Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Southern Campaign 4 of the Revolution National Heritage Corridor Act of 5 2019’’. 6 SEC. 2. FINDINGS AND PURPOSE. 7 (a) FINDINGS.—Congress finds that— 8 VerDate Sep 11 2014 04:43 Aug 06, 2019 Jkt 089200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\S2436.IS S2436 kjohnson on DSK79L0C42 with BILLS 2 •S 2436 IS (1) in accordance with the Study, the Southern 1 Campaign of the Revolution National Heritage Cor- 2 ridor, an 8-mile-wide corridor, provides operational 3 efficiency in connecting the greatest concentration of 4 the Carolinas’ Revolutionary War sites including 5 battlefields, historic communities, farmsteads, and 6 landscapes that reflect the cultural and natural envi- 7 ronments of North Carolina and South Carolina in 8 the latter half of the 18th century; 9 (2) there is a national interest in protecting, 10 conserving, restoring, promoting, and interpreting 11 the benefits of the Corridor for the residents of, and 12 visitors to, the Corridor; 13 (3) a primary responsibility for conserving, pre- 14 serving, protecting, and promoting the benefits re- 15 sides with the Managing Entity having jurisdiction 16 over the Corridor; and 17 (4) in view of the longstanding Federal practice 18 of assisting States in creating, protecting, con- 19 serving, preserving, and interpreting areas of signifi- 20 cant natural and cultural importance, and in view of 21 the national significance of the Corridor, the Federal 22 Government has an interest in assisting the States 23 and the Managing Entity in fulfilling the respon- 24 sibilities described in paragraph (3). 25 VerDate Sep 11 2014 04:43 Aug 06, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S2436.IS S2436 kjohnson on DSK79L0C42 with BILLS 3 •S 2436 IS (b) PURPOSES.—The purposes of this Act are— 1 (1) to protect, preserve, conserve, restore, pro- 2 mote, interpret, and make available for the benefit 3 of the public the historic, cultural, and natural re- 4 sources of the Corridor; 5 (2) to encourage and support, through financial 6 and technical assistance, the Managing Entity in the 7 development of a Management Action Plan for the 8 Corridor to ensure coordinated public and private 9 action in the Corridor in a manner consistent with 10 subsection (a); 11 (3) to provide, during the development of an in- 12 tegrated Corridor Management Action Plan, Federal 13 financial and technical assistance for the protection, 14 preservation, and conservation of land and water 15 areas in the Corridor that are in danger of being ad- 16 versely affected or destroyed; 17 (4) to encourage and assist Managing Entity to 18 identify the full range of public and private technical 19 and financial assistance programs and services avail- 20 able to implement the Corridor Management Action 21 Plan; and 22 (5) to encourage adequate coordination of all 23 government programs affecting the historic, cultural, 24 and natural resources of the Corridor. 25 VerDate Sep 11 2014 04:43 Aug 06, 2019 Jkt 089200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\S2436.IS S2436 kjohnson on DSK79L0C42 with BILLS 4 •S 2436 IS SEC. 3. DEFINITIONS. 1 In this Act: 2 (1) CORRIDOR.—The term ‘‘Corridor’’ means 3 the Southern Campaign of the Revolution National 4 Heritage Corridor established by section 4(a). 5 (2) CORRIDOR MANAGEMENT ACTION PLAN.— 6 The term ‘‘Corridor Management Action Plan’’ 7 means the management action plan developed under 8 section 6. 9 (3) MANAGEMENT ENTITY.—The term ‘‘Man- 10 agement Entity’’ means the University of South 11 Carolina as established under section 4. 12 (4) SECRETARY.—The term ‘‘Secretary’’ means 13 the Secretary of the Interior. 14 (5) STATES.—The term ‘‘States’’ mean the 15 States of North Carolina and South Carolina. 16 (6) STUDY.—The term ‘‘Study’’ means the De- 17 partment of the Interior, National Park Service 18 (NPS)’s July 2015 Southern Campaign of the Revo- 19 lution National Heritage Area Suitability/Feasibility 20 Study. 21 (7) MAP.—The term ‘‘map’’ means the map 22 provided in the Study: Appendix C: Corridor Maps, 23 page 93, ‘‘Map 1: Proposed National Heritage Area 24 Corridor’’. 25 VerDate Sep 11 2014 04:43 Aug 06, 2019 Jkt 089200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\S2436.IS S2436 kjohnson on DSK79L0C42 with BILLS 5 •S 2436 IS SEC. 4. SOUTHERN CAMPAIGN OF THE REVOLUTION NA- 1 TIONAL HERITAGE CORRIDOR. 2 (a) ESTABLISHMENT.—There is established in the 3 States the Southern Campaign of the Revolution National 4 Heritage Corridor. 5 (b) BOUNDARIES.—The Corridor shall consist of the 6 area depicted on the map. The Corridor shall be specified 7 in detail in the Corridor Management Action Plan. 8 (c) MAP.