SHORT TITLE. 3 This Act may be cited as the ‘‘Runaway and Homeless 4 Youth and Trafficking Prevention Act of 2020’’. 5 SEC. 2. REFERENCES. 6 Except as otherwise specifically provided, whenever in 7 this Act an amendment or repeal is expressed in terms of 8 an amendment to, or repeal of, a provision, the amendment 9 or repeal shall be considered to be made to a provision of 10 the Runaway and Homeless Youth Act (34 U.S.C. 11201 11 et seq.). 12 SEC. 3. FINDINGS. 13 Section 302 (34 U.S.C. 11201) is amended— 14 (1) in paragraph (1), by striking ‘‘share of, seri- 15 ous health, behavioral, and emotional problems’’ and 16 inserting ‘‘share of, trauma, serious health, behav- 17 ioral, social, and emotional problems, and substance 18 use disorder’’; 19 (2) in paragraph (2), by inserting ‘‘socially, age, 20 gender, developmentally, culturally and’’ before ‘‘lin- 21 guistically appropriate’’; 22 (3) by redesignating paragraphs (3) through (6), 23 as paragraphs (4) through (7), respectively; 24 VerDate Sep 11 2014 21:14 Dec 28, 2020 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6203 E:\BILLS\H5191.RH H5191 pamtmann on DSKBC07HB2PROD with BILLS 4 •HR 5191 RH (4) by inserting after paragraph (2) the fol- 1 lowing: 2 ‘‘(3) research has documented that youth experi- 3 ence homelessness as fluid, such that many youth ex- 4 perience 2 to 3 different types of homelessness, includ- 5 ing couch surfing, emergency shelters, and staying on 6 the streets;’’; 7 (5) in paragraph (4)(C), as redesignated by 8 paragraph (3), by striking ‘‘social contribution’’ and 9 inserting ‘‘self-advocacy’’; 10 (6) in paragraph (4)(E), as redesignated by 11 paragraph (3), by inserting ‘‘and peer’’ before ‘‘rela- 12 tionships’’; 13 (7) in paragraph (5), as redesignated by para- 14 graph (3), by striking ‘‘outside the welfare system and 15 the law enforcement system’’ and inserting ‘‘, in col- 16 laboration with public assistance systems, the law en- 17 forcement system, and the child welfare system’’; 18 (8) in paragraph (6), as redesignated by para- 19 graph (3)— 20 (A) by inserting ‘‘a safe place to live, con- 21 nection to caring adults, and’’ after ‘‘youth 22 need’’; and 23 (B) by striking ‘‘and’’ at the end; 24 VerDate Sep 11 2014 21:14 Dec 28, 2020 Jkt 019200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6203 E:\BILLS\H5191.RH H5191 pamtmann on DSKBC07HB2PROD with BILLS 5 •HR 5191 RH (9) in paragraph (7), as redesignated by para- 1 graph (3)— 2 (A) by striking ‘‘between the Federal pro- 3 grams that serve runaway and homeless youth 4 are’’ and inserting ‘‘at the Federal level is’’; and 5 (B) by striking the period at the end and 6 inserting a semicolon; and 7 (10) by adding at the end the following: 8 ‘‘(8) runaway and homeless youth are at a high 9 risk of substance use disorder and becoming victims 10 of sexual abuse, sexual exploitation, trafficking in 11 persons, and sex trafficking; 12 ‘‘(9) research has shown that— 13 ‘‘(A) the prevalence of homelessness among 14 youth and young adults is similar in rural and 15 urban communities; and 16 ‘‘(B) runaway and homeless youth pro- 17 grams, such as those funded under this Act, are 18 integral services that every community, regard- 19 less of size, should provide; and 20 ‘‘(10) runaway and homeless youth programs 21 provide expert adolescent services and are integral 22 community partners for the child welfare and juvenile 23 justice systems.’’. 24 VerDate Sep 11 2014 21:14 Dec 28, 2020 Jkt 019200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6203 E:\BILLS\H5191.RH H5191 pamtmann on DSKBC07HB2PROD with BILLS 6 •HR 5191 RH SEC. 4. BASIC CENTER GRANT PROGRAM. 1 (a) GRANTS FOR CENTERS AND SERVICES.—Section 2 311(a) (34 U.S.C. 11211(a)) is amended— 3 (1) in paragraph (1)— 4 (A) by striking ‘‘The Secretary’’ and insert- 5 ing ‘‘Every 2 or 3 years, the Secretary’’; 6 (B) by striking ‘‘and operate’’ and inserting 7 ‘‘, operate, and maintain’’; and 8 (C) by striking ‘‘services’’ and all that fol- 9 lows through the period at the end and inserting 10 ‘‘safe shelter and services, including trauma-in- 11 formed services, for runaway and homeless youth 12 and, if appropriate, services for the families of 13 such youth, including (if appropriate) individ- 14 uals identified by such youth as family. Grants 15 shall be awarded for a 5-year period.’’; and 16 (2) in paragraph (2)— 17 (A) by striking subparagraph (A) and in- 18 serting the following: 19 ‘‘(A) shall be provided to runaway youth, 20 street youth, homeless youth, and youth at risk 21 of separation from his or her family or at risk 22 of becoming homeless;’’; 2 (ii) by striking clause (ii) and insert- 3 ing the following: 4 ‘‘(ii) age, gender, developmentally, and 5 culturally and linguistically appropriate 6 individual, family, and group counseling, 7 as appropriate (including, if appropriate, 8 counseling for individuals identified by such 9 youth as family); and’’; and 10 (iii) by adding at the end the fol- 11 lowing: 12 ‘‘(iii) suicide prevention services; and’’; 13 and 14 (C) in subparagraph (C)— 15 (i) in clause (ii), by inserting ‘‘age, 16 gender, developmentally, and culturally and 17 linguistically appropriate, to the extent 18 practicable,’’ before ‘‘home-based services’’; 5 and 6 ‘‘(vi) if safe and appropriate, supports 7 for youth and their parents, legal guard- 8 ians, or (if appropriate) those identified by 9 such youth as family, including— 10 ‘‘(I) an assessment of family en- 11 gagement to improve support for youth 12 (and if appropriate) reunify youth; 13 ‘‘(II) strength-based interventions; 14 and 15 ‘‘(III) ongoing supportive serv- 16 ices.’’