To amend the Immigration and Nationality Act to require the Secretary
of Homeland Security to parole into the United States certain relatives
of current and former members of the Armed Forces, and for other
purposes.

A BILL
To amend the Immigration and Nationality Act to require
the Secretary of Homeland Security to parole into the
United States certain relatives of current and former
members of the Armed Forces, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Military Family Parole
4
in Place Act’’.

SEC. 2. PAROLE FOR CERTAIN RELATIVES OF CURRENT

AND FORMER MEMBERS OF THE ARMED
2
FORCES.

Section 212(d)(5) of the Immigration and Nationality
4
Act (8 U.S.C. 1182(d)(5)) is amended—
5
(1) in subparagraph (A), by striking ‘‘subpara-
6
graph (B) or’’ and inserting ‘‘subparagraphs (B)
7
and (C) and’’;
8
(2) by striking ‘‘Attorney General’’ each place
9
such term appears and inserting ‘‘Secretary of
10
Homeland Security’’; and
11
(3) by adding at the end the following:

‘‘(C)(i) Except as provided in clause (iii), the Sec-
13
retary of Homeland Security shall parole into the United
14
States an alien who is the spouse, widow or widower, par-
15
ent, or child of—
16
‘‘(I) a member of the Armed Forces on active
17
duty;
18
‘‘(II) a member of the Selected Reserve of the
19
Ready Reserve; or
20
‘‘(III) an individual, whether living or deceased,
21
who—
22
‘‘(aa) previously served as—
23
‘‘(AA) a member of the Armed Forces
24
on active duty; or

‘‘(BB) a member of the Selected Re-
1
serve of the Ready Reserve; and
2
‘‘(bb) was discharged or released from
3
such service under a condition other than dis-
4
honorable.
5
‘‘(ii) The Secretary of Homeland Security shall parole
6
an alien into the United States under clause (i) in 1-year
7
increments.
8
‘‘(iii)(I) An application for parole under this subpara-
9
graph may be denied only if the Secretary of Homeland
10
Security, the Secretary of Defense, and the Secretary of
11
Veterans Affairs jointly issue a written justification for the
12
denial.
13
‘‘(II) The Secretary of Homeland Security, the Sec-
14
retary of Defense, and the Secretary of Veterans Affairs
15
may not delegate the responsibility described in subclause
16
(I).

‘‘(III)(aa) In the case of a denial under subclause (I),
18
the Secretary of Homeland Security shall publish on a
19
publicly available internet website of the Department of
20
Homeland Security information about the denial, includ-
21
ing a detailed justification for the denial.
22
‘‘(bb) Information published under item (aa) shall not
23
include personally identifiable information.’’.
