Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Affordable Safe Drink- 4 ing Water Act of 2020’’. 5 SEC. 2. STATE REVOLVING FUNDS. 6 (a) DEFINITIONS.—In this section: 7 VerDate Sep 11 2014 20:18 Jan 10, 2020 Jkt 099200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\S3160.IS S3160 lotter on DSKBCFDHB2PROD with BILLS 2 •S 3160 IS (1) ADMINISTRATOR.—The term ‘‘Adminis- 1 trator’’ means the Administrator of the Environ- 2 mental Protection Agency. 3 (2) STATE REVOLVING LOAN FUND.—The term 4 ‘‘State revolving loan fund’’ means— 5 (A) a State water pollution control revolv- 6 ing fund established under title VI of the Fed- 7 eral Water Pollution Control Act (33 U.S.C. 8 1381 et seq.); and 9 (B) a State drinking water treatment re- 10 volving loan fund established under section 11 1452 of the Safe Drinking Water Act (42 12 U.S.C. 300j–12). 13 (b) LOAN TERMS.— 14 (1) FEDERAL WATER POLLUTION CONTROL 15 ACT.—Section 603(d)(1)(A) of the Federal Water 16 Pollution Control Act (33 U.S.C. 1383(d)(1)(A)) is 17 amended by striking ‘‘the lesser of 30 years and’’. 18 (2) SAFE DRINKING WATER ACT.—Section 19 1452(f)(1) of the Safe Drinking Water Act (42 20 U.S.C. 300j–12(f)(1)) is amended by striking sub- 21 paragraph (C) and inserting the following: 22 ‘‘(C) each loan has a term that does not 23 exceed the projected useful life (as determined 24 VerDate Sep 11 2014 03:16 Jan 09, 2020 Jkt 099200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S3160.IS S3160 lotter on DSKBCFDHB2PROD with BILLS 3 •S 3160 IS by the State) of the project for which the loan 1 was made;’’. 2 (c) APPLICABILITY TO EXISTING LOANS.—The term 3 of a loan made from a State revolving loan fund before 4 the date of enactment of this Act may, on agreement of 5 the parties to the loan, be extended in accordance with 6 the amendments made by subsection (b), as applicable. 7 (d) LEADED PUBLIC DRINKING WATER INFRA- 8 STRUCTURE.—Section 1452(g)(2)(B) of the Safe Drink- 9 ing Water Act (42 U.S.C. 300j–12(g)(2)(B)) is amend- 10 ed— 11 (1) in clause (iii), by striking ‘‘; and’’ and in- 12 serting a semicolon; 13 (2) in clause (iv), by striking the period at the 14 end and inserting ‘‘; and’’; and 15 (3) by adding at the end the following: 16 ‘‘(v) to replace pipes, plumbing fit- 17 tings, and fixtures that carry water that is 18 not free of lead or perfluoroalkyl or 19 polyfluoroalkyl substances at— 20 ‘‘(I) a public school; 21 ‘‘(II) a public park; 22 ‘‘(III) a fire station; 23 ‘‘(IV) a police station; 24 ‘‘(V) a senior center; 25 VerDate Sep 11 2014 03:16 Jan 09, 2020 Jkt 099200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\S3160.IS S3160 lotter on DSKBCFDHB2PROD with BILLS 4 •S 3160 IS ‘‘(VI) a community center; or 1 ‘‘(VII) any other municipal-, 2 Tribal-, or State-owned facility that 3 provides the public or employees with 4 drinking water.’’. 5 (e) REPORTS.— 6 (1) STATE REVOLVING LOANS.—Not later than 7 18 months after the date of enactment of this Act, 8 and each year thereafter, the Administrator shall 9 submit to Congress a report describing— 10 (A) the terms of assistance from, recipients 11 of assistance from, and amounts within each 12 State revolving fund loan; and 13 (B) whether a State revolving fund loan 14 has been refinanced. 15 (2) LEAD AND PFAS REMEDIATION.—Not later 16 than 18 months after the date of enactment of this 17 Act, and each year thereafter, the Administrator 18 shall submit to Congress a report describing each 19 project carried out under clause (v) of section 20 1452(g)(2)(B) of the Safe Drinking Water Act (42 21 U.S.C. 300j–12(g)(2)(B)) during the previous year, 22 including— 23 (A) a description of the project; 24 VerDate Sep 11 2014 03:16 Jan 09, 2020 Jkt 099200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\S3160.IS S3160 lotter on DSKBCFDHB2PROD with BILLS 5 •S 3160 IS (B) the level of lead contamination or con- 1 tamination by perfluoroalkyl or polyfluoroalkyl 2 substances, as applicable, of the drinking water 3 at the facility at which the project was carried 4 out before the project was carried out; 5 (C) the cost of the project; and 6 (D) an estimate of the number of people 7 that used the drinking water source that is the 8 subject of the project during the 1-year period 9 ending on the date on which the project began. 10 Æ VerDate Sep 11 2014 03:16 Jan 09, 2020 Jkt 099200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6301 E:\BILLS\S3160.IS S3160 lotter on DSKBCFDHB2PROD with BILLS