—A map of the Corridor shall be on file and 9 available for public inspection in the appropriate offices 10 of— 11 (1) the National Park Service; and 12 (2) the Management Entity. 13 (d) ADDITION.—Additional areas of the States out- 14 side the Corridor boundaries may be added to the Corridor 15 by the Secretary at the request of the Management Entity. 16 (e) MANAGEMENT ENTITY.—The Management Enti- 17 ty for the Corridor shall be The University of South Caro- 18 lina, a public research university. 19 SEC. 5. ADMINISTRATION. 20 (a) AUTHORITIES.—To carry out the management 21 plan, the Secretary, acting through the management enti- 22 ty, may use amounts made available under this section 23 to— 24 VerDate Sep 11 2014 04:43 Aug 06, 2019 Jkt 089200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6201 E:\BILLS\S2436.IS S2436 kjohnson on DSK79L0C42 with BILLS 6 •S 2436 IS (1) make grants to the States or a political sub- 1 division of the States, nonprofit organizations, and 2 other persons; 3 (2) enter into cooperative agreements with, or 4 provide technical assistance to, the States or a polit- 5 ical subdivision of the States, nonprofit organiza- 6 tions, and other interested parties; 7 (3) hire and compensate staff, which shall in- 8 clude individuals with expertise in natural, cultural, 9 and historical resources protection, and heritage pro- 10 gramming; 11 (4) obtain money or services from any source 12 including any that are provided under any other 13 Federal law or program; 14 (5) contract for goods or services; and 15 (6) undertake to be a catalyst for any other ac- 16 tivity that furthers the Corridor and is consistent 17 with the approved Corridor Management Action 18 Plan. 19 (b) DUTIES.—The management entity shall— 20 (1) in accordance with section 6, prepare and 21 submit a Corridor Management Action Plan for the 22 Corridor to the Secretary; 23 VerDate Sep 11 2014 04:43 Aug 06, 2019 Jkt 089200 PO 00000 Frm 00006 Fmt 6652 Sfmt 6201 E:\BILLS\S2436.IS S2436 kjohnson on DSK79L0C42 with BILLS 7 •S 2436 IS (2) assist units of local government, regional 1 planning organizations, and nonprofit organizations 2 in carrying out the approved management plan by— 3 (A) carrying out programs and projects 4 that recognize, protect, and enhance important 5 resource values in the Corridor; 6 (B) establishing and maintaining interpre- 7 tive exhibits and programs in the Corridor; 8 (C) developing recreational and educational 9 opportunities in the Corridor; 10 (D) increasing public awareness of, and 11 appreciation for, natural, historical, scenic, and 12 cultural resources of the Corridor; 13 (E) protecting and restoring historic sites 14 and buildings in the Corridor that are con- 15 sistent with Corridor themes; 16 (F) ensuring that clear, consistent, and ap- 17 propriate signs identifying points of public ac- 18 cess, and sites of interest are posted throughout 19 the Corridor; and 20 (G) promoting a wide range of partner- 21 ships among governments, organizations, and 22 individuals to further the Corridor; 23 (3) consider the interests of diverse units of 24 government, businesses, organizations, and individ- 25 VerDate Sep 11 2014 04:43 Aug 06, 2019 Jkt 089200 PO 00000 Frm 00007 Fmt 6652 Sfmt 6201 E:\BILLS\S2436.IS S2436 kjohnson on DSK79L0C42 with BILLS 8 •S 2436 IS uals in the Corridor in the preparation and imple- 1 mentation of the Corridor Management Action Plan; 2 (4) conduct meetings open to the public at least 3 semiannually regarding the development and imple- 4 mentation of the Corridor Management Plan; 5 (5) for any year that Federal funds have been 6 received under this section— 7 (A) submit an annual report to the Sec- 8 retary that describes the activities, expenses, 9 and income of the management entity (includ- 10 ing grants to any other entities during the year 11 that the report is made); 12 (B) make available to the Secretary for 13 audit all records relating to the expenditure of 14 the funds and any matching funds; and 15 (C) require, with respect to all agreements 16 authorizing expenditure of Federal funds by 17 other organizations, that the organizations re- 18 ceiving the funds make available to the Sec- 19 retary for audit all records concerning the ex- 20 penditure of the funds; and 21 (6) encourage by appropriate means economic 22 viability that is consistent with the Corridor. 23 (c) PROHIBITION ON THE ACQUISITION OF REAL 24 PROPERTY.—The management entity shall not use Fed- 25 VerDate Sep 11 2014 04:43 Aug 06, 2019 Jkt 089200 PO 00000 Frm 00008 Fmt 6652 Sfmt 6201 E:\BILLS\S2436.IS S2436 kjohnson on DSK79L0C42 with BILLS 9 •S 2436 IS eral funds made available under this section to acquire 1 real property or any interest in real property. 