FINDINGS. 1 Congress finds that— 2 (1) alcohol-impaired driving fatalities represent 3 approximately 1⁄3 of all highway fatalities in the 4 United States each year; 5 (2) in 2017, there were 10,874 alcohol-impaired 6 driving fatalities in the United States involving driv- 7 ers with a blood alcohol concentration level of .08 or 8 higher, and 68 percent of the crashes that resulted 9 in those fatalities involved a driver with a blood alco- 10 hol concentration level of .15 or higher; 11 (3) the estimated economic cost for alcohol-im- 12 paired driving in 2010 was $44,000,000,000; 13 (4) the National Highway Traffic Safety Ad- 14 ministration has partnered with automobile manu- 15 facturers to develop alcohol detection technologies 16 that could be installed in vehicles to prevent drunk 17 driving; and 18 (5) the Federal Government has invested nearly 19 $50,000,000 in advanced alcohol detection software, 20 and companies are actively pursuing solutions to the 21 significant problem of drunk driving. 22 SEC. 3. ADVANCED DRUNK DRIVING PREVENTION TECH- 23 NOLOGY PROGRAM. 24 (a) DEFINITIONS.—In this section: 25 VerDate Sep 11 2014 02:34 Oct 19, 2019 Jkt 099200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S2604.IS S2604 pamtmann on DSKBC07HB2PROD with BILLS 3 •S 2604 IS (1) ADMINISTRATOR.—The term ‘‘Adminis- 1 trator’’ means the Administrator of the National 2 Highway Traffic Safety Administration. 3 (2) DADSS.—The term ‘‘DADSS’’ means the 4 Driver Alcohol Detection System for Safety Re- 5 search Program carried out through a public-private 6 partnership between the National Highway Traffic 7 Safety Administration and the Automotive Coalition 8 for Traffic Safety. 9 (3) NEW VEHICLE.—The term ‘‘new vehicle’’ 10 has the meaning given the term in section 37.3 of 11 title 49, Code of Federal Regulations (or a successor 12 regulation). 13 (b) TECHNOLOGY TRANSFER AND VEHICLE INTE- 14 GRATION.— 15 (1) IN GENERAL.—During fiscal years 2021 16 and 2022, the Administrator shall work directly with 17 vehicle manufacturers, suppliers, and other inter- 18 ested parties, including institutions of higher edu- 19 cation with expertise in automotive engineering, to 20 advance the technology developed by DADSS, and 21 other suitable advanced drunk driving prevention 22 technology, as determined by the Administrator, 23 with the goal of integrating the technology, at the 24 earliest practicable date, into new vehicles. 25 VerDate Sep 11 2014 02:34 Oct 19, 2019 Jkt 099200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\S2604.IS S2604 pamtmann on DSKBC07HB2PROD with BILLS 4 •S 2604 IS (2) FUNDING.—Any amounts made available to 1 carry out this subsection under subsection (h)(1) 2 shall be made available for the purposes described in 3 paragraph (1) pursuant to the existing cooperative 4 agreement entered into by the Administrator and the 5 Automotive Coalition for Traffic Safety to carry out 6 DADSS. 7 (c) DEMONSTRATION OF TECHNOLOGY IN FEDERAL 8 FLEETS.— 9 (1) IN GENERAL.—Beginning in fiscal year 10 2021, the Administrator shall work with the Admin- 11 istrator of General Services to demonstrate advanced 12 drunk driving prevention technology in not fewer 13 than 2,500 vehicles in Federal fleets. 14 (2) REQUIREMENTS.—In carrying out para- 15 graph (1), the Administrator shall ensure that the 16 fleet vehicles in which advanced drunk driving pre- 17 vention technology is demonstrated— 18 (A) are driven not less than 3 days per 19 week; 20 (B) are located in various regions in the 21 United States; and 22 (C) collectively include not more than three 23 make, model, and model year combinations. 24 VerDate Sep 11 2014 02:34 Oct 19, 2019 Jkt 099200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\S2604.IS S2604 pamtmann on DSKBC07HB2PROD with BILLS 5 •S 2604 IS (d) PILOT DEPLOYMENT OF PROTOTYPE ADVANCED 1 DRUNK DRIVING PREVENTION TECHNOLOGY IN NON- 2 FEDERAL FLEETS.— 3 (1) IN GENERAL.—To assist in the development 4 of, and to aid the creation of market demand for, 5 advanced drunk driving prevention technology, the 6 Administrator shall carry out a program to encour- 7 age the use of advanced drunk driving prevention 8 technology in— 9 (A) State and local government fleets; and 10 (B) private sector fleets. 