Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Banning Smoking on 4 Amtrak Act of 2019’’. 5 SEC. 2. Prohibition on smoking on Amtrak trains 1 ‘‘(a) PROHIBITION.—Beginning on the date of the en- 2 actment of the Banning Smoking on Amtrak Act of 2019, 3 Amtrak shall prohibit smoking on board Amtrak trains. 4 ‘‘(b) ELECTRONIC CIGARETTES.— 5 ‘‘(1) INCLUSION.—The use of an electronic cig- 6 arette shall be treated as smoking for purposes of 7 this section. 8 ‘‘(2) ELECTRONIC CIGARETTE DEFINED.—In 9 this subsection, the term ‘electronic cigarette’ means 10 a device that delivers nicotine or other substances to 11 a user of the device in the form of a vapor that is 12 inhaled to simulate the experience of smoking.’’. 13 (b) CONFORMING AMENDMENT.—The table of sec- 14 tions for chapter 243 of title 49, United States Code, is 15 amended by adding at the end the following: 16 ‘‘24323.
