A BILL
To require, pursuant to the Federal Water Pollution Control
Act, disclosure of the introduction of perfluoroalkyl or
polyfluoroalkyl substances into treatment works, and for
other purposes.

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘PFAS Transparency
4
Act’’.

SEC. 2. DISCLOSURE OF INTRODUCTIONS OF PFAS.

(a)
IN
GENERAL.—The
introduction
of
any
2
perfluoroalkyl or polyfluoroalkyl substance by the owner
3
or operator of an industrial source shall be unlawful unless
4
such owner or operator first notifies the owner or operator
5
of the applicable treatment works of—
6
(1) the identity and quantity of such substance;
7
(2) whether such substance is susceptible to
8
treatment by such treatment works; and
9
(3) whether such substance would interfere with
10
the operation of the treatment works.

(b) VIOLATIONS.—A violation of this section shall be
12
treated in the same manner as a violation of a regulation
13
promulgated under subsection 307(b) of the Federal
14
Water Pollution Control Act (33 U.S.C. 1317(b)).

(c) DEFINITIONS.—In this section:
16
(1) INTRODUCTION.—The term ‘‘introduction’’
17
means the introduction of pollutants into treatment
18
works, as described in section 307(b) of the Federal
19
Water Pollution Control Act (33 U.S.C. 1317).
20
(2) TREATMENT WORKS.—The term ‘‘treatment
21
works’’ has the meaning given that term in section
22
212 of the Federal Water Pollution Control Act (33
23
U.S.C. 1292).