11 (2) FUNDING.— 12 (A) IN GENERAL.—Out of any amounts 13 made available to the Administrator and not 14 otherwise obligated, the Administrator shall use 15 such sums as are necessary to carry out para- 16 graph (1). 17 (B) EXISTING PROGRAM FUNDING.—The 18 Administrator may continue to use, in accord- 19 ance with existing guidelines for the relevant 20 fund, any Federal fund used by the Adminis- 21 trator on the date of enactment of this Act to 22 carry out an existing program that satisfies the 23 requirements of paragraph (1). 24 VerDate Sep 11 2014 02:34 Oct 19, 2019 Jkt 099200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6201 E:\BILLS\S2604.IS S2604 pamtmann on DSKBC07HB2PROD with BILLS 6 •S 2604 IS (e) REPORT.—Not later than 1 year after the date 1 of enactment of this Act, and every 180 days thereafter, 2 the Administrator shall submit to the Committee on Com- 3 merce, Science, and Transportation of the Senate and the 4 Committee on Energy and Commerce of the House of 5 Representatives a report describing the progress of the 6 Administrator in carrying out subsections (c) and (d). 7 (f) STAKEHOLDER TEAM.— 8 (1) IN GENERAL.—The Administrator shall es- 9 tablish and maintain a team, to be known as the 10 ‘‘Stakeholder Team’’, to provide input for the Ad- 11 ministrator to consider on issues of public policy, de- 12 ployment, and State law relating to the deployment 13 of advanced drunk driving prevention technology in 14 motor vehicles. 15 (2) MEMBERSHIP.—The Stakeholder Team 16 shall be composed of— 17 (A) vehicle manufacturers; 18 (B) suppliers; 19 (C) safety advocates; 20 (D) fleet administrators or managers; and 21 (E) other interested parties with expertise 22 in public policy, marketing, or product release. 23 (g) RULEMAKING.— 24 VerDate Sep 11 2014 02:34 Oct 19, 2019 Jkt 099200 PO 00000 Frm 00006 Fmt 6652 Sfmt 6201 E:\BILLS\S2604.IS S2604 pamtmann on DSKBC07HB2PROD with BILLS 7 •S 2604 IS (1) IN GENERAL.—Subject to paragraph (3), 1 not later than 2 years after the date of enactment 2 of this Act, the Administrator shall issue a final rule 3 prescribing a Federal motor vehicle safety standard 4 that requires advanced drunk driving prevention 5 technology in all new vehicles. 6 (2) REQUIREMENTS.— 7 (A) LEAD TIME.—The compliance date of 8 the rule issued under paragraph (1) shall be not 9 more than 2 model years after the effective date 10 of that rule. 11 (B) TECHNICAL CAPABILITY.—Any ad- 12 vanced drunk driving prevention technology re- 13 quired for new vehicles under paragraph (1) 14 that measures blood alcohol concentration shall 15 automatically use the legal limit for blood alco- 16 hol concentration of the jurisdiction in which 17 the vehicle is located. 18 (3) TIMING.—If the Administrator determines 19 that it is not practicable to issue the rule described 20 in paragraph (1) by the applicable date, the Admin- 21 istrator— 22 (A) may extend the time period for such 23 time as the Administrator determines to be nec- 24 essary; and 25 VerDate Sep 11 2014 02:34 Oct 19, 2019 Jkt 099200 PO 00000 Frm 00007 Fmt 6652 Sfmt 6201 E:\BILLS\S2604.IS S2604 pamtmann on DSKBC07HB2PROD with BILLS 8 •S 2604 IS (B) shall, not later than the date described 1 in paragraph (1), and not less frequently than 2 annually thereafter until the date on which the 3 rule under that paragraph is issued, submit to 4 the Committee on Commerce, Science, and 5 Transportation of the Senate and the Com- 6 mittee on Energy and Commerce of the House 7 of Representatives a report describing, as of the 8 date of submission of the report— 9 (i) the reasons for not prescribing a 10 Federal motor vehicle safety standard that 11 requires advanced drunk driving prevention 12 technology in all new vehicles; 13 (ii) the deployment of advanced drunk 14 driving prevention technology in vehicles; 15 (iii) any information regarding the 16 ability of vehicle manufacturers to include 17 advanced drunk driving prevention tech- 18 nology in new vehicles;
