LIMITATIONS ON ASSISTANCE TO THE PALESTINIAN 1 AUTHORITY AND THE PALESTINE LIBERA- 2 TION ORGANIZATION. 3 Chapter 1 of part III of the Foreign Assistance Act 4 of 1961 (22 U.S.C. 2351 et seq.) is amended by adding 5 at the end the following new section: 6 ‘‘SEC. 620N. LIMITATIONS ON ASSISTANCE TO THE PALES- 7 TINIAN AUTHORITY AND THE PALESTINE LIB- 8 ERATION ORGANIZATION. 9 ‘‘(a) LIMITATIONS.— 10 ‘‘(1) PALESTINIAN AUTHORITY.—In addition to 11 the limitation on assistance to the Palestinian Au- 12 thority described in sections 620K and 620L, assist- 13 ance may be provided under this Act to the Pales- 14 tinian Authority only during a period for which a 15 certification described in subsection (b) is in effect. 16 ‘‘(2) PALESTINE LIBERATION ORGANIZATION.— 17 Assistance may be provided under this Act to the 18 Palestine Liberation Organization only during a pe- 19 riod for which a certification described in subsection 20 (b) is in effect. 21 ‘‘(b) CERTIFICATION.—A certification described in 22 this subsection is a certification submitted by the Sec- 23 retary of State to Congress that contains a determination 24 of the Secretary that the Palestinian Authority, including 25 any ministry, agency, or instrumentality, or any official 26 VerDate Sep 11 2014 02:00 Sep 21, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H4411.IH H4411 kjohnson on DSK79L0C42 with BILLS 3 •HR 4411 IH acting on behalf of any such ministry, agency, or instru- 1 mentality, and the Palestine Liberation Organization, as 2 the case may be, has ceased the payment of any bonuses, 3 financial compensation, or any other benefit not generally 4 or otherwise available to the Palestinian population at 5 large to the families of Palestinians killed in connection 6 with— 7 ‘‘(1) conspiring to commit an act of terrorism; 8 or 9 ‘‘(2) the commission of an act of terrorism. 10 ‘‘(c) RECERTIFICATIONS.—Not later than 90 days 11 after the date on which the Secretary of State submits 12 to Congress an initial certification under subsection (b) 13 and every six months thereafter— 14 ‘‘(1) the Secretary shall submit to Congress a 15 recertification that the conditions described in such 16 subsection are continuing to be met; or 17 ‘‘(2) if the Secretary is unable to make such a 18 recertification, the Secretary shall submit to Con- 19 gress a report that contains the reasons therefor. 20 ‘‘(d) CONGRESSIONAL NOTIFICATION.—Assistance 21 made available under this Act to the Palestinian Authority 22 or the Palestine Liberation Organization may not be pro- 23 vided until 15 days after the date on which the Secretary 24 of State has provided notice thereof to the appropriate 25 VerDate Sep 11 2014 02:00 Sep 21, 2019 Jkt 089200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H4411.IH H4411 kjohnson on DSK79L0C42 with BILLS 4 •HR 4411 IH congressional committees in accordance with the proce- 1 dures applicable to reprogramming notifications under 2 section 634A(a). 3 ‘‘(e) AVAILABILITY OF FUNDS FOR IRON DOME.—If 4 the Secretary of State is unable to submit to Congress 5 a certification under subsection (b) or a recertification 6 under subsection (c), funds made available under this Act 7 for assistance to the Palestinian Authority and the Pal- 8 estine Liberation Organization that otherwise would have 9 been provided to the Palestinian Authority and the Pal- 10 estine Liberation Organization shall, notwithstanding any 11 other provision of law, be transferred and made available 12 to the Secretary of Defense to provide assistance to the 13 Government of Israel for the procurement of the Iron 14 Dome defense system to counter short-range rocket 15 threats. 16 ‘‘(f) ANNUAL REPORTS.—The Secretary of State 17 shall annually submit to the appropriate congressional 18 committees a report on the amount of any bonuses, finan- 19 cial compensation, or any other benefit described in sub- 20 section (b) that have been disbursed by the Palestinian 21 Authority, including by any ministry, agency, or instru- 22 mentality or any official acting on behalf of any such min- 23 istry, agency, or instrumentality, and the Palestine Lib- 24 eration Organization in the preceding 12-month period. 25 VerDate Sep 11 2014 02:00 Sep 21, 2019 Jkt 089200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H4411.IH H4411 kjohnson on DSK79L0C42 with BILLS 5 •HR 4411 IH ‘‘(g) DEFINITIONS.—In this section: 1 ‘‘(1) ACT OF TERRORISM.—The term ‘act of 2 terrorism’ means an act dangerous to human life 3 that would violate the criminal laws of the United 4 States if committed within the jurisdiction of the 5 United States that appears to be intended to— 6 ‘‘(A) intimidate or coerce a civilian popu- 7 lation; 8 ‘‘(B) influence the policy of a government 9 by intimidation or coercion; 10 ‘‘(C) affect the conduct of a government by 11 mass destruction, assassination, or kidnapping; 12 or 13 ‘‘(D) impair Israel’s existence as a Jewish, 14 democratic state within its current territorial 15 boundaries. 16 ‘‘(2) APPROPRIATE CONGRESSIONAL COMMIT- 17 TEES.—The term ‘appropriate congressional com- 18 mittees’ means— 19 ‘‘(A) the Committee on Foreign Affairs 20 and the Committee on Appropriations of the 21 House of Representatives;
