SHORT TITLE. 1 This Act may be cited as the ‘‘Clean Industrial Tech- 2 nology Act of 2019’’ or the ‘‘CIT Act of 2019’’. 3 SEC. 2. PURPOSE. 4 The purpose of this Act and the amendments made 5 by this Act is to encourage the development and evaluation 6 of innovative technologies aimed at increasing— 7 (1) the technological and economic competitive- 8 ness of industry and manufacturing in the United 9 States; and 10 (2) the emissions reduction of nonpower indus- 11 trial sectors. 12 SEC. 3. INDUSTRIAL EMISSIONS REDUCTION TECHNOLOGY 13 DEVELOPMENT PROGRAM. 14 (a) IN GENERAL.—The Energy Independence and 15 Security Act of 2007 is amended by inserting after section 16 453 (42 U.S.C. 17112) the following: 17 ‘‘SEC. 454. INDUSTRIAL EMISSIONS REDUCTION TECH- 18 NOLOGY DEVELOPMENT PROGRAM. 19 ‘‘(a) DEFINITIONS.—In this section: 20 ‘‘(1) DIRECTOR.—The term ‘Director’ means 21 the Director of the Office of Science and Technology 22 Policy. 23 ‘‘(2) ELIGIBLE ENTITY.—The term ‘eligible en- 24 tity’ means— 25 VerDate Sep 11 2014 22:02 Aug 05, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H3978.IH H3978 kjohnson on DSK79L0C42 with BILLS 3 •HR 3978 IH ‘‘(A) a scientist or other individual with 1 knowledge and expertise in emissions reduction; 2 ‘‘(B) an institution of higher education; 3 ‘‘(C) a nongovernmental organization; 4 ‘‘(D) a National Laboratory; 5 ‘‘(E) a private entity; and 6 ‘‘(F) a partnership or consortium of two or 7 more entities described in subparagraphs (B) 8 through (E). 9 ‘‘(3) EMISSIONS REDUCTION.— 10 ‘‘(A) IN GENERAL.—The term ‘emissions 11 reduction’ means the reduction, to the max- 12 imum extent practicable, of net nonwater green- 13 house gas emissions to the atmosphere by en- 14 ergy services and industrial processes. 15 ‘‘(B) EXCLUSION.—The term ‘emissions 16 reduction’ does not include the elimination of 17 carbon embodied in the principal products of in- 18 dustrial manufacturing. 19 ‘‘(4) INSTITUTION OF HIGHER EDUCATION.— 20 The term ‘institution of higher education’ has the 21 meaning given the term in section 101 of the Higher 22 Education Act of 1965 (20 U.S.C. 1001). 23 ‘‘(5) PROGRAM.—The term ‘program’ means 24 the program established under subsection (b)(1). 25 VerDate Sep 11 2014 22:02 Aug 05, 2019 Jkt 089200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H3978.IH H3978 kjohnson on DSK79L0C42 with BILLS 4 •HR 3978 IH ‘‘(b) INDUSTRIAL EMISSIONS REDUCTION TECH- 1 NOLOGY DEVELOPMENT PROGRAM.— 2 ‘‘(1) IN GENERAL.—Not later than 1 year after 3 the date of enactment of the CIT Act of 2019, the 4 Secretary, in coordination with the Director and in 5 consultation with the heads of relevant Federal 6 agencies, National Laboratories, industry, and insti- 7 tutions of higher education, shall establish a cross- 8 cutting industrial emissions reduction technology de- 9 velopment program of research, development, dem- 10 onstration, and commercial application to further 11 the development and commercialization of innovative 12 technologies that— 13 ‘‘(A) increase the technological and eco- 14 nomic competitiveness of industry and manufac- 15 turing in the United States; and 16 ‘‘(B) achieve emissions reduction in non- 17 power industrial sectors. 18 ‘‘(2) COORDINATION.—In carrying out the pro- 19 gram, the Secretary shall— 20 ‘‘(A) coordinate with each relevant office in 21 the Department and any other Federal agency; 22 ‘‘(B) coordinate and collaborate with the 23 Industrial Technology Innovation Advisory 24 Committee established under section 455; and 25 VerDate Sep 11 2014 22:02 Aug 05, 2019 Jkt 089200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H3978.IH H3978 kjohnson on DSK79L0C42 with BILLS 5 •HR 3978 IH ‘‘(C) coordinate with the energy-intensive 1 industries program established under section 2 452. 3 ‘‘(3) LEVERAGE OF EXISTING RESOURCES.—In 4 carrying out the program, the Secretary shall lever- 5 age, to the maximum extent practicable— 6 ‘‘(A) existing resources and programs of 7 the Department and other relevant Federal 8 agencies; and 9 ‘‘(B) public-private partnerships. 10 ‘‘(c) FOCUS AREAS.