A BILL
To amend the Internal Revenue Code of 1986 to require
that States give preference in allocating low-income hous-
ing credit dollar amounts to projects which are com-
mitted to providing non-smoking buildings.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Smoke Free Affordable
4
Housing Act’’.

SEC. 2. LOW-INCOME HOUSING CREDIT ALLOCATION PREF-

ERENCE FOR NON-SMOKING BUILDINGS.

(a) IN GENERAL.—Section 42(m)(1)(B)(ii) of the In-
3
ternal Revenue Code of 1986 is amended by adding at the
4
end the following new subclause:
5
‘‘(IV) projects consisting only of
6
buildings in which smoking is not per-
7
mitted, and’’.
8
(b) EFFECTIVE DATE.—The amendment made by
9
this section shall apply to allocations made after the date
10
of the enactment of this Act.
