Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Strengthening Services 4 for Native Elders Act of 2019’’. 5 SEC. 2. AUTHORIZATION OF APPROPRIATIONS. 4 ‘‘There are authorized to be appropriated to carry out 5 this title— 6 ‘‘(1) for parts A and B, $38,524,324 for fiscal 7 year 2020, $40,835,783 for fiscal year 2021, 8 $43,285,930 for fiscal year 2022, $45,883,086 for 9 fiscal year 2023, and $48,636,071 for fiscal year 10 2024; and 11 ‘‘(2) for part C, subject to section 644, 12 $10,785,575 for fiscal year 2020, $11,432,710 for 13 fiscal year 2021, $12,118,672 for fiscal year 2022, 14 $12,845,792 for fiscal year 2023, and $13,616,540 15 for fiscal year 2024.’’; and 16 (B) by adding at the end the following: 17 ‘‘SEC. 644. FUNDING SET ASIDE. 18 ‘‘(a) IN GENERAL.—Of the amount appropriated 19 under section 643(2) for a fiscal year, the Assistant Sec- 20 retary shall, subject to subsection (b), make available an 21 amount, not to exceed 5 percent of the amount appro- 22 priated under section 643(2) for the fiscal year, to carry 23 out part D for such fiscal year. 24 VerDate Sep 11 2014 03:19 Oct 26, 2019 Jkt 099200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S2696.IS S2696 kjohnson on DSK79L0C42 with BILLS 3 •S 2696 IS ‘‘(b) APPLICABILITY.—The requirement under sub- 1 section (a) shall apply for a fiscal year only if— 2 ‘‘(1) the amount appropriated for parts A and 3 B for the fiscal year is greater than the amount ap- 4 propriated for such parts for fiscal year 2019; and 5 ‘‘(2) the amount the Assistant Secretary makes 6 available for parts A and B for such fiscal year is 7 not less than the amount the Assistant Secretary 8 made available for such parts for fiscal year 2019.’’; 9 (2) by redesignating part D as part E; and 10 (3) by inserting after part C the following: 11 ‘‘PART D—SUPPORTIVE SERVICES FOR HEALTHY 12 AGING AND INDEPENDENCE 13 ‘‘SEC. 636. PROGRAM. 14 ‘‘(a) IN GENERAL.—The Assistant Secretary shall 15 carry out a competitive demonstration program for mak- 16 ing grants to tribal organizations or Native Hawaiian or- 17 ganizations with applications approved under part A or 18 B, respectively, to pay for the Federal share of carrying 19 out programs to enable the organizations to build their 20 capacity to provide a wider range of in-home and commu- 21 nity supportive services to enable older individuals to 22 maintain their health and independence and to avoid long- 23 term care facility placement. 24 ‘‘(b) SUPPORTIVE SERVICES.— 25 VerDate Sep 11 2014 03:19 Oct 26, 2019 Jkt 099200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\S2696.IS S2696 kjohnson on DSK79L0C42 with BILLS 4 •S 2696 IS ‘‘(1) IN GENERAL.—Subject to paragraph (2), 1 supportive services described in subsection (a) may 2 include any of the activities described in section 3 321(a). 4 ‘‘(2) PRIORITY.—The Assistant Secretary, in 5 making grants under this section, shall give priority 6 to organizations that will use the grant funds for 7 supportive services described in subsection (a) that 8 are for in-home assistance, transportation, informa- 9 tion and referral, case management, health and 10 wellness programs, legal services, family caregiver 11 support services, and other services that directly 12 support the independence of the older individuals 13 served. 14 ‘‘(c) RULE OF CONSTRUCTION.—Nothing in this sec- 15 tion shall be construed or interpreted to prohibit the provi- 16 sion of supportive services under part A or B.’’. 17 SEC. 3. ENHANCING CAPACITY TO SUPPORT NATIVE AMER- 18 ICAN AGING PROGRAMS. 19 Title II of the Older Americans Act of 1965 (42 20 U.S.C. 3011 et seq.) is amended— 21 (1) in section 201(c)(3)(H) (42 U.S.C. 22 3011(c)(3)(H)), by inserting ‘‘to ensure adequate ca- 23 pacity to deliver the services under such title, which 24 technical assistance and training programs may in- 25 VerDate Sep 11 2014 03:19 Oct 26, 2019 Jkt 099200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\S2696.IS S2696 kjohnson on DSK79L0C42 with BILLS 5 •S 2696 IS clude program management, data development and 1 use, basic business skills, grant development, pro- 2 gram and service innovations, and staff professional 3 development and certification’’ before the semicolon 4 at the end; and 5 (2) by amending section 216 (42 U.S.C. 3020f) 6 to read as follows: 7 ‘‘SEC. 216.
