following bill; which was referred to the Committee on Ways and Means

To amend the Internal Revenue Code of 1986 to classify
certain automatic fire sprinkler system retrofits as 15-
year property for purposes of depreciation.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘High Rise Fire Sprin-
4
kler Incentive Act of 2019’’.
5
SEC. 2. CLASSIFICATION OF CERTAIN AUTOMATIC FIRE
6
SPRINKLER SYSTEM RETROFITS.
7
(a) TREATMENT AS 15-YEAR PROPERTY.—Section
8
168(e)(3)(E) of the Internal Revenue Code of 1986 is
9
amended by striking ‘‘and’’ at the end of clause (v), by

striking the period at the end of clause (vi) and inserting

‘‘, and’’, and by adding at the end the following:

‘‘(vii) any automatic fire sprinkler sys-

tem retrofit property.’’.

(b) APPLICABLE DEPRECIATION METHOD.—Section
5
168(b)(3) of such Code is amended by adding at the end
6
the following new subparagraph:
7
‘‘(H) Any automatic fire sprinkler system
8
retrofit property.’’.

(c) ALTERNATIVE SYSTEM.—The table contained in
10
section 168(g)(3)(B) of such Code is amended by inserting
11
after the item relating to subparagraph (E)(vi) the fol-
12
lowing:

(d) DEFINITION OF AUTOMATIC FIRE SPRINKLER

SYSTEM RETROFIT PROPERTY.—Section 168(i) of such
15
Code is amended by adding at the end the following new
16
paragraph:

‘‘(20) AUTOMATIC
FIRE
SPRINKLER
SYSTEM
18
RETROFIT
PROPERTY.—The term ‘automatic fire
19
sprinkler system retrofit property’ means any sprin-
20
kler system which—
21
‘‘(A) meets the standards of National Fire
22
Protection Association 13 (or any successor
23
benchmark), and

‘‘(B) is installed in a building which—
1
‘‘(i) was placed in service before the
2
date of such installation, and
3
‘‘(ii) has an occupiable floor more
4
than 75 feet above the lowest level of fire
5
department vehicle access.’’.
6
(e) EFFECTIVE DATE.—The amendments made by
7
this section shall apply after the date of enactment of this
8
Act.
