To amend title XVIII of the Social Security Act to require the Secretary
of Health and Human Services to disseminate to part D subsidy eligible
individuals information comparing the premiums under LIS benchmark
plans for such individuals.

Mr. KIND (for himself, Ms. DAVIDS of Kansas, and Mr. BUTTERFIELD) intro-
duced the following bill; which was referred to the Committee on Energy
and Commerce, and in addition to the Committee on Ways and Means,
for a period to be subsequently determined by the Speaker, in each case
for consideration of such provisions as fall within the jurisdiction of the
committee concerned
A BILL
To amend title XVIII of the Social Security Act to require
the Secretary of Health and Human Services to dissemi-
nate to part D subsidy eligible individuals information
comparing the premiums under LIS benchmark plans
for such individuals.
Be it enacted by the Senate and House of Representa-

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Better Transparency
4
in Information for Medicare Beneficiaries Act of 2019’’.

IGIBLE INDIVIDUALS OF INFORMATION COM-

PARING PREMIUMS OF CERTAIN PRESCRIP-

TION DRUG PLANS.

Section 1860D–1(c)(3) of the Social Security Act (42
5
U.S.C. 1395w–101(c)(3)) is amended by adding at the end
6
the following new subparagraph:
7
‘‘(C) INFORMATION
ON
PREMIUMS
FOR
8
SUBSIDY ELIGIBLE INDIVIDUALS.—
9
‘‘(i) IN
GENERAL.—For plan year
10
2022 and each subsequent plan year, the
11
Secretary shall disseminate to each subsidy
12
eligible individual (as defined in section
13
1860D–14(a)(3)) information under this
14
paragraph comparing premiums that would
15
apply to such individual for prescription
16
drug coverage under LIS benchmark plans,
17
including, in the case of an individual en-
18
rolled in a prescription drug plan under
19
this part, information that compares the
20
premium that would apply if such indi-
21
vidual were to remain enrolled in such plan
22
to premiums that would apply if the indi-
23
vidual were to enroll in other LIS bench-
24
mark plans.

‘‘(ii) LIS BENCHMARK
PLAN.—For
1
purposes of clause (i), the term ‘LIS
2
benchmark plan’ means, with respect to an
3
individual, a prescription drug plan under
4
this part that is offered in the region in
5
which the individual resides and—
6
‘‘(I) that provides for a premium
7
that is not more than the low-income
8
benchmark premium amount (as de-
9
fined in section 1860D–14(b)(2)) for
10
such region; or
11
‘‘(II) with respect to which the
12
premium would be waived as de mini-
13
mis pursuant to section 1860D–
14
14(a)(5) for such individual.’’.
