introduced the following bill; which was read twice and referred to the
Committee on Health, Education, Labor, and Pensions
A BILL
To amend section 455(m) of the Higher Education Act of
1965 in order to allow adjunct faculty members to qual-
ify for public service loan forgiveness.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Adjunct Faculty Loan
4
Fairness Act of 2019’’.
5
SEC. 2. LOAN FORGIVENESS FOR ADJUNCT FACULTY.

Section 455(m)(3)(B)(ii) of the Higher Education
7
Act of 1965 (20 U.S.C. 1087e(m)(3)(B)(ii)) is amended—

(1) by striking ‘‘teaching as’’ and inserting the

following: ‘‘teaching—
2
‘‘(I) as’’;
3
(2) by striking ‘‘, foreign language faculty, and
4
part-time faculty at community colleges), as deter-
5
mined by the Secretary.’’ and inserting ‘‘and foreign
6
language faculty), as determined by the Secretary;
7
or’’; and
8
(3) by adding at the end the following:

‘‘(II) as a part-time faculty mem-
10
ber or instructor who—
11
‘‘(aa) teaches not less than
12
1 course at an institution of
13
higher education (as defined in
14
section 101(a)), a postsecondary
15
vocational institution (as defined
16
in section 102(c)), or a Tribal
17
College or University (as defined
18
in section 316(b)); and
19
‘‘(bb) is not employed on a
20
full-time basis by any other em-
21
ployer.’’.
