AVAILABILITY OF RECORDS FOR NATIONAL IN- 1 STANT CRIMINAL BACKGROUND CHECK SYS- 2 TEM. 3 (a) NICS RECORDS.—Section 101(b) of the NICS 4 Improvement Amendments Act of 2007 (34 U.S.C. 5 40911(b)) is amended— 6 (1) by redesignating paragraph (2) as para- 7 graph (3); and 8 (2) by inserting after paragraph (1), the fol- 9 lowing new paragraph (2): 10 ‘‘(2) DEPARTMENT OF DEFENSE.—Not later 11 than three business days after the final disposition 12 of a judicial proceeding conducted within the De- 13 partment of Defense, the Secretary of Defense shall 14 make available to the Attorney General records 15 which are relevant to a determination of whether a 16 member of the Armed Forces involved in such pro- 17 ceeding is disqualified from possessing or receiving a 18 firearm under subsection (g) or (n) of section 922 19 of title 18, United States Code, for use in back- 20 ground checks performed by the National Instant 21 Criminal Background Check System.’’. 22 (b) STUDY AND REPORT ON MPO DATABASE.— 23 (1) STUDY.—The Secretary of Defense shall 24 conduct a study on the feasibility of establishing a 25 database of military protective orders issued by mili- 26 VerDate Sep 11 2014 01:58 Sep 11, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H4264.IH H4264 pamtmann on DSKBC07HB2PROD with BILLS 3 •HR 4264 IH tary commanders against individuals suspected of 1 having committed an offense of domestic violence 2 under section 928b of title 10, United States Code 3 (article 128b of the Uniform Code of Military Jus- 4 tice).
