Mr. SCHUMER (for himself, Mr. CRAMER, Mr. INHOFE, Mr. ISAKSON, Mr.
DAINES, Mrs. GILLIBRAND, Ms. KLOBUCHAR, and Ms. DUCKWORTH) in-
troduced the following bill; which was read twice and referred to the Com-
mittee on Banking, Housing, and Urban Affairs
A BILL
To require the Secretary of the Treasury to mint coins
in commemoration of the National Purple Heart Honor
Mission.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘National Purple Heart
4
Honor Mission Commemorative Coin Act’’.
5
SEC. 2. FINDINGS.
6
The Congress finds the following:
7
(1) The mission of the National Purple Heart
8
Honor Mission is—

(A) to commemorate the extraordinary sac-
1
rifice of servicemembers of the United States
2
who were killed or wounded by enemy action;
3
and
4
(B) to collect and preserve the stories of
5
Purple Heart recipients from all branches of
6
service and across generations to ensure that all
7
recipients are represented.

(2) The National Purple Heart Honor Mission
9
first opened its doors on November 10, 2006, in
10
New Windsor, New York.
11
(3) The National Purple Heart Honor Mission
12
is colocated with the New Windsor Cantonment
13
State Historic Site.
14
(4) The National Purple Heart Mission esti-
15
mates 1,800,000 servicemembers of the United
16
States were wounded or killed in action representing
17
recipients from the Civil War to the present day,
18
serving as a living memorial to their sacrifice by
19
sharing their stories through interviews, exhibits,
20
and the Roll of Honor, an interactive computer data-
21
base of each recipient enrolled.

SEC. 3. COIN SPECIFICATIONS.
1
(a) DENOMINATIONS.—The Secretary of the Treas-
2
ury (hereafter in this Act referred to as the ‘‘Secretary’’)
3
shall mint and issue the following coins:
4
(1) $5 GOLD COINS.—Not more than 50,000 $5
5
coins, which shall—
6
(A) weigh 8.359 grams;
7
(B) have a diameter of 0.850 inches; and
8
(C) contain 90 percent gold and 10 percent
9
alloy.

(2) $1 SILVER COINS.—Not more than 400,000
11
$1 coins, which shall—
12
(A) weigh 26.73 grams;
13
(B) have a diameter of 1.500 inches; and
14
(C) contain not less than 90 percent silver.

(3) HALF-DOLLAR
CLAD
COINS.—Not more
16
than 750,000 half-dollar coins which shall—
17
(A) weigh 11.34 grams;
18
(B) have a diameter of 1.205 inches; and
19
(C) be minted to the specifications for half-
20
dollar coins contained in section 5112(b) of title
21
31, United States Code.

(b) LEGAL TENDER.—The coins minted under this
23
Act shall be legal tender, as provided in section 5103 of
24
title 31, United States Code.

(c) NUMISMATIC ITEMS.—For purposes of section
1
5134 of title 31, United States Code, all coins minted
2
under this Act shall be considered to be numismatic items.

SEC. 4. DESIGNS OF COINS.
4
(a) DESIGNS REQUIREMENTS.—
5
(1) IN
GENERAL.—The designs of the coins
6
minted under this Act shall be emblematic of the
7
mission of the National Purple Heart Honor Mis-
8
sion.
9
(2) DESIGNATION
AND
INSCRIPTIONS.—On
10
each coin minted under this Act there shall be—
11
(A) a designation of the value of the coin;
12
(B) an inscription of the year ‘‘2022’’; and
13
(C) inscriptions of the words ‘‘Liberty’’,
14
‘‘In God We Trust’’, ‘‘United States of Amer-
15
ica’’, and ‘‘E Pluribus Unum’’.
16
(b) SELECTION.—The designs for the coins minted
17
under this Act shall be—
18
(1) selected by the Secretary after consultation
19
with the Commission of Fine Arts and the National
20
Purple Heart Honor Mission, Inc.; and
21
(2) reviewed by the Citizens Coinage Advisory
22
Committee.

SEC. 5. ISSUANCE OF COINS.

(a) QUALITY OF COINS.—Coins minted under this
2
Act shall be issued in uncirculated and proof qualities.
3
(b) PERIOD
FOR ISSUANCE.—The Secretary may
4
issue coins minted under this Act only during the 1-year
5
period beginning on January 1, 2022.
6
SEC. 6. SALE OF COINS.
7
(a) SALE PRICE.—The coins issued under this Act
8
shall be sold by the Secretary at a price equal to the sum
9
of—
10
(1) the face value of the coins;
11
(2) the surcharge provided in section 7(a) with
12
respect to such coins; and
13
(3) the cost of designing and issuing the coins
14
(including labor, materials, dies, use of machinery,
15
overhead expenses, marketing, and shipping).
16
(b) BULK SALES.—The Secretary shall make bulk
17
sales of the coins issued under this Act at a reasonable
18
discount.
19
(c) PREPAID ORDERS.—
20
(1) IN GENERAL.—The Secretary shall accept
21
prepaid orders for the coins minted under this Act
22
before the issuance of such coins.
23
(2) DISCOUNT.—Sale prices with respect to pre-
24
paid orders under paragraph (1) shall be at a rea-
25
sonable discount.

SEC. 7. SURCHARGES.
1
(a) IN GENERAL.—All sales of coins issued under this
2
Act shall include a surcharge of—
3
(1) $35 per coin for the $5 coin;
4
(2) $10 per coin for the $1 coin; and
5
(3) $5 per coin for the half-dollar coin.
6
(b) DISTRIBUTION.—Subject to section 5134(f)(1) of
7
title 31, United States Code, all surcharges received by
8
the Secretary from the sale of coins issued under this Act
9
shall be promptly paid by the Secretary to the National
10
Purple Heart Honor Mission, Inc. to support the mission
11
of the National Purple Heart Honor Mission, Inc., includ-
12
ing capital improvements to the National Purple Heart
13
Honor Mission facilities.
14
(c) AUDITS.—The National Purple Heart Honor Mis-
15
sion, Inc. shall be subject to the audit requirements of sec-
16
tion 5134(f)(2) of title 31, United States Code, with re-
17
gard to the amounts received under subsection (b).
18
(d) LIMITATION.—Notwithstanding subsection (a),
19
no surcharge may be included with respect to the issuance
20
under this Act of any coin during a calendar year if, as
21
of the time of such issuance, the issuance of such coin
22
would result in the number of commemorative coin pro-
23
grams issued during such year to exceed the annual 2
24
commemorative coin program issuance limitation under
25
section 5112(m)(1) of title 31, United States Code (as in

effect on the date of the enactment of this Act). The Sec-
1
retary of the Treasury may issue guidance to carry out
2
this subsection.

SEC. 8. FINANCIAL ASSURANCES.
4
The Secretary shall take such actions as may be nec-
5
essary to ensure that—
6
(1) minting and issuing coins under this Act re-
7
sult in no net cost to the Federal Government; and
8
(2) no funds, including applicable surcharges,
9
are disbursed to any recipient designated in section
10
7(b) until the total cost of designing and issuing all
11
of the coins authorized by this Act, including labor,
12
materials, dies, use of machinery, overhead expenses,
13
marketing, and shipping, is recovered by the United
14
States Treasury, consistent with sections 5112(m)
15
and 5134(f) of title 31, United States Code.
