criteria for use of Federal funds to support trauma-informed practices
in schools, and for other purposes.

QUIGLEY) introduced the following bill; which was referred to the Com-

A BILL
To amend the Elementary and Secondary Education Act
of 1965 to provide criteria for use of Federal funds
to support trauma-informed practices in schools, and for
other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Trauma-Informed
4
Schools Act of 2019’’.

SEC. 2. TRAUMA-INFORMED PRACTICES.

(a) DEFINITION.—Section 8101 of the Elementary
2
and Secondary Education Act of 1965 (20 U.S.C. 7801)
3
is amended—
4
(1) by redesignating paragraphs (51) and (52)
5
as paragraphs (52) and (53), respectively; and
6
(2) by inserting after paragraph (50) the fol-
7
lowing:
8
‘‘(51)
TRAUMA-INFORMED
PRACTICES.—The
9
term ‘trauma-informed practices’ means—
10
‘‘(A) evidence-based professional develop-
11
ment that promotes a shared understanding
12
among teachers, teachers assistants, school
13
leaders, paraprofessionals, specialized instruc-
14
tional support personnel, and other staff that—
15
‘‘(i) traumatic experiences are com-
16
mon among students;
17
‘‘(ii) trauma can impact student
18
learning, behavior, and relationships in
19
school;
20
‘‘(iii) traumatic experiences do not in-
21
herently undermine the capabilities of stu-
22
dents to reach high expectations in aca-
23
demics and life;
24
‘‘(iv) school-wide learning environ-
25
ments where all students and adults feel

safe, welcomed, and supported can enable
1
students to succeed despite traumatic expe-
2
riences; and
3
‘‘(v) services, supports, and programs
4
provided to meet individual student needs
5
should be trauma-informed, where appro-
6
priate, and increase student connection to
7
the school-wide learning environment;
8
‘‘(B) adoption of disciplinary procedures
9
and practices that—
10
‘‘(i) accompany disciplinary actions
11
with holistic assessments and positive be-
12
havioral interventions and supports to ad-
13
dress the underlying causes of student be-
14
havior, including trauma;
15
‘‘(ii) avoid harsh, punitive, or exclu-
16
sionary disciplinary practices;
17
‘‘(iii) utilize evidence-based restorative
18
practices that build a culture of trust; and
19
‘‘(iv) do not discriminate on the basis
20
of race, color, national origin, sex (includ-
21
ing sexual orientation or gender identity),
22
disability, English proficiency status, mi-
23
grant status, or age consistent with the
24
Age Discrimination Act of 1975 (42

ments of 1972 (20 U.S.C. 1681 et seq.),

section 504 of the Rehabilitation Act of

1973 (29 U.S.C. 794), the Americans with

Disabilities Act of 1990 (42 U.S.C. 12101

et seq.), and the Individuals with Disabil-
8
ities Education Act (42 U.S.C. 1400 et
9
seq.); and

‘‘(C) activities that engage teachers, teach-
11
ers assistants, school leaders, paraprofessionals,
12
specialized instructional support personnel, and
13
other staff in a process of school-based planning
14
to—
15
‘‘(i) promote a school-wide culture of
16
acceptance;
17
‘‘(ii) help all students feel safe and
18
connected to the school community;
19
‘‘(iii) support all students to form
20
positive relationships with adults and
21
peers, understand and manage emotions,
22
achieve success academically and in extra-
23
curricular areas, and experience physical
24
and psychological health and well being;

‘‘(iv) promote teamwork and effective

communication among all staff and shared
2
responsibility for every student;
3
‘‘(v) integrate evidence-based practices
4
that build social-emotional skills into rig-
5
orous academic instruction; and
6
‘‘(vi) recognize and prevent adult im-
7
plicit bias.’’.

(b) STATE PLAN.—Section 1111(g)(1)(C) of such
9
Act (20 U.S.C. 6311(g)(1)(C)) is amended—
10
(1) by striking ‘‘reducing’’;
11
(2) in clause (i), by inserting ‘‘reducing’’ before
12
‘‘incidences’’;
13
(3) in clause (ii)—
14
(A) by inserting ‘‘reducing’’ before ‘‘the
15
overuse’’; and
16
(B) by striking ‘‘and’’;
17
(4) in clause (iii)—
18
(A) by inserting ‘‘reducing’’ before ‘‘the
19
use’’; and
20
(B) by inserting ‘‘and’’ after ‘‘safety;’’; and
21
(5) by adding at the end the following:

‘‘(iv) increasing the prevalence of
23
trauma-informed practices;’’.

(c) PLAN PROVISIONS.—Section 1112(b) of the Ele-
1
mentary and Secondary Education Act of 1965 (20 U.S.C.
2
6312(b)) is amended—
3
(1) by redesignating paragraphs (12) and (13)
4
as paragraphs (13) and (14), respectively; and
5
(2) by inserting after paragraph (11) the fol-
6
lowing:
7
‘‘(12) how the local educational agency will sup-
8
port efforts to increase the prevalence of trauma-in-
9
formed practices;’’.

SCHOOLWIDE
PROGRAM.—Section

1114(b)(7)(A)(iii)
of
such

(1) in subclause (IV), by striking at the end

(e) TRAINING.—Section 2101 of such Act (20 U.S.C.

6611) is amended—

through (M) as subparagraphs (L) through (N)

respectively; and

(B) by inserting after subparagraph (J)

‘‘(K) A description of how the State edu-

cational agency will use funds under this part

to increase the prevalence of trauma-informed
15
practices.’’.

(f) LOCAL USE OF FUNDS.—Section 2103(b)(3)(I) of
17
such Act (20 U.S.C. 6613(b)(3)(I)) is amended—
18
(1) by redesignating clauses (i) through (iv) as
19
clauses (ii) through (v); and
20
(2) by inserting before clause (ii), as redesig-
21
nated, the following:
22
‘‘(i) trauma-informed practices;’’.

(g) STATE ACTIVITIES.—Section 4104(b)(3)(B)(ii) of
24
such Act (20 U.S.C. 7114(b)(3)(B)(ii)) is amended—
