 by an urban Indian organization pursuant to a grant 21 or contract with the Indian Health Service pursuant 22 to title V of the Indian Health Care Improvement 23 Act (25 U.S.C. 1651 et seq.). 24 ‘‘(c) REPORTS.—Each grantee under this section 25 shall submit reports at such time, in such manner, and 26 VerDate Sep 11 2014 15:57 Dec 28, 2019 Jkt 099200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S3126.IS S3126 pamtmann on DSKBC07HB2PROD with BILLS 3 •S 3126 IS containing such information as the Director of the Indian 1 Health Service may require. 2 ‘‘(d) TECHNICAL ASSISTANCE CENTER.— 3 ‘‘(1) ESTABLISHMENT.—The Director of the 4 Indian Health Service, in coordination with the As- 5 sistant Secretary for Mental Health and Substance 6 Use, shall establish a technical assistance center (di- 7 rectly or by contract or cooperative agreement)— 8 ‘‘(A) to provide technical assistance to 9 grantees under this section; and 10 ‘‘(B) to collect and evaluate information on 11 the program carried out under this section. 12 ‘‘(2) CONSULTATION.—The technical assistance 13 center shall consult with grantees under this section 14 for purposes of developing evaluation measures and 15 data submission requirements for purposes of the 16 collection and evaluation of information under para- 17 graph (1)(B). 18 ‘‘(3) DATA SUBMISSION.—As a condition on re- 19 ceipt of a grant under this section, an applicant 20 shall agree to submit data consistent with the data 21 submission requirements developed under paragraph 22 (2). 23 ‘‘(e) FUNDING.— 24 VerDate Sep 11 2014 15:57 Dec 28, 2019 Jkt 099200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\S3126.IS S3126 pamtmann on DSKBC07HB2PROD with BILLS 4 •S 3126 IS ‘‘(1) IN GENERAL.—For the purpose of making 1 grants under this section, there is authorized to be 2 appropriated, and there is appropriated, out of any 3 money in the Treasury not otherwise appropriated, 4 $150,000,000 for each of fiscal years 2021 through 5 2025. 6 ‘‘(2) TECHNICAL ASSISTANCE CENTER.—Of the 7 amount made available to carry out this section for 8 each of fiscal years 2021 through 2025, the Director 9 of the Indian Health Service shall allocate a percent- 10 age of such amount, to be determined by the Direc- 11 tor in consultation with Indian tribes, for the tech- 12 nical assistance center under subsection (d). 13 ‘‘(f) DEFINITIONS.—In this section: 14 ‘‘(1) INDIAN HEALTH PROGRAM.—The term 15 ‘Indian health program’ has the meaning given that 16 term in section 4 of the Indian Health Care Im- 17 provement Act (25 U.S.C. 1603). 18 ‘‘(2) INDIAN TRIBE.—The term ‘Indian tribe’ 19 has the meaning given that term in section 4 of the 20 Indian Health Care Improvement Act (25 U.S.C. 21 1603). 22 ‘‘(3) TRIBAL ORGANIZATION.—The term ‘tribal 23 organization’ has the meaning given that term in 24 VerDate Sep 11 2014 15:57 Dec 28, 2019 Jkt 099200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\S3126.IS S3126 pamtmann on DSKBC07HB2PROD with BILLS 5 •S 3126 IS section 4 of the Indian Self-Determination and Edu- 1 cation Assistance Act (25 U.S.C. 5304). 2 ‘‘(4) URBAN INDIAN ORGANIZATION.—The term 3 ‘urban Indian organization’ has the meaning given 4 the term ‘Urban Indian organization’ in section 4 of 5 the Indian Health Care Improvement Act (25 U.S.C. 6 1603).’’. 7 Æ VerDate Sep 11 2014 15:57 Dec 28, 2019 Jkt 099200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6301 E:\BILLS\S3126.IS S3126 pamtmann on DSKBC07HB2PROD with BILLS
