FINDINGS. 1 Congress finds that— 2 (1) the building sector uses more than 40 per- 3 cent of the energy of the United States; 4 (2) emerging building energy monitoring and 5 control technologies are enabling a transition of the 6 building sector to ‘‘smart’’ buildings that have dra- 7 matically reduced energy use and improved quality 8 of service to occupants; 9 (3) an analysis of select private-sector smart 10 buildings by the Department of Energy would docu- 11 ment the costs and benefits of the emerging tech- 12 nologies, promote the adoption of the technologies, 13 and accelerate the transition to the technologies; 14 (4) with over 400,000 buildings, the Federal 15 Government is the largest building owner in the 16 United States; and 17 (5) the Federal Government can also accelerate 18 the transition to smart building technologies by dem- 19 onstrating and evaluating emerging smart building 20 technologies using existing programs and funding to 21 showcase selected Federal smart buildings. 22 SEC. 3. DEFINITIONS. 23 In this Act: 24 (1) DEPARTMENT.—The term ‘‘Department’’ 25 means the Department of Energy. 26 VerDate Sep 11 2014 22:02 Oct 24, 2019 Jkt 099200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S2335.RS S2335 pamtmann on DSKBC07HB2PROD with BILLS 3 •S 2335 RS (2) PROGRAM.—The term ‘‘program’’ means 1 the Federal Smart Building Program established 2 under section 4(a). 3 (3) SECRETARY.—The term ‘‘Secretary’’ means 4 the Secretary of Energy. 5 (4) SMART BUILDING.—The term ‘‘smart build- 6 ing’’ means a building, or collection of buildings, 7 with an energy system that— 8 (A) is flexible and automated; 9 (B) has extensive operational monitoring 10 and communication connectivity, allowing re- 11 mote monitoring and analysis of all building 12 functions; 13 (C) takes a systems-based approach in in- 14 tegrating the overall building operations for 15 control of energy generation, consumption, and 16 storage; 17 (D) communicates with utilities and other 18 third-party commercial entities, if appropriate; 19 (E) protects the health and safety of occu- 20 pants and workers; and 21 (F) is cybersecure. 22 (5) SMART BUILDING ACCELERATOR.—The 23 term ‘‘smart building accelerator’’ means an initia- 24 VerDate Sep 11 2014 22:02 Oct 24, 2019 Jkt 099200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\S2335.RS S2335 pamtmann on DSKBC07HB2PROD with BILLS 4 •S 2335 RS tive that is designed to demonstrate specific innova- 1 tive policies and approaches— 2 (A) with clear goals and a clear timeline; 3 and 4 (B) that, on successful demonstration, 5 would accelerate investment in energy effi- 6 ciency. 7 SEC. 4. FEDERAL SMART BUILDING PROGRAM. 8 (a) ESTABLISHMENT.—Not later than 1 year after 9 the date of enactment of this Act, the Secretary shall, in 10 consultation with the Administrator of General Services, 11 establish a program to be known as the ‘‘Federal Smart 12 Building Program’’— 13 (1) to implement smart building technology; 14 and 15 (2) to demonstrate the costs and benefits of 16 smart buildings. 17 (b) SELECTION.— 18 (1) IN GENERAL.—The Secretary shall coordi- 19 nate the selection of not fewer than 1 building from 20 among each of several key Federal agencies, as de- 21 scribed in subsection (d), to compose an appro- 22 priately diverse set of smart buildings based on size, 23 type, and geographic location. 24 VerDate Sep 11 2014 22:02 Oct 24, 2019 Jkt 099200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\S2335.RS S2335 pamtmann on DSKBC07HB2PROD with BILLS 5 •S 2335 RS (2) INCLUSION OF COMMERCIALLY OPERATED 1 BUILDINGS.—In making selections under paragraph 2 (1), the Secretary may include buildings that are 3 owned by the Federal Government but are commer- 4 cially operated. 5 (c) TARGETS.—Not later than 18 months after the 6 date of enactment of this Act, the Secretary shall establish 7 targets for the number of smart buildings to be commis- 8 sioned and evaluated by key Federal agencies by 3 years 9 and 6 years after the date of enactment of this Act. 10 (d) FEDERAL AGENCY DESCRIBED.