FAA OUTREACH TO COMMUNITY AND ELECTED OF- 1 FICIALS WHEN PROPOSING NEW OR MODI- 2 FIED FLIGHT PROCEDURES. 3 (a) IN GENERAL.—In order to avoid having to subse- 4 quently modify products and services developed as a part 5 of the NextGen Performance Based Navigation (PBN) 6 Implementation Process—FAA Order JO7100.41A, the 7 Administrator of the Federal Aviation Administration 8 shall comply with the requirements of this section. 9 (b) NOTIFICATION TO OFFICIALS.—The Adminis- 10 trator shall notify the public of any proposed new PBN 11 flight procedure or flight procedure change affecting air- 12 space at altitudes below 18,000 feet. This notification 13 shall be made not later than 30 days after the date of 14 the entry of the procedure into the FAA Performance 15 Based Navigation IFP Gateway to the elected governing 16 body of each of the cities and counties within 5 miles of 17 such a proposed new or modified flight procedure, to any 18 Member of Congress whose district is within 5 miles of 19 such a proposed new or modified flight procedure, and to 20 any Aviation Roundtable whose jurisdictional area is with- 21 in 5 miles of such a proposed new or modified flight proce- 22 dure. 23 (c) NOTIFICATION CONTENTS.—Notification shall be 24 made with sufficient specificity for an official to determine 25 if such new or modified flight procedure being processed 26 VerDate Sep 11 2014 23:24 Nov 26, 2019 Jkt 099200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H5111.IH H5111 tkelley on DSKBCP9HB2PROD with BILLS 3 •HR 5111 IH is likely to affect constituents of such official and shall 1 include— 2 (1) name of flight procedure; 3 (2) name of the proponent of the flight proce- 4 dure; 5 (3) whether the flight procedure is a new or 6 modified procedure and, if modified, the changes 7 being proposed; 8 (4) name of existing procedure if the procedure 9 substantially replaces an existing procedure; 10 (5) approximate flight path including latitude 11 and longitude of the proposed procedure overlaid on 12 a satellite map such as Google Earth or similar; 13 (6) approximate altitudes of proposed flight 14 path; and 15 (7) contact person to provide additional infor- 16 mation. 17 (d) DEFINITIONS.—In this section, the following defi- 18 nitions apply: 19 (1) AVIATION ROUNDTABLE.—The term ‘‘Avia- 20 tion Roundtable’’ means an organization designed to 21 address community concerns over a sustained period 22 of time regarding aircraft operations often associ- 23 ated with a nearby airport. 24 VerDate Sep 11 2014 23:24 Nov 26, 2019 Jkt 099200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H5111.IH H5111 tkelley on DSKBCP9HB2PROD with BILLS 4 •HR 5111 IH (2) FAA ORDER JO7100.41A.—The term ‘‘FAA 1 Order JO7100.41A’’ means FAA Order 2 JO7100.41A and any other successor versions of 3 such Order. 4 (3) FLIGHT PROCEDURE.—The term ‘‘flight 5 procedure’’ means a preplanned Instrument Flight 6 Rules (IFR) procedure published for pilot use, in 7 graphic or textual format, that provides obstruction 8 clearance from the terminal area to the en route 9 structure (departure) or from the en route structure 10 to the terminal area (arrival). 11 (4) IFP.—The term ‘‘IFP’’ means instrument 12 flight procedure. 13 (5) INSTRUMENT FLIGHT PROCEDURES GATE- 14 WAY.—The term ‘‘Instrument Flight Procedures 15 Gateway’’ means a centralized instrument flight pro- 16 cedures data portal providing, among others, current 17 IFPs under Development or Amendments with Ten- 18 tative Publication Date and Status. 19 (6) ELECTED GOVERNING BODY.—The term 20 ‘‘elected governing body’’ means a municipal body 21 having legislative and administrative powers, such as 22 passing ordinances and appropriating funds, such as 23 a City Council, Town Council, County Board of Su- 24 pervisors, or similar. 25 VerDate Sep 11 2014 23:24 Nov 26, 2019 Jkt 099200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H5111.IH H5111 tkelley on DSKBCP9HB2PROD with BILLS 5 •HR 5111 IH (7) PBN.—The term ‘‘PBN’’ means perform- 1 ance based navigation. 2 Æ VerDate Sep 11 2014 23:24 Nov 26, 2019 Jkt 099200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6301 E:\BILLS\H5111.IH H5111 tkelley on DSKBCP9HB2PROD with BILLS
