COMMODITY ASSISTANCE FOR SCHOOL BREAKFAST 1 PROGRAMS. 2 (a) DELIVERY OF COMMODITIES.—Section 6(b) of 3 the Richard B. Russell National School Lunch Act (42 4 U.S.C. 1755(b)) is amended by inserting ‘‘and the school 5 breakfast program’’ after ‘‘school lunch program’’. 6 (b) COMMODITY ASSISTANCE FORMULA.—Section 7 6(c)(1) of the Richard B. Russell National School Lunch 8 Act (42 U.S.C. 1755(c)(1)) is amended— 9 (1) in subparagraph (A)— 10 (A) by inserting ‘‘for the school lunch pro- 11 gram’’ after ‘‘11 cents’’; and 12 (B) by inserting ‘‘The national average 13 value of donated foods, or cash payments in lieu 14 thereof, shall be 6 cents for the school breakfast 15 program, adjusted on the first July 1 after the 16 date of enactment of the Healthy Breakfast 17 Help Kids Learn Act of 2019 and each July 1 18 thereafter to reflect the changes in the Price 19 Index for Food Used in Schools and Institu- 20 tions.’’ after ‘‘Institutions.’’; 21 (2) in subparagraph (C)— 22 (A) by striking ‘‘For each school year’’ and 23 inserting ‘‘(i) For each school year’’; 24 (B) by striking ‘‘State for’’ and inserting 25 the following: ‘‘State— 26 VerDate Sep 11 2014 01:58 Sep 11, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H4265.IH H4265 pamtmann on DSKBC07HB2PROD with BILLS 3 •HR 4265 IH ‘‘(I) for’’; 1 (C) by striking ‘‘subparagraph (B).’’ and 2 inserting the following: ‘‘subparagraph (B); and 3 ‘‘(II) for the school breakfast program 4 shall be calculated by multiplying the number of 5 breakfasts served in the preceding school year 6 by the rate established by subparagraph (B).’’; 7 (D) by striking ‘‘After the end’’ and insert- 8 ing the following: 9 ‘‘(ii) After the end’’; 10 (E) by striking ‘‘shall reconcile the’’ and 11 inserting ‘‘shall reconcile— 12 ‘‘(I) the’’; and 13 (F) by striking ‘‘such reconciliation.’’ and 14 inserting ‘‘such reconciliation; and 15 ‘‘(II) the number of breakfasts served by 16 schools in each State with the number of break- 17 fasts served by schools in each State during the 18 preceding school year and increase or reduce 19 subsequent commodity assistance or cash in lieu 20 thereof provided to each State based on such 21 reconciliation.’’; and 22 (3) in subparagraph (E), by inserting ‘‘and 23 school breakfast program’’ after ‘‘school lunch pro- 24 gram’’. 25 VerDate Sep 11 2014 01:58 Sep 11, 2019 Jkt 089200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H4265.IH H4265 pamtmann on DSKBC07HB2PROD with BILLS 4 •HR 4265 IH (c) REPEAL OF LIMITATION ON COMMODITY ASSIST- 1 ANCE FOR SCHOOL BREAKFAST.—Section 6 of the Rich- 2 ard B.
