A BILL
To provide for cooperation between the Commodity Futures
Trading Commission and foreign regulators.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘International Regu-
4
latory Cooperation Improvement Act’’.
5
SEC. 2. INTERNATIONAL REGULATORY COOPERATION.
6
(a) Section 1a(26) of the Commodity Exchange Act
7
(7 U.S.C. 1a(26)) is amended by striking ‘‘futures or op-
8
tions’’ each place it appears and inserting ‘‘futures, swaps,
9
or options.’’.

(b) CLARIFICATION OF MEANING OF FOREIGN FU-
1
TURES AUTHORITY.—Section 8 of such Act (7 U.S.C. 12)
2
is amended by adding at the end the following:
3
‘‘(j) For purposes of this section, the term ‘foreign
4
futures authority’ includes any foreign authority that is
5
empowered under foreign law to detect, investigate, or
6
prosecute potential violations of law.’’.

(c) AUTHORITY TO PROVIDE FOOD AND INCIDENTAL
8
ASSISTANCE TO FOREIGN GUESTS HOSTED BY THE COM-
9
MISSION.—Section 12(b) of such Act (7 U.S.C. 16(b)) is
10
amended by adding at the end the following:
11
‘‘(5) The Commission may incur expenses for
12
consultations and meetings hosted by the Commis-
13
sion with foreign governmental and other regulatory
14
officials, such expenses to include necessary logistic
15
and administrative expenses and the expenses of
16
Commission staff and foreign invitees in attendance
17
including:
18
‘‘(A) meals;
19
‘‘(B) local travel and transportation; and
20
‘‘(C) related incidental expenses.’’.

(d) TRANSFER AND ACCEPTANCE OF PERSONNEL.—
22
Section 2(a) of such Act (7 U.S.C. 2(a)) is amended by
23
adding at the end the following:

‘‘(16) ASSISTANCE
FROM
FEDERAL
AGEN-

CIES.—Any department or agency of the United
2
States may cooperate with and provide to the Com-
3
mission, any assistance, including services, funds, fa-
4
cilities, employees, and other support services as de-
5
termined by the Commission to effectuate the pur-
6
poses and provisions of this Act. An employee from
7
another department or agency of the United States
8
may be detailed to the Commission on a reimburs-
9
able or non-reimbursable basis, and the detail shall
10
be without interruption or loss of civil service status
11
or privilege.

‘‘(17) ASSISTANCE
FROM
FOREIGN
FUTURES

AUTHORITIES, FOREIGN
GOVERNMENT
AGENCIES,
14
FOREIGN MINISTRIES, FOREIGN CENTRAL BANKS, OR
15
FOREIGN PERSONS.—

‘‘(A)
IN
GENERAL.—The
Commission

may—
18
‘‘(i) retain or employ officers or em-
19
ployees of a foreign futures authority, for-
20
eign government agency, foreign ministry,
21
foreign central bank, or foreign person on
22
a temporary basis as employees of the
23
Commission pursuant to section 12(b) of

this Act or section 3101 or section 3109 of

title 5, United States Code; and
2
‘‘(ii) detail officers or employees of
3
the Commission to work on a temporary
4
basis for any such foreign entity.

‘‘(B)
RECIPROCITY
AND
REIMBURSE-
6
MENT.—
7
‘‘(i) RECIPROCITY NOT REQUIRED.—
8
Assistance described in subparagraph (A)
9
need not be provided on a reciprocal basis.
10
‘‘(ii)
WRITTEN
AGREEMENT
RE-
11
QUIRED.—The Commission may provide
12
and accept assistance described in sub-
13
paragraph (A) on a reimbursable or non-
14
reimbursable basis, only in accordance with
15
a written agreement between the Commis-
16
sion and the foreign entity involved.
17
‘‘(iii) RULES
APPLICABLE
TO
REIM-
18
BURSEMENTS.—
19
‘‘(I) FORM.—A reimbursement
20
to, or from or on behalf of, the Com-
21
mission may be made in cash or in-
22
kind.

‘‘(II)
ADVANCE
REIMBURSE-

MENTS.—The Commission may pro-

vide an advance reimbursement to

such a foreign entity, and may accept
2
an advance reimbursement from such
3
a foreign entity. Such an advance re-
4
imbursement shall be available for the
5
services and uses set forth in the ap-
6
plicable written agreement.

‘‘(III) USE OF REIMBURSEMENTS
8
FROM FOREIGN ENTITIES.—
9
‘‘(aa) IN
GENERAL.—The
10
Commission shall credit a reim-
11
bursement received from such a
12
foreign entity to the appropriate
13
Commission appropriation, fund,
14
or account, subject to item (bb).
15
‘‘(bb) USE OF ADVANCE RE-
16
IMBURSEMENTS.—The Commis-
17
sion may use such an advance re-
18
imbursement for direct expendi-
19
ture in lieu of making the credit
20
required by item (aa).
21
‘‘(C) STANDARDS OF CONDUCT.—An offi-
22
cer or employee employed under subparagraph
23
(A)(i) shall be subject to the provisions of law
24
relating to ethics, conflicts of interest, or cor-
