IN THE SENATE OF THE UNITED STATES SEPTEMBER 26, 2019 Mr. GRAHAM, from the Committee on Appropriations, reported the following original bill; which was read twice and placed on the calendar A BILL Making appropriations for the Department of State, foreign operations, and related programs for the fiscal year end- ing September 30, 2020, and for other purposes. Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 That the following sums are appropriated, out of any 3 money in the Treasury not otherwise appropriated, for the 4 Department of State, foreign operations, and related pro- 5 grams for the fiscal year ending September 30, 2020, and 6 for other purposes, namely: 7 2 •S 2583 RS TITLE I 1 DEPARTMENT OF STATE AND RELATED 2 AGENCY 3 DEPARTMENT OF STATE 4 ADMINISTRATION OF FOREIGN AFFAIRS 5 DIPLOMATIC PROGRAMS 6 For necessary expenses of the Department of State 7 and the Foreign Service not otherwise provided for, 8 $8,894,788,000, of which $767,244,600 may remain avail- 9 able until September 30, 2021, and of which up to 10 $3,779,824,000 may remain available until expended for 11 Worldwide Security Protection: Provided, That of the 12 funds appropriated for Worldwide Security Protection, 13 $2,626,122,000 is designated by the Congress for Over- 14 seas Contingency Operations/Global War on Terrorism 15 pursuant to section 251(b)(2)(A)(ii) of the Balanced 16 Budget and Emergency Deficit Control Act of 1985: Pro- 17 vided further, That funds made available under this head- 18 ing shall be allocated in accordance with paragraphs (1) 19 through (4) as follows: 20 (1) HUMAN RESOURCES.—For necessary ex- 21 penses for training, human resources management, 22 and salaries, including employment without regard 23 to civil service and classification laws of persons on 24 a temporary basis (up to $700,000), as authorized 25 3 •S 2583 RS by section 801 of the United States Information and 1 Educational Exchange Act of 1948 (62 Stat. 11; 2 Chapter 36), $2,878,842,000, of which up to 3 $508,129,000 is for Worldwide Security Protection. 4 (2) OVERSEAS PROGRAMS.—For necessary ex- 5 penses for the regional bureaus of the Department 6 of State and overseas activities as authorized by law, 7 $1,840,143,000. 8 (3) DIPLOMATIC POLICY AND SUPPORT.—For 9 necessary expenses for the functional bureaus of the 10 Department of State, including representation to 11 certain international organizations in which the 12 United States participates pursuant to treaties rati- 13 fied pursuant to the advice and consent of the Sen- 14 ate or specific Acts of Congress, general administra- 15 tion, and arms control, nonproliferation, and disar- 16 mament activities as authorized, $878,962,000. 17 (4) SECURITY PROGRAMS.—For necessary ex- 18 penses for security activities, $3,296,841,000, of 19 which up to $3,271,695,000 is for Worldwide Secu- 20 rity Protection. 21 (5) FEES AND PAYMENTS COLLECTED.—In ad- 22 dition to amounts otherwise made available under 23 this heading— 24 4 •S 2583 RS (A) as authorized by section 810 of the 1 United States Information and Educational Ex- 2 change Act, up to $5,000,000, to remain avail- 3 able until expended, may be credited to this ap- 4 propriation from fees or other payments re- 5 ceived from English teaching, library, motion 6 pictures, and publication programs and from 7 fees from educational advising and counseling 8 and exchange visitor programs; and 9 (B) up to $15,000, which shall be derived 10 from reimbursements, surcharges, and fees for 11 use of Blair House facilities. 12 (6) TRANSFER OF FUNDS, REPROGRAMMING, 13 AND OTHER MATTERS.—(A) Notwithstanding any 14 other provision of this Act, funds may be repro- 15 grammed within and between paragraphs (1) 16 through (4) under this heading subject to section 17 7011 of this Act. 18 (B) Of the amount made available under this 19 heading, up to $10,000,000 may be transferred to, 20 and merged with, funds made available by this Act 21 under the heading ‘‘Emergencies in the Diplomatic 22 and Consular Service’’, to be available only for emer- 23 gency evacuations and rewards, as authorized. 24 5 •S 2583 RS (C) Funds appropriated under this heading are 1 available for acquisition by exchange or purchase of 2 passenger motor vehicles as authorized by law and, 3 pursuant to section 1108(g) of title 31, United 4 States Code, for the field examination of programs 5 and activities in the United States funded from any 6 account contained in this title. 