To amend title 49, United States Code, to provide that only citizens or
nationals of the United States may operate trains within the United
States that originate in Mexico.

Mr. BLUMENTHAL introduced the following bill; which was read twice and
referred to the Committee on Commerce, Science, and Transportation
A BILL
To amend title 49, United States Code, to provide that
only citizens or nationals of the United States may oper-
ate trains within the United States that originate in
Mexico.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Protection of American
4
Jobs in Cross-Border Rail Operations With Mexico Act’’.

SEC. 2. CREW REQUIREMENTS FOR TRAINS ORIGINATING

IN MEXICO.

(a) IN GENERAL.—Subchapter II of chapter 201 of
3
title 49, United States Code, is amended by adding at the
4
end the following:
5
‘‘§ 20169. Crew requirements for trains originating in
6
Mexico
7
‘‘Trains originating in Mexico may only be operated
8
in the United States by crews comprised entirely of citi-
9
zens or nationals of the United States.’’.

(b) RULEMAKING.—Not later than 180 days after the
11
date of the enactment of this Act, the Secretary of Trans-
12
portation shall promulgate such regulations as may be
13
necessary to carry out the amendment made by subsection
14
(a).

(c) CONFORMING AMENDMENT.—The chapter anal-
16
ysis for subchapter II of chapter 201 of title 49, United
17
States Code, is amended by adding at the end the fol-
18
lowing:
19
‘‘20169. Crew requirements for trains originating in Mexico.’’.
