AN ACT
To authorize public housing agencies to share certain data
regarding homeless individuals and families for the provi-
sion of housing and services, and for other purposes.
Be it enacted by the Senate and House of Representa-

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Homeless Assistance
2
Act of 2019’’.

SEC. 2. LIMITED AUTHORITY TO SHARE INFORMATION RE-
4
GARDING HOMELESS INDIVIDUALS AND FAM-
5
ILIES WITH APPROPRIATE ENTITY WITHIN
6
CONTINUUM OF CARE.

Section 2 of the United States Housing Act of 1937
8
(42 U.S.C. 1437) is amended by adding at the end the
9
following new subsection:
10
‘‘(c) LIMITED AUTHORITY TO SHARE INFORMATION
11
REGARDING
HOMELESS
INDIVIDUALS
AND
FAMILIES
12
WITH APPROPRIATE ENTITY WITHIN CONTINUUM
OF
13
CARE.—Notwithstanding section 904 of the Stewart B.
14
McKinney Homeless Assistance Amendments Act of 1988
15
(42 U.S.C. 3544), a public housing agency may disclose,
16
to the collaborative applicant of the local Continuum of
17
Care or designee of the collaborative applicant within
18
which the jurisdiction of the public housing agency is lo-
19
cated, information regarding individuals and families who
20
are homeless (as such term is used in section 103 of the
21
McKinney-Vento Homeless Assistance Act (42 U.S.C.
22
11302)) or at risk of homelessness (as such term is used
23
in section 401 of such Act (42 U.S.C. 11360)), but only—
24
‘‘(1) for the purpose of facilitating the identi-
25
fication, assessment, and linkage of housing and

supportive services for such individuals and families

to ensure continuity of care, to the extent allowable
2
under State Law;

‘‘(2) if the public housing agency takes appro-
4
priate measures to ensure that the privacy of the in-
5
dividuals and families is protected and that the in-
6
formation, including any personally identifiable in-
7
formation, is used only for the purpose described in
8
paragraph (1); and
9
‘‘(3) if the public housing agency takes appro-
10
priate measures to ensure clients’ information and
11
confidentiality is protected pursuant to section
12
41411(c)(4) of the Violence Against Women Act of
13
1994 (34 U.S.C. 12491(c)(4)), and any regulations
14
promulgated pursuant to such section.’’.
