A BILL
To amend the Child Nutrition Act of 1966 to clarify the
availability and appropriateness of training for local food
service personnel, and for other purposes.
Be it enacted by the Senate and House of Representa-

SECTION 1. SHORT TITLE.

This Act may be cited as the ββImproving Training

for School Food Service Workers Act of 2019ββ.

SEC. 2. TRAINING AND CERTIFICATION OF ALL LOCAL

FOOD SERVICE PERSONNEL.

Section 7(g)(2)(B) of the Child Nutrition Act of 1966
3
(42 U.S.C. 1776(g)(2)(B)) is amended by adding at the
4
end the following:
5
ββ(iv)
AVAILABILITY
AND
APPRO-

PRIATENESS OF TRAINING.β

ββ(I) IN
GENERAL.βA training
8
program carried out under this sub-
9
paragraph shallβ
10
ββ(aa) to the maximum ex-
11
tent practicable, be scheduled
12
during regular, paid working
13
hours;
14
ββ(bb) be offered in-person, if
15
appropriate;
16
ββ(cc) incorporate hands-on
17
training techniques; and
18
ββ(dd) be provided at no cost
19
to food service personnel.

training program carried out under

to inform food service personnel

of the necessity of the program
3
to be scheduled outside of reg-
4
ular, paid working hours;
5
ββ(bb) food service personnel
6
shall be consulted to schedule the
7
program at a time that is mini-
8
mally disruptive to the personnel
9
participating in the training pro-
10
gram;
11
ββ(cc) compensation shall be
12
provided to food service personnel
13
attending the program at the
14
regular rate of pay, including any
15
applicable overtime rate; and
16
ββ(dd) food service personnel
17
shall not be penalized or in any
18
other
manner
discriminated
19
against for not being able to at-
20
tend the program.
