To penalize acts of domestic terrorism, and for other
purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Domestic Terrorism
4
Penalties Act of 2019’’.
5
SEC. 2. DOMESTIC TERRORISM.

(a) IN GENERAL.—Chapter 113B of title 18, United
7
States Code, is amended by adding at the end the fol-
8
lowing:

‘‘§ 2339E. Domestic terrorism
1
‘‘(a) OFFENSES AND PENALTIES.—Whoever, with re-
2
spect to a circumstance described in subsection (b), and
3
with the intent to intimidate or coerce a civilian population
4
or influence, affect, or retaliate against the policy or con-
5
duct of a government—
6
‘‘(1) kills any person, shall be sentenced to
7
death or imprisonment of not more than a term of
8
life imprisonment, fined under this title, or both;
9
‘‘(2) kidnaps any person, shall be imprisoned
10
not more than a term of life imprisonment, fined
11
under this title, or both;
12
‘‘(3) assaults any person with a deadly weapon,
13
shall be imprisoned not more than 30 years, fined
14
under this title, or both;
15
‘‘(4) assaults any person, and serious bodily in-
16
jury results therefrom, shall be imprisoned not more
17
than 30 years, fined under this title, or both;
18
‘‘(5) destroys or damages any structure, convey-
19
ance, or other real or personal property, shall be im-
20
prisoned not more than 25 years, fined under this
21
title, or both; or
22
‘‘(6) attempts or conspires to commit an offense
23
described under paragraph (1), (2), (3), (4), or (5)
24
of this subsection, shall be punished in the same
25
manner as a completed act of such offense.

‘‘(b) CIRCUMSTANCE DESCRIBED.—A circumstance
1
described in this subsection is, with respect to an offense
2
under subsection (a), that the offense is committed—
3
‘‘(1) against any person or property within the
4
United States, and—
5
‘‘(A) the mail or any facility of interstate
6
or foreign commerce is used in furtherance of
7
the offense;
8
‘‘(B) such property is used in interstate or
9
foreign commerce or in an activity that affects
10
interstate or foreign commerce;
11
‘‘(C) any perpetrator travels in or causes
12
another to travel in interstate or foreign com-
13
merce in furtherance of the offense; or
14
‘‘(D) the offense, or the results of the of-
15
fense, affect interstate or foreign commerce, or,
16
in the case of a threat, attempt, or conspiracy,
17
would have affected interstate or foreign com-
18
merce;
19
‘‘(2) against any property that is owned, leased,
20
or used by the United States or by any department
21
or agency of the United States, whether the property
22
is within or outside of the United States; or

(b) CLERICAL AMENDMENT.—The table of sections
4
for such chapter is amended by adding after the item re-
5
lating to section 2339D the following:

‘‘2339E. Domestic terrorism.’’.
