SEXUAL HARASSMENT IN OR AROUND A DWELLING. 1 The Fair Housing Act is amended by inserting after 2 section 807 (42 U.S.C. 3607) the following: 3 ‘‘SEC. 807A. SEXUAL HARASSMENT IN OR AROUND A DWELL- 4 ING. 5 ‘‘(a) HOSTILE ENVIRONMENT SEXUAL HARASS- 6 MENT.—For purposes of determining, under this title, 7 whether unwelcome conduct of a sexual nature is suffi- 8 ciently severe or pervasive to constitute a discriminatory 9 housing practice based on hostile environment sexual har- 10 assment, any incident of conduct described in subsection 11 (b) that occurs in or around a dwelling, shall be considered 12 to be severe or pervasive. 13 ‘‘(b) CONDUCT.—The conduct described in subsection 14 (a) consists of— 15 ‘‘(1) unwelcome touching of a sexual nature or 16 groping; or 17 ‘‘(2) any other unwelcome conduct of a sexual 18 nature that is intended to be coercive, threatening, 19 or intimidating.’’. 20 Æ VerDate Sep 11 2014 00:44 Dec 20, 2019 Jkt 099200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6301 E:\BILLS\S3059.IS S3059 kjohnson on DSK79L0C42 with BILLS
