the requirements applicable to the Office of Small Business and Dis-
advantaged Business Utilization of the Federal agency, and for other
purposes.

A BILL
To require Federal agencies to report to Congress on non-
compliance with the requirements applicable to the Office
of Small Business and Disadvantaged Business Utiliza-
tion of the Federal agency, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Small Business Con-
4
tracting Accountability Act of 2019’’.

BUSINESS UTILIZATION.

Section 15(k) of the Small Business Act (15 U.S.C.
3
644(k)) is amended, in the matter preceding paragraph
4
(1)—
5
(1) by inserting after the first sentence the fol-
6
lowing: ‘‘If the Government Accountability Office
7
has determined that a Federal agency is not in com-
8
pliance with all of the requirements under this sub-
9
section, the Federal agency shall, not later than 120
10
days after that determination or 120 days after the
11
date of enactment of the Small Business Contracting
12
Accountability Act of 2019, whichever is later, sub-
13
mit to the Committee on Small Business and Entre-
14
preneurship of the Senate and the Committee on
15
Small Business of the House of Representatives a
16
report that includes the reasons why the Federal
17
agency is not in compliance and the specific actions
18
that the Federal agency will take to comply with the
19
requirements under this subsection.’’; and
20
(2) by striking ‘‘The management of each such
21
office’’ and inserting ‘‘The management of each Of-
22
fice of Small Business and Disadvantaged Business
23
Utilization’’.
