Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Clean Federal Fleet 4 Act of 2020’’. 5 SEC. 2. FEDERAL FLEET EMISSION REQUIREMENTS. 6 (a) IN GENERAL.—Section 303(f) of the Energy Pol- 7 icy Act of 1992 (42 U.S.C. 13212(f)) is amended— 8 VerDate Sep 11 2014 22:14 Jan 10, 2020 Jkt 099200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H5554.IH H5554 kjohnson on DSK79L0C42PROD with BILLS 2 •HR 5554 IH (1) in paragraph (1), by— 1 (A) striking subparagraph (A) and insert- 2 ing the following new subparagraph: 3 ‘‘(A) COVERED FEDERAL ENTITY.—The 4 term ‘covered Federal entity’ means any entity 5 that owns, operates, leases, or otherwise con- 6 trols or is assigned a Federal fleet (as such 7 term is defined in subsection (b)(3)).’’; 8 (B) striking subparagraph (C); 9 (C) redesignating subparagraph (B) as 10 subparagraph (C); and 11 (D) inserting after subparagraph (A) the 12 following new subparagraph: 13 ‘‘(B) LOW GREENHOUSE GAS EMITTING 14 VEHICLE.—The term ‘low greenhouse gas emit- 15 ting vehicle’ means a light duty or medium duty 16 vehicle that meets, at a minimum— 17 ‘‘(i) if a model year 2012 through 18 2016 vehicle, the requirements of the 19 greenhouse gas emission standards for 20 such vehicle that were published in the 21 Federal Register by the Environmental 22 Protection Agency and the Department of 23 Transportation on May 7, 2010, in the 24 final rule titled ‘Light Duty Vehicle Green- 25 VerDate Sep 11 2014 22:14 Jan 10, 2020 Jkt 099200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H5554.IH H5554 kjohnson on DSK79L0C42PROD with BILLS 3 •HR 5554 IH house Gas Emission Standards and Cor- 1 porate Average Fuel Economy Standards’ 2 (75 Fed. Reg. 25324); or 3 ‘‘(ii) if a model year 2017 or later ve- 4 hicle, the requirements of the greenhouse 5 gas emission standards for such vehicle 6 that were published in the Federal Reg- 7 ister by the Environmental Protection 8 Agency and the Department of Transpor- 9 tation on October 15, 2012, in the final 10 rule titled ‘2017 and Later Model Year 11 Light-Duty Vehicle Greenhouse Gas Emis- 12 sions and Corporate Average Fuel Econ- 13 omy Standards’ (77 Fed. Reg. 62624).’’; 14 and 15 (2) in paragraph (2)— 16 (A) in subparagraph (A), by striking ‘‘Fed- 17 eral agency’’ and inserting ‘‘covered Federal en- 18 tity’’; 19 (B) in subparagraph (B), by striking 20 ‘‘agency’’ each place it appears and inserting 21 ‘‘covered Federal entity’’; and 22 (C) by striking subparagraph (C). 23 VerDate Sep 11 2014 22:14 Jan 10, 2020 Jkt 099200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H5554.IH H5554 kjohnson on DSK79L0C42PROD with BILLS 4 •HR 5554 IH (b) GUIDANCE.—Not later than 30 days after the 1 date of the enactment of this section, the Administrator 2 of the Environmental Protection Agency shall— 3 (1) issue guidance identifying the makes and 4 model numbers of vehicles that are low greenhouse 5 gas emitting vehicles, as required by section 6 303(f)(3)(A) of the Energy Policy Act of 1992 (42 7 U.S.C. 13212(f)(3)(A)); and 8 (2) in issuing such guidance, utilize the defini- 9 tion of ‘‘low greenhouse gas emitting vehicle’’ in sec- 10 tion 303(f)(1)(B) of such Act (42 U.S.C. 11 13212(f)(1)(B)), as amended by subsection (a). 12 (c) EFFECT ON ACQUISITIONS.—The amendments in 13 subsection (a) shall apply with respect to acquisitions 14 made after the date on which guidance is issued pursuant 15 to subsection (b). 16 Æ VerDate Sep 11 2014 22:14 Jan 10, 2020 Jkt 099200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6301 E:\BILLS\H5554.IH H5554 kjohnson on DSK79L0C42PROD with BILLS