7 (D) Funds appropriated under this heading 8 that are designated for Worldwide Security Protec- 9 tion shall continue to be made available for support 10 of security-related training at sites in existence prior 11 to enactment of this Act. 12 (E) Of the funds appropriated under this head- 13 ing, up to $5,000,000 may be transferred to any 14 other appropriation of any department or agency of 15 the United States Government, upon the concur- 16 rence of the head of such department or agency, to 17 support operations in, and assistance for, Afghani- 18 stan and to carry out the provisions of the Foreign 19 Assistance Act of 1961 (22 U.S.C. 2151 et seq.): 20 Provided, That any such transfer shall be subject to 21 the regular notification procedures of the Commit- 22 tees on Appropriations. 23 6 •S 2583 RS CAPITAL INVESTMENT FUND 1 For necessary expenses of the Capital Investment 2 Fund, as authorized, $139,500,000, to remain available 3 until expended. 4 OFFICE OF INSPECTOR GENERAL 5 For necessary expenses of the Office of Inspector 6 General, $90,829,000, of which $13,624,350 may remain 7 available until September 30, 2021: Provided, That funds 8 appropriated under this heading are made available not- 9 withstanding section 209(a)(1) of the Foreign Service Act 10 of 1980 (22 U.S.C. 3929(a)(1)), as it relates to post in- 11 spections. 12 In addition, for the Special Inspector General for Af- 13 ghanistan Reconstruction (SIGAR), $54,900,000, to re- 14 main available until September 30, 2021, which is des- 15 ignated by the Congress for Overseas Contingency Oper- 16 ations/Global War on Terrorism pursuant to section 17 251(b)(2)(A)(ii) of the Balanced Budget and Emergency 18 Deficit Control Act of 1985: Provided, That funds appro- 19 priated under this heading that are made available for the 20 printing and reproduction costs of SIGAR shall not exceed 21 amounts for such costs during fiscal year 2019. 22 EDUCATIONAL AND CULTURAL EXCHANGE PROGRAMS 23 For necessary expenses of educational and cultural 24 exchange programs, as authorized, $735,700,000, to re- 25 7 •S 2583 RS main available until expended, of which not less than 1 $272,000,000 shall be for the Fulbright Program and not 2 less than $111,860,000 shall be for Citizen Exchange Pro- 3 gram: Provided, That fees or other payments received 4 from, or in connection with, English teaching, educational 5 advising and counseling programs, and exchange visitor 6 programs as authorized may be credited to this account, 7 to remain available until expended: Provided further, That 8 a portion of the Fulbright awards from the Eurasia and 9 Central Asia regions shall be designated as Edmund S. 10 Muskie Fellowships, following consultation with the Com- 11 mittees on Appropriations: Provided further, That funds 12 appropriated under this heading that are made available 13 for the Benjamin Gilman International Scholarships Pro- 14 gram shall also be made available for the John S. McCain 15 Scholars Program, pursuant to section 7075 of the De- 16 partment of State, Foreign Operations, and Related Pro- 17 grams Appropriations Act, 2019 (division F of Public Law 18 116–6): Provided further, That of the funds appropriated 19 under this heading, not less than $10,000,000 shall be 20 made available for a Civil Society Exchange Program, in 21 accordance with the requirements specified under this 22 heading in the report accompanying this Act, and fol- 23 lowing consultation with the Committees on Appropria- 24 tions: Provided further, That any substantive modifica- 25 8 •S 2583 RS tions from the prior fiscal year to programs funded by this 1 Act under this heading shall be subject to prior consulta- 2 tion with, and the regular notification procedures of, the 3 Committees on Appropriations. 4 REPRESENTATION EXPENSES 5 For representation expenses as authorized, 6 $7,212,000. 7 PROTECTION OF FOREIGN MISSIONS AND OFFICIALS 8 For necessary expenses, not otherwise provided, to 9 enable the Secretary of State to provide for extraordinary 10 protective services, as authorized, $30,890,000, to remain 11 available until September 30, 2021. 12 EMBASSY SECURITY, CONSTRUCTION, AND MAINTENANCE 13 For necessary expenses for carrying out the Foreign 14 Service Buildings Act of 1926 (22 U.S.C. 292 et seq.), 15 preserving, maintaining, repairing, and planning for real 16 property that are owned or leased by the Department of 17 State, and renovating, in addition to funds otherwise avail- 18 able, the Harry S Truman Building, $767,423,000, to re- 19 main available until expended, of which up to $25,000 20 may be used for overseas representation expenses as au- 21 thorized: Provided, That none of the funds appropriated 22 in this paragraph shall be available for acquisition of fur- 23 niture, furnishings, or generators for other departments 24 and agencies of the United States Government. 