To amend title 38, United States Code, to clarify when
educational assistance is available for an individual who
pursues an approved program of education leading to
a degree while on active duty in the Armed Forces.
Be it enacted by the Senate and House of Representa-

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Reserve and Guard
4
GI Bill Housing Fairness Act’’.

SEC. 2. CLARIFICATION OF EDUCATIONAL ASSISTANCE

FOR INDIVIDUALS WHO PURSUE AN AP-

PROVED PROGRAM OF EDUCATION LEADING
3
TO A DEGREE WHILE ON ACTIVE DUTY.

Section 3313(e) of title 38, United States Code, is
5
amended—
6
(1) in the heading, by inserting ‘‘FOR A PERIOD
7
OF MORE THAN 30 DAYS’’ after ‘‘ACTIVE DUTY’’;
8
(2) in paragraph (1), by inserting ‘‘for a period
9
of more than 30 days’’ after ‘‘active duty’’; and
10
(3) in paragraph (2), in the matter preceding
11
subparagraph (A), by inserting ‘‘for a period of
12
more than 30 days’’ after ‘‘active duty’’.