2 SEC. 6. CORRIDOR MANAGEMENT ACTION PLAN. 3 (a) IN GENERAL.—Not later than 3 years after the 4 date of enactment of this Act, the Management Entity 5 shall submit to the Secretary for approval a proposed Cor- 6 ridor Management Action Plan for the Corridor. 7 (b) REQUIREMENTS.—The Corridor Management Ac- 8 tion Plan shall— 9 (1) determine the boundaries of the Corridor 10 adherent to section 4(b); 11 (2) incorporate an integrated and cooperative 12 approach for the protection, enhancement, and inter- 13 pretation of the natural, cultural, historic, scenic, 14 and recreational resources of the Corridor; 15 (3) take into consideration Federal, State, local, 16 and Tribal plans and treaty rights; 17 (4) include— 18 (A) an inventory of— 19 (i) the resources located in the Cor- 20 ridor; and 21 (ii) any other property in the Corridor 22 that— 23 (I) is related to the themes of the 24 Corridor; and 25 VerDate Sep 11 2014 04:43 Aug 06, 2019 Jkt 089200 PO 00000 Frm 00009 Fmt 6652 Sfmt 6201 E:\BILLS\S2436.IS S2436 kjohnson on DSK79L0C42 with BILLS 10 •S 2436 IS (II) should be preserved, re- 1 stored, managed, or maintained be- 2 cause of the significations of the prop- 3 erty; 4 (B) comprehensive policies, strategies, and 5 recommendations for conservation, funding, 6 management, and development of the Corridor; 7 (C) a description of the actions that the 8 Federal Government, State, Tribal, and local 9 governments, private organizations, and individ- 10 uals have agreed to take to protect the natural, 11 historical, cultural, scenic, and recreational re- 12 sources of the Corridor; 13 (D) a program of implementation for the 14 Corridor Management Action Plan by the man- 15 agement entity that includes a description of— 16 (i) actions to facilitate ongoing col- 17 laboration among partners to promote 18 plans for resource protection, restoration, 19 and construction; and 20 (ii) specific commitments for imple- 21 mentation that have been made by the 22 management entity or any government, or- 23 ganization, or individual for the first 5 24 years of operation; 25 VerDate Sep 11 2014 04:43 Aug 06, 2019 Jkt 089200 PO 00000 Frm 00010 Fmt 6652 Sfmt 6201 E:\BILLS\S2436.IS S2436 kjohnson on DSK79L0C42 with BILLS 11 •S 2436 IS (E) the identification of sources of funding 1 for carrying out the management plan; 2 (F) analysis and recommendations for 3 means by which Federal, State, local, and Trib- 4 al programs, including the role of the National 5 Park Service in the Corridor, may best be co- 6 ordinated to carry out this subsection; and 7 (G) an interpretative plan for the Corridor; 8 and 9 (5) recommend policies and strategies for re- 10 source management that consider and detail the ap- 11 plication of appropriate land and water management 12 techniques, including the development of intergov- 13 ernmental and interagency cooperative agreements 14 to protect the natural, historical, cultural, edu- 15 cational, scenic, and recreational resources of the 16 Corridor. 17 (c) DEADLINE.—If a proposed management plan is 18 not submitted to the Secretary by the date that is 3 years 19 after the date of enactment of this Act, the management 20 entity shall be ineligible to receive additional funding 21 under this section until the date that the Secretary re- 22 ceives and approves the management plan. 23 (d) APPROVAL OR DISAPPROVAL OF MANAGEMENT 24 PLAN.— 25 VerDate Sep 11 2014 04:43 Aug 06, 2019 Jkt 089200 PO 00000 Frm 00011 Fmt 6652 Sfmt 6201 E:\BILLS\S2436.IS S2436 kjohnson on DSK79L0C42 with BILLS 12 •S 2436 IS (1) IN GENERAL.—Not later than 180 days 1 after the date of receipt of the management plan the 2 Secretary, in consultation with State and Tribal gov- 3 ernments, shall approve or disapprove the manage- 4 ment plan. 5 (2) CRITERIA FOR APPROVAL.—In determining 6 whether to approve the management plan, the Sec- 7 retary shall consider whether— 8 (A) the management entity is representa- 9 tive of the diverse interests of the Corridor, in- 10 cluding Federal, State, Tribal, and local govern- 11 ments, natural and historic resources protection 12 organizations, educational institutions, busi- 13 nesses, recreational organizations; 14 (B) the management entity has afforded 15 adequate opportunity, including public hearings, 16 for public and governmental involvement in the 17 preparation of the management plan; 18 (C) the resource preservation and interpre- 19 tation strategies contained in the management 20 plan would adequately protect the natural, his- 21 torical, and cultural resources of the Corridor; 22 and 23 (D) the Secr [Text truncated for display.
