A BILL
To facilitate the automatic acquisition of citizenship for law-
ful permanent resident children of military and Federal
Government personnel residing abroad, and for other
purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Citizenship for Chil-
4
dren of Military Members and Civil Servants Act’’.

SEC. 2. FACILITATING THE AUTOMATIC ACQUISITION OF

CITIZENSHIP
FOR
LAWFUL
PERMANENT

RESIDENT CHILDREN OF MILITARY AND FED-
3
ERAL GOVERNMENT PERSONNEL RESIDING
4
ABROAD.

(a) IN GENERAL.—Section 320 of the Immigration
6
and Nationality Act (8 U.S.C. 1431) is amended—
7
(1) by amending the section header to read as
8
follows:
‘‘CHILDREN
BORN
OUTSIDE
THE
9
UNITED
STATES
AND
LAWFULLY
ADMITTED
10
FOR
PERMANENT
RESIDENCE;
CONDITIONS
11
UNDER WHICH CITIZENSHIP AUTOMATICALLY
12
ACQUIRED’’;
13
(2) by redesignating subsection (c) as sub-
14
section (d); and
15
(3) by inserting after subsection (b) the fol-
16
lowing:

‘‘(c) Subsection (a)(3) shall be deemed to be satisfied
18
with respect to a child who is lawfully admitted for perma-
19
nent residence in the United States if the child—
20
‘‘(1) is residing in the legal and physical cus-
21
tody of a citizen parent who is stationed and resid-
22
ing abroad—
23
‘‘(A) as an employee of the Government of
24
the United States; or

‘‘(B) in marital union with an employee of
1
the Government of the United States; or
2
‘‘(2)(A) is residing in the legal and physical
3
custody of a citizen parent who—
4
‘‘(i) is stationed and residing abroad as a
5
member of the Armed Forces of the United
6
States; or
7
‘‘(ii) is authorized to accompany and reside
8
abroad with a member of the Armed Forces of
9
the United States pursuant to the member’s of-
10
ficial orders, and is so accompanying and resid-
11
ing abroad with the member in marital union;
12
and
13
‘‘(B) is authorized to accompany such member
14
and reside abroad with the member pursuant to the
15
member’s official orders, and is so accompanying
16
and residing abroad with the member in the legal
17
and physical custody of the member.’’.

(b) CONFORMING AMENDMENT.—The table of con-
19
tents for the Immigration and Nationality Act (8 U.S.C.
20
1101 note) is amended by striking the item relating to
21
section 320 and inserting the following:
22
‘‘Sec. 320. Children born outside the United States and lawfully admitted for
permanent residence; conditions under which citizenship auto-
matically acquired.’’.
