What This Bill Does
This bill prohibits colleges and universities from receiving federal money if they host or work with a student health clinic that provides abortion drugs or performs abortions for students or employees. The bill requires colleges that operate student health clinics to submit annual reports certifying that their clinics do not provide abortion drugs or abortions.

• Student health clinics covered by this law include clinics on college campuses offering primary care, family planning services, telehealth services, and pharmacy services, but do not include hospitals (Sec. 2(c)(3))
What Changes
Colleges receiving federal funds would lose that funding if their on-campus student health clinics provide abortion drugs or abortions. Colleges would need to submit annual reports about their clinics' practices related to abortion.
Important Definitions
"Abortion drug" - any drug or combination of drugs meant to end a pregnancy, except treatments for ectopic pregnancies, removal of deceased unborn children, or procedures producing live births.
"School-based service site" - a clinic providing health care on a college campus that accepts federal money, but not hospitals.

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Protecting Life on Col-
2
lege Campus Act of 2023’’.

SEC. 2. PROHIBITION ON AWARD OF FUNDS TO CERTAIN
4
INSTITUTIONS OF HIGHER EDUCATION.

(a) PROHIBITION.—No Federal funds may be award-
6
ed (directly or indirectly, including through a contract or
7
subcontract) to any institution of higher education that
8
hosts or is affiliated with any school-based service site that
9
provides abortion drugs or abortions to students of the
10
institution or to employees of the institution or site.
11
(b) ANNUAL REPORTING.—To remain eligible for
12
awards of Federal funds, an institution of higher edu-
13
cation that hosts or is affiliated with one or more school-
14
based service sites shall submit an annual report to the
15
Secretary of Education and the Secretary of Health and
16
Human Services certifying that no such site provides abor-
17
tion drugs or abortions to students of the institution or
18
to employees of the institution or site.
19
(c) DEFINITIONS.—In this section:
20
(1) The term ‘‘abortion drug’’ means any drug,
21
substance, or combination of drugs or substances
22
that is intended for use or that is in fact used (irre-
23
spective of how the product is labeled)—
24
(A) to intentionally kill the unborn child of
25
a woman known to be pregnant; or

(B) to intentionally terminate the preg-

nancy of a woman known to be pregnant, with
2
an intention other than—
3
(i) to produce a live birth;
4
(ii) to remove a dead unborn child; or
5
(iii) to treat an ectopic pregnancy.

(2) The term ‘‘institution of higher education’’
7
has the meaning given to such term in section 101
8
of the Higher Education Act of 1965 (20 U.S.C.
9
1001).

(3) The term ‘‘school-based service site’’
11
means—
12
(A) a clinic providing health care services
13
(including primary health services, family plan-
14
ning services, telehealth services, and pharma-
15
ceutical services, without regard to whether the
16
services are provided by employees of the clinic
17
or contracted providers) to students that is lo-
18
cated on the campus of an institution of higher
19
education that accepts Federal funding; and
20
(B) does not include a hospital (as defined
21
in section 1861(e) of the Social Security Act
22
(42 U.S.C. 1395x(e))).
