REQUIRING REPORTS BY LAW ENFORCEMENT OFFI- 1 CERS IN THE EVENT OF AN INJURY OR FA- 2 TALITY. 3 (a) IN GENERAL.—Beginning in fiscal year 2021 and 4 each fiscal year thereafter, the Attorney General shall re- 5 duce by 10 percent the amount that a State or unit of 6 local government would otherwise receive under a grant 7 program described in subsection (b), if the State or unit 8 of local government does not have in place a law requiring 9 the submission of reports by State and local law enforce- 10 ment officers that is substantially similar to the reporting 11 requirement under section 3. 12 (b) GRANT PROGRAMS DESCRIBED.—The grant pro- 13 grams described in this subsection are the following: 14 (1) The Edward Byrne Memorial Justice As- 15 sistance Grant Program under subpart 1 of part E 16 of title I of the Omnibus Crime Control and Safe 17 Streets Act of 1968 (34 U.S.C. 10151 et seq.). 18 (2) The ‘‘Cops on the Beat’’ grant program 19 under part Q of title I of the Omnibus Crime Con- 20 trol and Safe Streets Act of 1968 (34 U.S.C. 10381 21 et seq.). 22 (c) REALLOCATION.—Amounts not allocated under a 23 program described in subsection (b) to a State or unit of 24 local government for failure to comply with this section 25 shall be reallocated under that program to States and 26 VerDate Sep 11 2014 22:01 Oct 28, 2019 Jkt 099200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H4798.IH H4798 kjohnson on DSK79L0C42 with BILLS 3 •HR 4798 IH units of local government that are in compliance with this 1 section. 2 SEC. 3. REPORTING REQUIREMENT FOR FEDERAL LAW EN- 3 FORCEMENT OFFICERS. 4 (a) REQUIREMENT.—In the case that an individual 5 is injured or killed by a Federal law enforcement officer 6 while in the custody or control of the officer, or otherwise 7 in the course of the law enforcement officer’s employ- 8 ment— 9 (1) not later than 24 hours after such injury or 10 death occurs, such law enforcement officer shall sub- 11 mit to the Attorney General a report, which de- 12 scribes, in detail, the facts and circumstances sur- 13 rounding such injury or death; 14 (2) any Federal law enforcement officer who is 15 present at the time of the injury or death, or is in- 16 volved during the 12-hour period following the injury 17 or death in the transportation or care of the indi- 18 vidual, or any administrative procedures relating to 19 the individual, shall, not later than 24 hours after 20 the conclusion of such involvement, submit to the 21 Attorney General a report, which describes, in detail, 22 the facts and circumstances surrounding such in- 23 volvement; and 24 VerDate Sep 11 2014 22:01 Oct 28, 2019 Jkt 099200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H4798.IH H4798 kjohnson on DSK79L0C42 with BILLS 4 •HR 4798 IH (3) the Inspector General of the Department of 1 Justice shall investigate the facts and circumstances 2 surrounding such injury or death, and submit a re- 3 port to the Attorney General not later than 60 days 4 after such injury or death. 5 (b) CRIMINAL PENALTY.—Whoever, being a Federal 6 law enforcement officer required to submit a report under 7 subsection (a), knowingly— 8 (1) fails to submit such a report; or 9 (2) submits a report containing false or mis- 10 leading information, 11 shall be fined under title 18, United States Code, impris- 12 oned not more than 5 years, or both. 13 (c) DEFINITION.—In this Act, the term ‘‘Federal law 14 enforcement officer’’ has the meaning given the term in 15 section 115 of title 18, United States Code. 16 Æ VerDate Sep 11 2014 22:01 Oct 28, 2019 Jkt 099200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6301 E:\BILLS\H4798.IH H4798 kjohnson on DSK79L0C42 with BILLS
