AN ACT
To amend the McKinney-Vento Homeless Assistance Act to
enable Indian Tribes and tribally designated housing en-
tities to apply for, receive, and administer grants and
subgrants under the Continuum of Care Program of
the Department of Housing and Urban Development.
Be it enacted by the Senate and House of Representa-

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Tribal Access to
2
Homeless Assistance Act’’.
3
SEC. 2. PARTICIPATION OF INDIAN TRIBES AND TRIBALLY
4
DESIGNATED HOUSING ENTITIES IN CON-
5
TINUUM OF CARE PROGRAM.
6
(a) IN GENERAL.—Title IV of the McKinney-Vento
7
Homeless Assistance Act (42 U.S.C. 11360 et seq.) is
8
amended—
9
(1) in section 401 (42 U.S.C. 11360)—
10
(A) by redesignating paragraphs (10)
11
through (33) as paragraphs (12) through (35),
12
respectively;
13
(B) by redesignating paragraphs (8) and
14
(9) as paragraphs (9) and (10), respectively;
15
(C) by inserting after paragraph (7) the
16
following:
17
‘‘(8) FORMULA AREA.—The term ‘formula area’
18
has the meaning given the term in section 1000.302
19
of title 24, Code of Federal Regulations, or any suc-
20
cessor regulation.’’;
21
(D) in paragraph (9), as so redesignated,
22
by inserting ‘‘a formula area,’’ after ‘‘non-
23
entitlement area,’’; and
24
(E) by inserting after paragraph (10), as
25
so redesignated, the following:

‘‘(11) INDIAN TRIBE.—The term ‘Indian Tribe’
1
has the meaning given the term ‘Indian tribe’ in sec-
2
tion 4 of the Native American Housing Assistance
3
and Self-Determination Act of 1996 (25 U.S.C.
4
4103).’’; and
5
(2) in subtitle C (42 U.S.C. 11381 et seq.), by
6
adding at the end the following:

‘‘SEC. 435. PARTICIPATION OF INDIAN TRIBES AND TRIB-
8
ALLY DESIGNATED HOUSING ENTITIES.
9
‘‘Notwithstanding any other provision of this title, for
10
purposes of this subtitle, an Indian Tribe or tribally des-
11
ignated housing entity (as defined in section 4 of the Na-
12
tive American Housing Assistance and Self-Determination
13
Act of 1996 (25 U.S.C. 4103)) may—
14
‘‘(1) be a collaborative applicant or eligible enti-
15
ty; or
16
‘‘(2) receive grant amounts from another entity
17
that receives a grant directly from the Secretary,
18
and use the amounts in accordance with this sub-
19
title.’’.

(b) TECHNICAL AND CONFORMING AMENDMENT.—

The table of contents in section 101(b) of the McKinney-
22
Vento Homeless Assistance Act (Public Law 100–77; 101
23
Stat. 482) is amended by inserting after the item relating
24
to section 434 the following:
