To amend the Public Health Service Act to provide for treatment of certain
respiratory protective devices as covered countermeasures for purposes
of targeted liability protections for pandemic and epidemic products and
security countermeasures, and for other purposes.

following bill; which was referred to the Committee on Energy and Commerce

To amend the Public Health Service Act to provide for
treatment of certain respiratory protective devices as cov-
ered countermeasures for purposes of targeted liability
protections for pandemic and epidemic products and se-
curity countermeasures, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Health Care Workforce
4
Protection Act of 2019’’.

VICES AS COVERED COUNTERMEASURES.

Section 319F–3(i)(1) of the Public Health Service
3
Act (42 U.S.C. 247d–6d(i)(1)) is amended—
4
(1) in subparagraph (B), by striking ‘‘or’’ at
5
the end;
6
(2) in subparagraph (C), by striking the period
7
at the end and inserting ‘‘; or’’; and
8
(3) by adding at the end the following:
9
‘‘(D) a respiratory protective device that is
10
approved under part 84 of title 42, Code of
11
Federal Regulations (or successor regula-
12
tions).’’.
