Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Sarah Debbink 4 Langenkamp Active Transportation Safety Act’’. 5 SEC. 2. HIGHWAY SAFETY IMPROVEMENT PROGRAM. 6 (a) HIGHWAY SAFETY IMPROVEMENT PROJECT.— 7 Section 148(a)(4)(B) of title 23, United States Code, is 8 amended— 9 VerDate Sep 11 2014 02:41 Apr 01, 2023 Jkt 039200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H1668.IH H1668 kjohnson on DSK79L0C42PROD with BILLS 2 •HR 1668 IH (1) in clause (xxix) by striking ‘‘through 1 (xxviii)’’ and inserting ‘‘through (xxx)’’; 2 (2) by redesignating clause (xxix) as clause 3 (xxxi); and 4 (3) by inserting after clause (xxviii) the fol- 5 lowing: 6 ‘‘(xxix) The connection of 2 or more 7 segments of existing bicyclist or pedestrian 8 infrastructure. 9 ‘‘(xxx) The reduction of safety risks to 10 vulnerable road users through a project or 11 strategy described in a program of projects 12 or strategies developed pursuant to sub- 13 section (l)(2)(B).’’. 14 (b) TREATMENT OF CERTAIN PROJECTS AND STRAT- 15 EGIES RELATED TO VULNERABLE ROAD USERS.— 16 (1) VULNERABLE ROAD USER SAFETY ASSESS- 17 MENT.—Section 148(l) of title 23, United States 18 Code, is amended by adding at the end the fol- 19 lowing: 20 ‘‘(8) CONSISTENCY WITH STATE STRATEGIC 21 HIGHWAY SAFETY PLAN.—A project or strategy shall 22 be treated as consistent with a State strategic high- 23 way safety plan, including for purposes of section 24 133(h)(7)(B)(i)(II), if— 25 VerDate Sep 11 2014 02:41 Apr 01, 2023 Jkt 039200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H1668.IH H1668 kjohnson on DSK79L0C42PROD with BILLS 3 •HR 1668 IH ‘‘(A) the relevant State strategic highway 1 safety plan includes an emphasis area related to 2 vulnerable road users; and 3 ‘‘(B) the project or strategy— 4 ‘‘(i) was described in a program of 5 projects or strategies developed pursuant 6 to paragraph (2)(B) of this subsection; 7 ‘‘(ii) was identified by a local govern- 8 ment, metropolitan planning organization, 9 or regional transportation planning organi- 10 zation during the consultation process re- 11 quired under paragraph (4)(B) of this sub- 12 section; or 13 ‘‘(iii) is eligible under section 14 133(h)(3).’’. 15 (2) ELIGIBLE PROJECTS.—Section 148(e)(1) of 16 title 23, United States Code, is amended— 17 (A) in subparagraph (B) by striking ‘‘or’’ 18 at the end; 19 (B) in subparagraph (C) by striking the 20 period at the end and inserting ‘‘; or’’; and 21 (C) by adding at the end the following: 22 ‘‘(D) a project or strategy that is treated 23 as consistent with a State strategic highway 24 safety plan under subsection (l)(8).’’. 25 VerDate Sep 11 2014 02:41 Apr 01, 2023 Jkt 039200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H1668.IH H1668 kjohnson on DSK79L0C42PROD with BILLS 4 •HR 1668 IH (c) FEDERAL SHARE OF CERTAIN HIGHWAY SAFETY 1 IMPROVEMENT PROJECTS.— 2 (1) IN GENERAL.—Section 148(j) of title 23, 3 United States Code, is amended— 4 (A) by striking ‘‘Except’’ and inserting the 5 following: 6 ‘‘(1) IN GENERAL.—Except’’; and 7 (B) by adding at the end the following: 8 ‘‘(2) EXCEPTION.—Notwithstanding paragraph 9 (1) and section 120, the Federal share of the cost 10 of a highway safety improvement project carried out 11 with funds apportioned to a State under section 12 104(b)(3) may be up to 100 percent if the project 13 is carried out pursuant to clause (xxix) or (xxx) of 14 subsection (a)(4)(B) of this section.’’. 15 (2) FLEXIBLE FINANCING.—Section 16 133(h)(7)(B)(i) of title 23, United States Code, is 17 amended— 18 (A) in subclause (I) by striking ‘‘and’’ at 19 the end; 20 (B) in subclause (II) by adding ‘‘and’’ at 21 the end; and 22 (C) by adding at the end the following: 23 ‘‘(III) includes a Proven Safety 24 Countermeasure for bicyclists or pe- 25 VerDate Sep 11 2014 02:41 Apr 01, 2023 Jkt 039200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H1668.IH H1668 kjohnson on DSK79L0C42PROD with BILLS 5 •HR 1668 IH destrians, as determined by the Fed- 1 eral Highway Administration;’’. 2 (3) INCREASED FEDERAL SHARE FOR PROVEN 3 SAFETY COUNTERMEASURES.—Section 120(c)(1) of 4 title 23, United States Code, is amended by insert- 5 ing ‘‘Proven Safety Countermeasures for bicyclists 6 or pedestrians (as determined by the Federal High- 7 way Administration),’’ before ‘‘breakaway utility 8 poles’’. 9 Æ VerDate Sep 11 2014 02:41 Apr 01, 2023 Jkt 039200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6301 E:\BILLS\H1668.IH H1668 kjohnson on DSK79L0C42PROD with BILLS
