A BILL
To prohibit the private purchase or sale of a firearm or
ammunition except through a federally licensed firearms
dealer, to impose additional requirements on such a deal-
er, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Santa Fe High School
4
Victims Act’’.

SEC. 2. PROHIBITION ON PRIVATE PURCHASE OR SALE OF

FIREARM
OR
AMMUNITION
EXCEPT

THROUGH A FEDERALLY LICENSED FIRE-
3
ARMS DEALER.

(a) IN GENERAL.—Section 922 of title 18, United
5
States Code, is amended by adding at the end the fol-
6
lowing:
7
‘‘(aa) It shall be unlawful for an individual to know-
8
ingly—
9
‘‘(1) sell a firearm or ammunition, except to a
10
licensed dealer; or
11
‘‘(2) purchase a firearm or ammunition, except
12
from a licensed dealer.’’.
13
(b) PENALTIES.—Section 924(a) of such title is
14
amended by adding at the end the following:
15
‘‘(8) Whoever violates section 922(aa) shall be fined
16
not less than $75,000 and not more than $150,000, im-
17
prisoned not less than 15 years and not more than 25
18
years, or both.’’.

SEC. 3. ANNUAL RENEWAL OF FEDERAL LICENSE TO DEAL
20
IN FIREARMS OTHER THAN DESTRUCTIVE
21
DEVICES; INCREASE IN LICENSE FEE.

(a) IN GENERAL.—Section 923(a)(3)(B) of title 18,
23
United States Code, is amended—
24
(1) by striking ‘‘$200 for 3 years’’ and insert-
25
ing ‘‘$500 per year’’; and

(b) ADDITIONAL INCREASE IN FEES.—Effective Jan-
3
uary 1, 2021, section 923(a)(3)(B) of title 18, United
4
States Code, is amended—
5
(1) by striking ‘‘$500’’ and inserting ‘‘$1,000’’;
6
and
7
(2) by striking ‘‘$250’’ and inserting ‘‘$500’’.

SEC. 4. ADDITIONAL REQUIREMENTS APPLICABLE TO FED-
9
ERALLY LICENSED FIREARMS DEALERS.
10
(a) IN GENERAL.—Section 923 of title 18, United
11
States Code, is amended by adding at the end the fol-
12
lowing:
13
‘‘(m) Each licensed dealer shall report to the Attor-
14
ney General and local law enforcement authorities any in-
15
stance in which the licensed dealer suspects, or is made
16
aware, that—
17
‘‘(1) an actual or prospective purchaser of a
18
firearm or ammunition is exhibiting signs of mental
19
duress, or suicidal or homicidal ideation, or other be-
20
haviors which alarm the licensed dealer; or
21
‘‘(2) an individual has attempted to purchase a
22
firearm on behalf of another individual.
23
‘‘(n)(1) Each licensed dealer shall prominently dis-
24
play at the business premises subject to the license to deal

in firearms issued to the licensed dealer under this sec-

tion—
2
‘‘(A) the license;
3
‘‘(B) the name and license number of each indi-
4
vidual who is licensed under this section to sell fire-
5
arms at the business premises; and
6
‘‘(C) a toll-free telephone number established by
7
the Attorney General at which any individual, at any
8
time of day, may immediately report illegal, sus-
9
picious, or alarming behavior.
10
‘‘(2) The Attorney General shall establish a toll-free
11
telephone number to which any individual, at any time of
12
any day, may immediately report illegal, suspicious, or
13
alarming behavior in relating to conduct at, or on the
14
curtilage of, any business premises subject to a license to
15
deal in firearms issued under this section.
16
‘‘(o) Each licensed dealer shall successfully complete
17
an annual training course, certified by the Attorney Gen-
18
eral, in reducing the risk of gun violence through identi-
19
fying high-risk behaviors of customers for firearms or am-
20
munition, and in such other matters relating to dealing
21
in firearms as the Attorney General shall prescribe by reg-
22
ulation, that includes at least 40 hours of classroom train-
23
ing.’’.

(b) ENFORCEMENT.—Section 923(e) of such title is
1
amended—
2
(1) by inserting after the 2nd comma the fol-
3
lowing: ‘‘suspend or revoke a license to deal in fire-
4
arms issued to a licensed dealer who violates sub-
5
section (m), (n), or (o), or’’; and
6
(2) by inserting after the 2nd sentence the fol-
7
lowing: ‘‘The determination as to whether to sus-
8
pend or revoke a license to deal in firearms issued
9
under this section shall be based on the number of
10
requirements of this chapter which have been vio-
11
lated by the licensed dealer.’’.
