Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘The Commuter Park- 4 way Safety and Reliability Act’’. 5 SEC. 2. PRIORITIZATION. 6 Section 203(a) of title 23, United States Code, is 7 amended by adding at the end the following: 8 ‘‘(6) PRIORITIZATION.— 9 VerDate Sep 11 2014 18:48 Dec 29, 2019 Jkt 099200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H5503.IH H5503 pamtmann on DSKBC07HB2PROD with BILLS 2 •HR 5503 IH ‘‘(A) IN GENERAL.—The Director of the 1 National Park Service shall prioritize the funds 2 made available under the Federal lands trans- 3 portation program for high-commuter corridors. 4 ‘‘(B) TRANSFER FOR HIGH-COMMUTER 5 CORRIDORS.— 6 ‘‘(i) REQUEST.—If the Director deter- 7 mines that a high-commuter corridor re- 8 quires additional investment, based on the 9 criteria described in clause (iv), the Direc- 10 tor, with respect to such corridor, shall 11 submit to the State— 12 ‘‘(I) information on condition of 13 pavements and bridges; 14 ‘‘(II) an estimate of the amounts 15 needed to bring such corridor into a 16 state of good repair, taking into con- 17 sideration any planned future invest- 18 ments; and 19 ‘‘(III) at the discretion of the Di- 20 rector, a request that the State trans- 21 fer to the National Park Service, 22 under the authority of section 132, or 23 to the Federal Highway Administra- 24 tion, under the authority of section 25 VerDate Sep 11 2014 18:48 Dec 29, 2019 Jkt 099200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H5503.IH H5503 pamtmann on DSKBC07HB2PROD with BILLS 3 •HR 5503 IH 104, a portion of such amounts nec- 1 essary to address the condition of the 2 corridor. 3 ‘‘(ii) STATE RESPONSE.—Not later 4 than 45 days after the date of receipt of 5 the request described in clause (i)(III), the 6 State shall— 7 ‘‘(I) approve the request; 8 ‘‘(II) deny the request and ex- 9 plain the reasons for such denial; or 10 ‘‘(III) request any additional in- 11 formation necessary to take action on 12 the request. 13 ‘‘(iii) NOTIFICATION TO THE SEC- 14 RETARY.—The Director shall provide to 15 the Secretary of Transportation a copy of 16 any request or response described under 17 clauses (i)(III) and (ii). 18 ‘‘(iv) CRITERIA.—In making a deter- 19 mination under clause (i), the Director, 20 with respect to the corridor, shall con- 21 sider— 22 ‘‘(I) the condition of roads, 23 bridges, and tunnels; and 24 VerDate Sep 11 2014 18:48 Dec 29, 2019 Jkt 099200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H5503.IH H5503 pamtmann on DSKBC07HB2PROD with BILLS 4 •HR 5503 IH ‘‘(II) the average annual daily 1 traffic. 2 ‘‘(C) HIGH-COMMUTER CORRIDOR DE- 3 FINED.—In this paragraph, the term ‘high-com- 4 muter corridor’ means a Federal lands trans- 5 portation facility administered by the National 6 Park Service that has average annual daily 7 traffic of not less than 20,000 vehicles.’’. 8 Æ VerDate Sep 11 2014 18:48 Dec 29, 2019 Jkt 099200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6301 E:\BILLS\H5503.IH H5503 pamtmann on DSKBC07HB2PROD with BILLS
