Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. TIMELINE FOR PM2.5 REQUIREMENTS IN FAIR- 3 BANKS NORTH STAR BOROUGH OF ALASKA. 4 (a) DEFINITIONS.—In this section: 5 (1) ADMINISTRATOR.—The term ‘‘Adminis- 6 trator’’ means the Administrator of the Environ- 7 mental Protection Agency. 8 VerDate Sep 11 2014 19:43 Aug 15, 2019 Jkt 089200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\S2426.IS S2426 pamtmann on DSKBFK8HB2PROD with BILLS 2 •S 2426 IS (2) SERIOUS AREA.—The term ‘‘Serious Area’’ 1 means an area reclassified as a Serious Area with 2 respect to PM2.5 under section 188(b) of the Clean 3 Air Act (42 U.S.C. 7513(b)). 4 (b) TIMELINE.—Notwithstanding subpart 4 of part 5 D of title I of the Clean Air Act (42 U.S.C. 7513 et seq.), 6 sections 51.1003 and 51.1004 of title 40, Code of Federal 7 Regulations, or any other provision of law, the following 8 shall apply with respect to the attainment of the 2006 na- 9 tional ambient air quality standard for PM2.5 under the 10 Clean Air Act (42 U.S.C. 7401 et seq.) in the Fairbanks 11 North Star Borough in the State of Alaska under section 12 81.302 of title 40, Code of Federal Regulations (as in ef- 13 fect on the date of enactment of this Act): 14 (1) The deadline for the submission of a Seri- 15 ous Area implementation plan under section 16 189(b)(1) of the Clean Air Act (42 U.S.C. 17 7513a(b)(1)) shall be June 30, 2021. 18 (2) The Serious Area attainment date under 19 section 188(c)(2) of the Clean Air Act (42 U.S.C. 20 7513(c)(2)) shall be— 21 (A) if the Administrator does not grant an 22 extension under section 188(e) of that Act (42 23 U.S.C. 7513(e)), as expeditiously as practicable, 24 but not later than December 31, 2023; or 25 VerDate Sep 11 2014 19:43 Aug 15, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S2426.IS S2426 pamtmann on DSKBFK8HB2PROD with BILLS 3 •S 2426 IS (B) if the Administrator grants an exten- 1 sion under section 188(e) of that Act (42 2 U.S.C. 7513(e)), as expeditiously as practicable, 3 but not later than December 31, 2028. 4 (3) If the Fairbanks North Star Borough does 5 not attain the national ambient air quality standard 6 by the applicable Serious Area attainment date 7 under paragraph (2), the deadline for the submission 8 of the revision of the Serious Area implementation 9 plan that provides for attainment and for the annual 10 reduction in PM2.5 or PM2.5 precursor emissions of 11 not less than 5 percent under section 189(d) of the 12 Clean Air Act (42 U.S.C. 7513a(d)) shall be— 13 (A) if the Administrator does not grant an 14 extension under section 188(e) of that Act (42 15 U.S.C. 7513(e)), not later than 1 year after the 16 Serious Area attainment date under paragraph 17 (2)(A); or 18 (B) if the Administrator grants an exten- 19 sion under section 188(e) of that Act (42 20 U.S.C. 7513(e)), not later than 1 year after the 21 Serious Area attainment date under paragraph 22 (2)(B). 23 Æ VerDate Sep 11 2014 19:43 Aug 15, 2019 Jkt 089200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6301 E:\BILLS\S2426.IS S2426 pamtmann on DSKBFK8HB2PROD with BILLS