25 9 •S 2583 RS In addition, for the costs of worldwide security up- 1 grades, acquisition, and construction as authorized, 2 $1,121,792,000, to remain available until expended, of 3 which $666,549,000 is designated by the Congress for 4 Overseas Contingency Operations/Global War on Ter- 5 rorism pursuant to section 251(b)(2)(A)(ii) of the Bal- 6 anced Budget and Emergency Control Act of 1985: Pro- 7 vided, That not later than 45 days after enactment of this 8 Act, the Secretary of State shall submit to the Committees 9 on Appropriations the proposed allocation of funds made 10 available under this heading and the actual and antici- 11 pated proceeds of sales or gifts for all projects in fiscal 12 year 2020. 13 EMERGENCIES IN THE DIPLOMATIC AND CONSULAR 14 SERVICE 15 For necessary expenses to enable the Secretary of 16 State to meet unforeseen emergencies arising in the Diplo- 17 matic and Consular Service, as authorized, $7,885,000, to 18 remain available until expended, of which up to 19 $1,000,000 may be transferred to, and merged with, funds 20 appropriated by this Act under the heading ‘‘Repatriation 21 Loans Program Account’’. 22 REPATRIATION LOANS PROGRAM ACCOUNT 23 For the cost of direct loans, $1,300,000, as author- 24 ized: Provided, That such costs, including the cost of 25 10 •S 2583 RS modifying such loans, shall be as defined in section 502 1 of the Congressional Budget Act of 1974: Provided fur- 2 ther, That such funds are available to subsidize gross obli- 3 gations for the principal amount of direct loans up to 4 $5,563,619. 5 PAYMENT TO THE AMERICAN INSTITUTE IN TAIWAN 6 For necessary expenses to carry out the Taiwan Rela- 7 tions Act (Public Law 96–8), $31,963,000. 8 INTERNATIONAL CENTER, WASHINGTON, DISTRICT OF 9 COLUMBIA 10 Up to $1,806,600 shall be derived from fees collected 11 from other executive agencies for lease or use of facilities 12 at the International Center in accordance with section 4 13 of the International Center Act (Public Law 90–553), and, 14 in addition, as authorized by section 5 of such Act, 15 $743,000, to be derived from the reserve authorized by 16 such section, to be used for the purposes set out in that 17 section. 18 PAYMENT TO THE FOREIGN SERVICE RETIREMENT AND 19 DISABILITY FUND 20 For payment to the Foreign Service Retirement and 21 Disability Fund, as authorized, $158,900,000. 22 11 •S 2583 RS INTERNATIONAL ORGANIZATIONS 1 CONTRIBUTIONS TO INTERNATIONAL ORGANIZATIONS 2 For necessary expenses, not otherwise provided for, 3 to meet annual obligations of membership in international 4 multilateral organizations, pursuant to treaties ratified 5 pursuant to the advice and consent of the Senate, conven- 6 tions, or specific Acts of Congress, $1,473,806,000, of 7 which $96,240,000, to remain available until September 8 30, 2021, is designated by the Congress for Overseas Con- 9 tingency Operations/Global War on Terrorism pursuant to 10 section 251(b)(2)(A)(ii) of the Balanced Budget and 11 Emergency Deficit Control Act of 1985: Provided, That 12 the Secretary of State shall notify the Committees on Ap- 13 propriations at least 15 days in advance (or in an emer- 14 gency, as far in advance as is practicable) of any United 15 Nations action to increase funding for any United Nations 16 program without identifying an offsetting decrease else- 17 where in the United Nations budget: Provided further, 18 That any payment of arrearages under this heading shall 19 be directed to activities that are mutually agreed upon by 20 the United States and the respective international organi- 21 zation and shall be subject to the regular notification pro- 22 cedures of the Committees on Appropriations: Provided 23 further, That none of the funds appropriated under this 24 heading shall be available for a United States contribution 25 12 •S 2583 RS to an international organization for the United States 1 share of interest costs made known to the United States 2 Government by such organization for loans incurred on 3 or after October 1, 1984, through external borrowings. 4 CONTRIBUTIONS FOR INTERNATIONAL PEACEKEEPING 5 ACTIVITIES 6 For necessary expenses to pay assessed and other ex- 7 penses of international peacekeeping activities directed to 8 the maintenance or restoration of international peace and 9 security, $1,576,759,000, of which $88,215,450 may re- 10 main available until September 30, 2021: Provided, That 11 of the funds appropriated under this heading, 12 $988,656,000, to remain available until September 30, 13 2021, is designated by the Congress for Overseas Contin- 14 gency Operations/Global War on Terrorism pursuant to 15 section 251(b)(2)(A)(ii) of the Balanced Budget and 16 Emergency Deficit Control Act of 1985: Provided further, 17 That none of the funds made available by this Act shall 18 be obligated or expended for any new or expanded United 19 Nations peacekeeping mission unless, at least 15 days in 20 advance of voting for such mission in the United Nations 21 Security Council (or in an emergency as far in advance 22 as is practicable), the C [Text truncated for display.