. 17 (b) ELIGIBILITY; PLAN REQUIREMENTS.—Section 312 18 (34 U.S.C. 11212) is amended— 19 (1) in subsection (a), by inserting ‘‘, to youth 20 who are at risk of separation from the family,’’ after 21 ‘‘guardians’’; and 3 (ii) by striking ‘‘requires’’ and insert- 4 ing ‘‘allows’’; 5 (C) in paragraph (5), by inserting ‘‘, or (if 6 appropriate) individuals identified by such 7 youth as family,’’ after ‘‘parents or legal guard- 8 ians’’; 9 (D) in paragraph (6)— 10 (i) by inserting ‘‘(which may include 11 the use of online resources in order to reach 12 and engage youth)’’ after ‘‘programs’’; and 13 (ii) by striking ‘‘cultural minority and 14 persons with limited ability to speak 15 English’’ and inserting ‘‘cultural minority, 16 persons with limited ability to speak 17 English, and runaway or homeless youth 18 who are victims of sexual abuse, sexual ex- 19 ploitation, trafficking in persons, or sex 20 trafficking’’; 4 ‘‘(B) are members of vulnerable or under- 5 served populations; 6 ‘‘(C) are victims of sexual abuse, sexual ex- 7 ploitation, trafficking in persons, or sex traf- 8 ficking; 9 ‘‘(D) are pregnant or parenting; 10 ‘‘(E) have been involved in the child welfare 11 system; and 12 ‘‘(F) have been involved in the juvenile jus- 13 tice system;’’; 14 (F) by striking paragraph (8) and inserting 15 the following: 16 ‘‘(8) shall ensure that— 17 ‘‘(A) the records described in paragraph (7), 18 on an individual runaway or homeless youth, 19 shall not be disclosed without the consent of the 20 individual youth and of the parent or legal 21 guardian of such youth or (if appropriate) an 22 individual identified by such youth as family, to 23 anyone other than another agency compiling sta- 24 tistical records or a government agency involved 25 VerDate Sep 11 2014 21:14 Dec 28, 2020 Jkt 019200 PO 00000 Frm 00010 Fmt 6652 Sfmt 6203 E:\BILLS\H5191.RH H5191 pamtmann on DSKBC07HB2PROD with BILLS 11 •HR 5191 RH in the disposition of criminal charges against an 1 individual runaway or homeless youth; and 2 ‘‘(B) reports or other documents based on 3 the statistics described in paragraph (7) shall 4 not disclose the identity of any individual run- 5 away or homeless youth;’’; 6 (G) in paragraph (12)— 7 (i) by striking subparagraph (B) and 8 inserting the following: 9 ‘‘(B) detailed information on how the center 10 has been able to meet the goals of its plans; and’’; 11 and 12 (ii) in subparagraph (C)— 13 (I) by striking clause (i) and in- 14 serting the following: 15 ‘‘(i) the number and characteristics of 16 runaway and homeless youth, and youth at 17 risk of family separation, who participate 18 in the project, including such information 19 on— 20 ‘‘(I) such youth (including run- 21 away and homeless youth, and youth 22 at risk of family separation) who are 23 victims of sexual abuse, sexual exploi- 24 VerDate Sep 11 2014 21:14 Dec 28, 2020 Jkt 019200 PO 00000 Frm 00011 Fmt 6652 Sfmt 6203 E:\BILLS\H5191.RH H5191 pamtmann on DSKBC07HB2PROD with BILLS 12 •HR 5191 RH tation, trafficking in persons, or sex 1 trafficking; 2 ‘‘(II) such youth who are preg- 3 nant or parenting; 4 ‘‘(III) such youth who have been 5 involved in the child welfare system; 6 and 7 ‘‘(IV) such youth who have been 8 involved in the juvenile justice system; 9 and’’; and 10 (II) in clause (ii), by striking 11 ‘‘and’’ after the semicolon; 12 (H) in paragraph (13) by striking the pe- 13 riod at the end and inserting ‘‘for natural disas- 14 ters, inclement weather, and mental health emer- 15 gencies;’’; and 16 (I) by adding at the end the following: 17 ‘‘(14) shall provide age, gender, developmentally, 18 and culturally and linguistically appropriate, to the 19 extent practicable, services to runaway and homeless 20 youth; 4 (3) in subsection (d)— 5 (A) in paragraph (1)— 6 (i) by inserting ‘‘age, gender, develop- 7 mentally, and culturally and linguistically 8 appropriate, to the extent practicable,’’ after 9 ‘‘provide’’; 10 (ii) by striking ‘‘families (including 11 unrelated individuals in the family house- 12 holds) of such youth’’ and inserting ‘‘fami- 13 lies of such youth (including unrelated indi- 14 viduals in the family households of such 15 youth and, if appropriate, individuals iden- 16 tified by such youth as family)’’; and 17 (iii) by inserting ‘‘suicide prevention,’’ 18 after ‘‘physical health care,’’; 19 (B) in paragraph (4)— 20 (i) by inserting ‘‘, including training 21 on trauma-informed and youth-centered 22 care’’ after ‘‘home-based services’’;
