Ms. MCSALLY (for herself and Ms. SINEMA) introduced the following bill;
which was read twice and referred to the Committee on Energy and Nat-
ural Resources
A BILL
To authorize the Secretary of the Interior to establish the
January 8th National Memorial in Tucson, Arizona, as
an affiliated area of the National Park System, and
for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘January 8th National
4
Memorial Act’’.
5
SEC. 2. FINDINGS.

Congress finds that—

(1) the tragedy of January 8, 2011, at the
1
‘‘Congress on Your Corner’’ event of Congress-
2
woman Gabrielle Giffords resulted in the deaths of
3
6 people (Christina-Taylor Green, Dorothy Morris,
4
U.S. District Court Judge John Roll, Phyllis
5
Schneck, Dorwan Stoddard, and Gabe Zimmerman)
6
and the injury of 13 people (Congresswoman Gif-
7
fords, Bill Badger, Ron Barber, Kenneth Dorushka,
8
James Eric Fuller, Randy Gardner, Susan Hileman,
9
George Morris, Mary Reed, Pam Simon, Mavanell
10
Stoddard, Jim Tucker, and Kenneth Veeder);
11
(2) the assassination attempt of January 8,
12
2011, was the first time in the history of the United
13
States that an assassination attempt was made on
14
a Member of Congress while the Member of Con-
15
gress was meeting with constituents;
16
(3) Congresswoman Giffords sustained severe
17
injuries on January 8, 2011, that continue to affect
18
the Congresswoman as of the date of enactment of
19
this Act;
20
(4) on January 8, 2011, Gabe Zimmerman be-
21
came the first congressional staff member to be as-
22
sassinated in the line of duty;
23
(5) the people in the State of Arizona and peo-
24
ple from all over the world came together in the days

that followed the tragedy to provide comfort and
1
support to each other at spontaneous memorial vigil
2
sites at—
3
(A) the shopping center at which the
4
shooting took place;
5
(B) the front lawn of University Medical
6
Center, at which many of the victims were
7
treated; and
8
(C) the Tucson district office of Congress-
9
woman Giffords;
10
(6) the January 8th Memorial in the State of
11
Arizona will not only be a tribute to the people who
12
died on January 8, 2011, but also to the local, na-
13
tional, and international response to the tragedy on
14
that day; and
15
(7) the January 8th Memorial will be con-
16
structed, managed, and maintained as a place at
17
which visitors, young and old, can learn not only
18
about 1 horrific event, but can also learn about the
19
resilience of a community and the durability of de-
20
mocracy in the United States.

SEC. 3. DEFINITIONS.
22
In this Act:
23
(1) COUNTY.—The term ‘‘County’’ means Pima
24
County, Arizona.

(2) FOUNDATION.—The term ‘‘Foundation’’
1
means the Tucson’s January 8th Memorial Founda-
2
tion, an organization described in section 501(c)(3)
3
of the Internal Revenue Code of 1986 and exempt
4
from taxation under section 501(a) of that Code.
5
(3) MAP.—The term ‘‘map’’ means the map en-
6
titled ‘‘Phase 1 Siteplan + Survey Plan’’, numbered
7
LAl2.01, and dated November 11, 2016.
8
(4) MEMORIAL.—The term ‘‘Memorial’’ means
9
the January 8th National Memorial established
10
under section 4(a).
11
(5) SECRETARY.—The term ‘‘Secretary’’ means
12
the Secretary of the Interior.

SEC. 4. JANUARY 8TH NATIONAL MEMORIAL.
14
(a) ESTABLISHMENT.—As soon as practicable after
15
the date of enactment of this Act, the Secretary shall es-
16
tablish the Memorial as an affiliated area of the National
17
Park System.
18
(b) FUNDING.—The Foundation shall transfer to the
19
County the total amount of final funding pledges, which
20
shall be in addition to amounts that the Foundation has
21
raised and transferred to the County for construction of
22
the Memorial.

(c) MEMORIAL CONSTRUCTION.—

(1) IN GENERAL.—The Memorial shall be con-
1
structed on land owned by the County.
2
(2) RESPONSIBILITY OF COUNTY.—The County
3
shall be responsible for managing the construction
4
contract for the Memorial using funds provided by
5
the Foundation under subsection (b).
6
(d) FOUNDATION DISSOLUTION.—The Foundation
7
shall cease to operate on the later of the date on which—
8
(1) final funding pledge amounts have been
9
paid to the County under subsection (b); or
10
(2) construction of the Memorial is complete.
11
(e) MANAGEMENT ENTITY.—The County shall—
12
(1) be the management entity for the Memorial;
13
and
14
(2) be responsible for the construction, oper-
15
ation, maintenance, and management of the Memo-
16
rial.
17
(f) AVAILABILITY OF MAP.—The map shall be on file
18
and available for public inspection at the appropriate of-
19
fices of the National Park Service.
20
(g) COOPERATIVE
AGREEMENTS.—The Secretary
21
may provide technical assistance to, and enter into cooper-
22
ative agreements with, the County for the purpose of pro-
23
viding financial assistance for the marketing of the Memo-
24
rial.

(h) LIMITED ROLE OF THE SECRETARY.—Nothing in
1
this Act authorizes the Secretary to acquire property or
2
use Federal funds for the construction, operation, mainte-
3
nance, or management of the Memorial.
4
(i) GENERAL MANAGEMENT PLAN.—
5
(1) IN GENERAL.—The Secretary, in consulta-
6
tion with the County, shall develop a general man-
7
agement plan for the Memorial in accordance with
8
section 100502 of title 54, United States Code.
9
(2) TRANSMITTAL.—Not later than the date
10
that is 3 years after the date on which the Memorial
11
is established by the Secretary, the Secretary shall
12
provide to the Committee on Energy and Natural
13
Resources of the Senate and the Committee on Nat-
14
ural Resources of the House of Representatives the
15
general management plan for the Memorial devel-
16
oped under paragraph (1).
