To authorize the Secretary of the Interior to establish the
January 8th National Memorial in Tucson, Arizona, as
an affiliated area of the National Park System, and
for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘January 8th National
4
Memorial Act’’.

SEC. 2. FINDINGS.

Congress finds the following:

(1) The tragedy of January 8, 2011, at Con-

gresswoman Gabrielle Gifford’s ‘‘Congress on Your
2
Corner’’ event resulted in the deaths of 6 people

(Christina-Taylor Green, Dorothy Morris, U.S. Dis-

trict Court Judge John Roll, Phyllis Schneck,
5
Dorwan Stoddard, and Gabe Zimmerman) and in-
6
jury of 13 others (Congresswoman Giffords, Bill
7
Badger, Ron Barber, Kenneth Dorushka, James
8
Eric Fuller, Randy Gardner, Susan Hileman, George
9
Morris, Mary Reed, Pam Simon, Mavanell Stoddard,
10
Jim Tucker, and Kenneth Veeder).

(2) This was the first time in the history of the
12
United States that an assassination attempt was
13
made upon a Congressional Member while she was
14
meeting with constituents.
15
(3) Congresswoman Giffords sustained severe
16
injuries that affect her to this day.
17
(4) Gabe Zimmerman was the first Congres-
18
sional staffer to be assassinated in the line of duty.
19
(5) The Arizona community and people from all
20
over the world came together in the days that fol-
21
lowed the tragedy to provide comfort and support to
22
one another at three spontaneous memorial vigil
23
sites—

(A) the shopping center where the shooting
1
took place;
2
(B) the front lawn of University Medical
3
Center, where many of the victims were treated;
4
and
5
(C) at Congresswoman Giffords’ Tucson
6
district office.

(6) Tucson’s January 8th Memorial will not
8
only be a tribute to those who died that day, but
9
also to the local, national, and international response
10
to the tragedy.
11
(7) The memorial will be constructed, managed,
12
and maintained to be a place where visitors, young
13
and old, can learn not only about one horrific event,
14
but about the resilience of a community and the du-
15
rability of democracy in the United States.

SEC. 3. JANUARY 8TH NATIONAL MEMORIAL.

(a) DEFINITIONS.—
18
(1) MEMORIAL.—The term ‘‘Memorial’’ means
19
the January 8th National Memorial.
20
(2) FOUNDATION.—The term ‘‘Foundation’’
21
means the Tucson’s January 8th Memorial Founda-
22
tion, an organization described in section 501(c)(3)
23
of the Internal Revenue Code of 1986 and exempt
24
from taxation under section 501(a) of that Code.

(3) MAP.—The term ‘‘map’’ means the map en-
1
titled ‘‘Phase 1 Siteplan + Survey Plan’’, numbered
2
LAl2.01, and dated November 11, 2016.

(4) SECRETARY.—The term ‘‘Secretary’’ means
4
the Secretary of the Interior.
5
(b) JANUARY 8TH NATIONAL MEMORIAL.—
6
(1) ESTABLISHMENT.—As soon as practicable,
7
the Secretary shall establish the Memorial as an af-
8
filiated area of the National Park System.
9
(2) FUNDING.—The Foundation shall transfer
10
to Pima County amounts equal to final funding
11
pledges, in addition to amounts that the Foundation
12
has raised and transferred to Pima County for con-
13
struction of the Memorial.
14
(3) MEMORIAL CONSTRUCTION.—The Memorial
15
shall be constructed on property owned by Pima
16
County. Pima County shall be responsible for man-
17
aging the Memorial construction contract using
18
funds provided by the Foundation.
19
(4) FOUNDATION DISSOLUTION.—The Founda-
20
tion shall cease to operate after—
21
(A) final funding pledge amounts have
22
been paid to Pima Country; and
23
(B) construction of the Memorial is com-
24
plete.

(5) MANAGEMENT ENTITY.—Pima County shall
1
be—
2
(A) the management entity for the Memo-
3
rial; and
4
(B) responsible for the construction, oper-
5
ation, maintenance, and management of the
6
Memorial.
7
(6) AVAILABILITY OF MAP.—The map shall be
8
on file and available for public inspection at the ap-
9
propriate offices of the National Park Service.
10
(7) COOPERATIVE
AGREEMENTS.—The Sec-
11
retary may provide technical assistance and enter
12
into cooperative agreements with Pima County for
13
the purpose of providing financial assistance with
14
marketing of the Memorial.
15
(8) LIMITED ROLE OF THE SECRETARY.—Noth-
16
ing in this Act authorizes the Secretary to acquire
17
property or to use Federal funds for the construc-
18
tion, operation, maintenance, or management of the
19
Memorial.
20
(9) GENERAL MANAGEMENT PLAN.—
21
(A) IN GENERAL.—The Secretary, in con-
22
sultation with the Pima County, shall develop a
23
general management plan for the Memorial.

The plan shall be prepared in accordance with

section 100502 of title 54, United States Code.
2
(B) TRANSMITTAL.—Not later than 3
3
years after the Memorial is established by the
4
Secretary, the Secretary shall provide of a copy
5
of the completed general management plan to
6
the Committee on Natural Resources of the
7
House of Representatives and the Committee
8
on Energy and Natural Resources of the Sen-
9
ate.