—The key Fed- 11 eral agencies referred to subsection (b)(1) shall include 12 buildings operated by— 13 (1) the Department of the Army; 14 (2) the Department of the Navy; 15 (3) the Department of the Air Force; 16 (4) the Department of Energy; 17 (5) the Department of the Interior; 18 (6) the Department of Veterans Affairs; and 19 (7) the General Services Administration. 20 (e) REQUIREMENT.—In implementing the program, 21 the Secretary shall leverage existing financing mechanisms 22 including energy savings performance contracts, utility en- 23 ergy service contracts, and annual appropriations. 24 VerDate Sep 11 2014 22:02 Oct 24, 2019 Jkt 099200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6201 E:\BILLS\S2335.RS S2335 pamtmann on DSKBC07HB2PROD with BILLS 6 •S 2335 RS (f) EVALUATION.—Using the guidelines of the Fed- 1 eral Energy Management Program relating to whole-build- 2 ing evaluation, measurement, and verification, the Sec- 3 retary shall evaluate the costs and benefits of the buildings 4 selected under subsection (b), including an identification 5 of— 6 (1) which advanced building technologies— 7 (A) are most cost-effective; and 8 (B) show the most promise for— 9 (i) increasing building energy savings; 10 (ii) increasing service performance to 11 building occupants; 12 (iii) reducing environmental impacts; 13 and 14 (iv) establishing cybersecurity; and 15 (2) any other information the Secretary deter- 16 mines to be appropriate. 17 (g) AWARDS.—The Secretary may expand awards 18 made under the Federal Energy Management Program 19 and the Better Building Challenge to recognize specific 20 agency achievements in accelerating the adoption of smart 21 building technologies. 22 SEC. 5. LEVERAGING EXISTING PROGRAMS. 3 (a) BETTER BUILDING CHALLENGE.—As part of the 4 Better Building Challenge of the Department, the Sec- 5 retary, in consultation with major private sector property 6 owners, shall develop smart building accelerators to dem- 7 onstrate innovative policies and approaches that will accel- 8 erate the transition to smart buildings in the public, insti- 9 tutional, and commercial buildings sectors. 10 (b) RESEARCH AND DEVELOPMENT.— 11 (1) IN GENERAL.—The Secretary shall conduct 12 research and development to address key barriers to 13 the integration of advanced building technologies 14 and to accelerate the transition to smart buildings. 15 (2) INCLUSION.—The research and development 16 conducted under paragraph (1) shall include re- 17 search and development on— 18 (A) achieving whole-building, systems-level 19 efficiency through smart system and component 20 integration; 21 (B) improving physical components, such 22 as sensors and controls, to be adaptive, antici- 23 patory, and networked; 24 VerDate Sep 11 2014 22:02 Oct 24, 2019 Jkt 099200 PO 00000 Frm 00008 Fmt 6652 Sfmt 6201 E:\BILLS\S2335.RS S2335 pamtmann on DSKBC07HB2PROD with BILLS 9 •S 2335 RS (C) reducing the cost of key components to 1 accelerate the adoption of smart building tech- 2 nologies; 3 (D) data management, including the cap- 4 ture and analysis of data and the interoper- 5 ability of the energy systems; 6 (E) protecting against cybersecurity 7 threats and addressing security vulnerabilities 8 of building systems or equipment; 9 (F) business models, including how busi- 10 ness models may limit the adoption of smart 11 building technologies and how to support 12 transactive energy; 13 (G) integration and application of com- 14 bined heat and power systems and energy stor- 15 age for resiliency; 16 (H) characterization of buildings and com- 17 ponents; 18 (I) consumer and utility protections; 19 (J) continuous management, including the 20 challenges of managing multiple energy systems 21 and optimizing systems for disparate stake- 22 holders; and 23 VerDate Sep 11 2014 22:02 Oct 24, 2019 Jkt 099200 PO 00000 Frm 00009 Fmt 6652 Sfmt 6201 E:\BILLS\S2335.RS S2335 pamtmann on DSKBC07HB2PROD with BILLS 10 •S 2335 RS (K) other areas of research and develop- 1 ment, as determined appropriate by the Sec- 2 retary. 3 SEC. 7.
