STRENGTHENING PROGRAM ALIGNMENT FOR POST- 1 SECONDARY PERKINS CAREER AND TECH- 2 NICAL EDUCATION PROGRAMS. 3 (a) AUTHORIZATION OF APPROPRIATIONS.— 4 (1) IN GENERAL.—There are authorized to be 5 appropriated to carry out this section $181,000,000 6 for fiscal year 2021 and each of the 5 succeeding fis- 7 cal years. 8 (2) OUTLYING AREAS.—In addition to the 9 amounts authorized to be appropriated under para- 10 graph (1), there are authorized to be appropriated 11 $1,000,000 for fiscal year 2021 and each of the 5 12 succeeding fiscal years, for the purpose of awarding 13 funds to carry out this section to the outlying areas 14 described in section 115(a) of the Carl D. Perkins 15 Career and Technical Education Act of 2006 (20 16 U.S.C. 2325(a)). 17 (3) TRIBALLY CONTROLLED POSTSECONDARY 18 CAREER AND TECHNICAL INSTITUTIONS.—In addi- 19 tion to the amounts authorized to be appropriated 20 under paragraphs (1) and (2), there are authorized 21 to be appropriated $10,469,000 for fiscal year 2021 22 and each of the 5 succeeding fiscal years, for the 23 purpose of awarding funds to carry out this section 24 to tribally controlled postsecondary career and tech- 25 nical institutions described in section 117(a) of the 26 VerDate Sep 11 2014 21:43 Sep 20, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H4371.IH H4371 kjohnson on DSK79L0C42 with BILLS 3 •HR 4371 IH Carl D. Perkins Career and Technical Education 1 Act of 2006 (20 U.S.C. 2327(a)). 2 (b) ALLOTMENT AND ALLOCATION.— 3 (1) STATE ALLOTMENT.— 4 (A) IN GENERAL.—From the amount ap- 5 propriated under subsection (a)(1) for each fis- 6 cal year, the Secretary of Education shall allot 7 funds to States in the same manner as allot- 8 ments are made to States under 111(a)(2) of 9 the Carl D. Perkins Career and Technical Edu- 10 cation Act of 2006 (20 U.S.C. 2321(a)(2)), ex- 11 cept that such section 111(a)(2) shall be ap- 12 plied by substituting ‘‘From the amount appro- 13 priated under subsection (a)(1),’’ for ‘‘From the 14 remainder of the amount appropriated under 15 section 9 and not reserved under paragraph (1) 16 for a fiscal year,’’. 17 (B) REALLOTMENT.—If for any fiscal year 18 the amount appropriated for allotments under 19 this paragraph is insufficient to satisfy the pro- 20 visions of subparagraph (A), the payments to 21 all States under such subparagraph shall be 22 ratably reduced. 23 (2) REQUIREMENTS FOR STATE ALLOTMENT.— 24 From the amount allotted to each State under para- 25 VerDate Sep 11 2014 21:43 Sep 20, 2019 Jkt 089200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H4371.IH H4371 kjohnson on DSK79L0C42 with BILLS 4 •HR 4371 IH graph (1) for a fiscal year, the eligible agency shall 1 use such funds in the same manner and in the same 2 amounts as described in paragraphs (2) and (3) of 3 section 112(a) of the Carl D. Perkins Career and 4 Technical Education Act of 2006 (20 U.S.C. 5 2321(a)). 6 (3) ELIGIBLE RECIPIENT ALLOCATION.— 7 (A) IN GENERAL.—From the amount allot- 8 ted to each State under paragraph (1) and not 9 used under paragraph (2) for a fiscal year, the 10 eligible agency shall allocate funds to each eligi- 11 ble recipient within the State in the same man- 12 ner that funds are allocated to eligible institu- 13 tions or consortium of eligible institutions under 14 section 132(a)(2) of the Carl D. Perkins Career 15 and Technical Education Act of 2006 (20 16 U.S.C. 2352(a)(2)), except that such section 17 132(a)(2) shall be applied by substituting ‘‘the 18 amount allotted to the State under paragraph 19 (1) and not used under paragraph (2)’’ for ‘‘the 20 portion of funds made available under section 21 112(a)(1) to carry out this section’’. 22 (B) REQUIREMENTS FOR ALLOCATION.— 23 To receive an allocation under subparagraph 24 VerDate Sep 11 2014 21:43 Sep 20, 2019 Jkt 089200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H4371.IH H4371 kjohnson on DSK79L0C42 with BILLS 5 •HR 4371 IH (A), an eligible recipient shall meet the fol- 1 lowing requirements: 2 (i) Provide a description to the Sec- 3 retary, at such time and in such manner, 4 as may be required by the Secretary of 5 how the eligible recipient will use the allo- 6 cation to support and coordinate with— 7 (I) any funds received by such el- 8 igible recipient under title I of the 9 Carl D. Perkins Career and Technical 10 Education Act of 2006 (20 U.S.C. 11 2321 et seq.); and 12 (II) the activities described in the 13 State plan of the eligible agency that 14 distributes funds under such title to 15 such eligible recipient, and local appli- 16 cation of such eligible recipient under 17 such title. 18 (ii) Establish partnerships with each 19 of the following: 20 (I) A local educational agency or 21 a consortia of local educational agen- 22 cies. 23 (II) An area career and technical 24 education school, in a case in which 25 VerDate Sep 11 2014 21:43 Sep 20, 2019 Jkt 089200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6201 E:\BILLS\H4371.IH H4371 kjohnson on DSK79L0C42 with BILLS 6 •HR 4371 IH such a school is located in the State 1 or local area of the eligible recipient. 2 (III) A State or local workforce 3 development system. 4 (IV) A 4-year institution of high- 5 er education. 6 (c) USES OF FUNDS.— 7 (1) IN GENERAL.—Each eligible recipient that 8 receives an allocation under subsection (b)(2) shall 9 use such allocation to carry out a career and tech- 10 nical education program of study that shall— 11 (A) include alignment to career pathways, 12 the use of articulation agreements, and career 13 guidance and academic counseling; 14 (B) combine a minimum of 2 years of sec- 15 ondary education (as determined under State 16 law) with a minimum of 2 years of postsec- 17 ondary education in a nonduplicative, sequential 18 course of study; 19 (C) include work-based learning or appren- 20 ticeship programs; 21 (D) be aligned with— 22 (i) the workforce development system; 23 and 24 VerDate Sep 11 2014 21:43 Sep 20, 2019 Jkt 089200 PO 00000 Frm 00006 Fmt 6652 Sfmt 6201 E:\BILLS\H4371.IH H4371 kjohnson on DSK79L0C42 with BILLS 7 •HR 4371 IH (ii) institutions of higher education of- 1 fering baccalaureate or advanced degree 2 programs; 3 (E) offer education and training in high- 4 skill, high-wage, or in-demand industry sectors 5 and occupations to meet the regional needs and 6 support the priorities described in the most re- 7 cent comprehensive local needs assessment con- 8 ducted by the eligible recipient under section 9 134(c) of the Carl D. Perkins Career and Tech- 10 nical Education Act (20 U.S.C. 2354(c)); and 11 (F) carry out the requirements of subpara- 12 graph (A), (B), (C), (D), or (E) of paragraph 13 (2). 14 (2) REQUIREMENTS.—Each career and tech- 15 nical education program of study described in para- 16 graph (1) shall carry out at least one of the fol- 17 lowing: 18 (A) Supporting the development, delivery, 19 or implementation of a statewide effort to scale 20 such program of study and career pathways. 21 (B) Establishing industry or sector part- 22 nerships inside or outside the State. 23 (C) Providing equal access to, and sup- 24 ports for, successful completion of the career 25 VerDate Sep 11 2014 21:43 Sep 20, 2019 Jkt 089200 PO 00000 Frm 00007 Fmt 6652 Sfmt 6201 E:\BILLS\H4371.IH H4371 kjohnson on DSK79L0C42 with BILLS 8 •HR 4371 IH and technical education program of study to in- 1 dividuals who are members of special popu- 2 lations, including the development of services 3 appropriate to the needs of special populations. 4 (D) Improving career guidance, academic 5 counseling, and career exploration activities for 6 prospective or participating students through 7 the development and implementation of gradua- 8 tion and career plans aligned to career path- 9 ways. 10 (E) Developing curriculum and supports 11 for effective transitions between the following: 12 (i) The transition from a secondary 13 career and technical education program to 14 a postsecondary career and technical edu- 15 cation program. 16 (ii) The transition from postsecondary 17 career and technical education programs to 18 an institution of higher education offering 19 a baccalaureate or an advanced degree pro- 20 gram. 21 (iii) The transition from a workforce 22 development system to a postsecondary ca- 23 reer and technical education program. 24 VerDate Sep 11 2014 21:43 Sep 20, 2019 Jkt 089200 PO 00000 Frm 00008 Fmt 6652 Sfmt 6201 E:\BILLS\H4371.IH H4371 kjohnson on DSK79L0C42 with BILLS 9 •HR 4371 IH (iv) The transition from a postsec- 1 ondary career and technical education pro- 2 gram to employment. 3 (v) The transition from a career and 4 technical education program to an appren- 5 ticeship program or from an apprenticeship 6 program to an institution of higher edu- 7 cation or employment. 8 (3) RESTRICTION ON USES OF FUNDS.—Each 9 eligible recipient that receives an allocation under 10 subsection (b)(2) shall not use more than 5 percent 11 of such allocation for costs associated with the ad- 12 ministration of activities. 13 (d) DEFINITIONS.—In this section: 14 (1) APPRENTICESHIP PROGRAM.—The term 15 ‘‘apprenticeship program’’ means an apprenticeship 16 registered under the Act of August 16, 1937 (com- 17 monly known as the ‘‘National Apprenticeship Act’’; 18 50 Stat. 664, chapter 663; 29 U.S.C. 50 et seq.). 19 (2) ELIGIBLE RECIPIENT.—The term ‘‘eligible 20 recipient’’ has the meaning given the term in section 21 3(21)(B) of the Carl D. Perkins Career and Tech- 22 nical Education Act of 1965 (20 U.S.C. 23 2302(21)(B)). 24 VerDate Sep 11 2014 21:43 Sep 20, 2019 Jkt 089200 PO 00000 Frm 00009 Fmt 6652 Sfmt 6201 E:\BILLS\H4371.IH H4371 kjohnson on DSK79L0C42 with BILLS 10 •HR 4371 IH (3) INSTITUTION OF HIGHER EDUCATION.—The 1 term ‘‘institution of higher education’’ has the 2 meaning given such term in section 101 of the High- 3 er Education Act of 1965 (20 U.S.C. 1001). 4 (4) LOCAL EDUCATIONAL AGENCY.—The term 5 ‘‘local educational agency’’ has the meaning given 6 such term in section 8101 of the Elementary and 7 Secondary Education Act of 1965 (20 U.S.C. 7801). 8 (5) PERKINS CTE TERMS.—The terms ‘‘articu- 9 lation agreement’’, ‘‘area career and technical edu- 10 cation school’’, ‘‘career and technical education’’, 11 ‘‘eligible agency’’, ‘‘program of study’’, ‘‘special pop- 12 ulation’’, and ‘‘work-based learning’’ have the mean- 13 ings given the terms in section 3 of the Carl D.
