REIMBURSEMENT BY DEPARTMENT OF VETERANS 1 AFFAIRS FOR EMERGENCY AMBULANCE 2 SERVICES. 3 (a) IN GENERAL.—Section 1725(c) of title 38, 4 United States Code, is amended by adding at the end the 5 following new paragraph: 6 ‘‘(5) In delineating under paragraph (1)(B) the cir- 7 cumstances under which reimbursement may be made 8 under this section for ambulance services for an individual, 9 the Secretary shall treat such services as emergency serv- 10 ices for which reimbursement may be made under this sec- 11 tion if the Secretary determines that the request for ambu- 12 lance services was made as a result of the sudden onset 13 of a medical condition of such a nature that a prudent 14 layperson who possesses an average knowledge of health 15 and medicine— 16 ‘‘(A) would have reasonably expected that a 17 delay in seeking immediate medical attention would 18 have been hazardous to the life or health of the indi- 19 vidual; or 20 ‘‘(B) could reasonably expect the absence of im- 21 mediate medical attention to result in placing the 22 health of the individual in serious jeopardy, the seri- 23 ous impairment of bodily functions, or the serious 24 dysfunction of any bodily organ or part.’’. 25 VerDate Sep 11 2014 04:51 Aug 08, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S2392.IS S2392 kjohnson on DSK79L0C42 with BILLS 3 •S 2392 IS (b) EFFECTIVE DATE.—The amendment made by 1 subsection (a) shall apply with respect to ambulance serv- 2 ices provided on or after the date of the enactment of this 3 Act. 4 Æ VerDate Sep 11 2014 04:51 Aug 08, 2019 Jkt 089200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6301 E:\BILLS\S2392.IS S2392 kjohnson on DSK79L0C42 with BILLS