—The program shall focus on— 11 ‘‘(1) industrial production processes, including 12 technologies and processes that— 13 ‘‘(A) achieve emissions reduction in high- 14 emissions industrial materials production proc- 15 esses, including production processes for iron, 16 steel, steel mill products, aluminum, cement, 17 glass, pulp, paper, and industrial ceramics; 18 ‘‘(B) achieve emissions reduction in 19 medium- and high-temperature heat generation, 20 including— 21 ‘‘(i) through electrification of heating 22 processes; 23 ‘‘(ii) through renewable heat genera- 24 tion technology; and 2 ‘‘(iv) by switching to alternative fuels, 3 including hydrogen; 4 ‘‘(C) achieve emissions reduction in chem- 5 ical production processes; 6 ‘‘(D) leverage smart manufacturing tech- 7 nologies and principles, digital manufacturing 8 technologies, and advanced data analytics to de- 9 velop advanced technologies and practices in in- 10 formation, automation, monitoring, computa- 11 tion, sensing, modeling, and networking that— 12 ‘‘(i) simulate manufacturing produc- 13 tion lines; 14 ‘‘(ii) monitor and communicate pro- 15 duction line status; 16 ‘‘(iii) manage and optimize energy 17 productivity and cost throughout produc- 18 tion; and 19 ‘‘(iv) model, simulate, and optimize 20 the energy efficiency of manufacturing 21 processes; 5 ‘‘(ii) by minimizing waste from indus- 6 trial processes; and 7 ‘‘(iii) by reducing resource intensity; 8 and 9 ‘‘(F) increase the energy efficiency of in- 10 dustrial processes; 11 ‘‘(2) alternative materials that produce fewer 12 emissions during production and result in fewer 13 emissions during use, including— 14 ‘‘(A) innovative building materials; 15 ‘‘(B) high-performance lightweight mate- 16 rials; and 17 ‘‘(C) substitutions for critical materials 18 and minerals; 19 ‘‘(3) development of net-zero emissions liquid 20 and gaseous fuels; 21 ‘‘(4) emissions reduction in shipping, aviation, 22 and long distance transportation, including through 23 the use of alternative fuels; 2 ‘‘(6) high-performance computing to develop ad- 3 vanced materials and manufacturing processes con- 4 tributing to the focus areas described in paragraphs 5 (1) through (5), including— 6 ‘‘(A) modeling, simulation, and optimiza- 7 tion of the design of energy efficient and sus- 8 tainable products; and 9 ‘‘(B) the use of digital prototyping and ad- 10 ditive manufacturing to enhance product de- 11 sign; and 12 ‘‘(7) other technologies that achieve net-zero 13 emissions in nonpower industrial sectors as deter- 14 mined by Secretary in coordination with the Direc- 15 tor. 16 ‘‘(d) GRANTS, CONTRACTS, COOPERATIVE AGREE- 17 MENTS, AND DEMONSTRATION PROJECTS.— 18 ‘‘(1) GRANTS.—In carrying out the program, 19 the Secretary shall award grants on a competitive 20 basis to eligible entities for projects that the Sec- 21 retary determines would best achieve the goals of the 22 program. 23 ‘‘(2) CONTRACTS AND COOPERATIVE AGREE- 24 MENTS.—In carrying out the program, the Secretary 25 VerDate Sep 11 2014 22:02 Aug 05, 2019 Jkt 089200 PO 00000 Frm 00008 Fmt 6652 Sfmt 6201 E:\BILLS\H3978.IH H3978 kjohnson on DSK79L0C42 with BILLS 9 •HR 3978 IH may enter into contracts and cooperative agreements 1 with eligible entities and Federal agencies for 2 projects that the Secretary determines would further 3 the purposes of the program. 4 ‘‘(3) DEMONSTRATION PROJECTS.—In sup- 5 porting technologies developed under this section, 6 the Secretary shall fund demonstration projects that 7 test and validate technologies described in subsection 8 (c). 9 ‘‘(4) APPLICATION.—An entity seeking funding 10 or a contract or agreement under this subsection 11 shall submit to the Secretary an application at such 12 time, in such manner, and containing such informa- 13 tion as the Secretary may require. 14 ‘‘(5) COST SHARING.—In awarding funds under 15 this section, the Secretary shall require cost sharing 16 in accordance with section 988 of the Energy Policy 17 Act of 2005 (42 U.S.C. 16352). 18 ‘‘(e) AUTHORIZATION OF APPROPRIATIONS.— 19 ‘‘(1) IN GENERAL.—There are authorized to be 20 appropriated to the Secretary such sums as are nec- 21 essary to carry out this section for each fiscal year 22 during which the program is in effect. 23 ‘‘(2) DEMONSTRATION PROJECTS.—Of the 24 amount appropriated under paragraph (1), not more 25 VerDate Sep 11 2014 22:02 Aug 05, 2019 Jkt 089200 PO 00000 Frm 00009 Fmt 6652 Sfmt 6201 E:\BILLS\H3978.IH H3978 kjohnson on DSK79L0C42 with BILLS 10 •HR 3978 IH than $650,000,000 shall be used to carry out dem- 1 onstration projects under subsection (d)(3).’’. 2 (b) TECHNICAL AMENDMENT.—The table of contents 3 of the Energy Independence and Security Act of 2007 4 (Public Law 110–140; 121 Stat. 1494) is amended by in- 5 serting after the item relating to section 453 the following: 6 ‘‘Sec. 454. Industrial emissions reduction technology development program.’’. SEC. 4. INDUSTRIAL TECHNOLOGY INNOVATION ADVISORY 7 COMMITTEE. 8 (a) IN GENERAL.—The Energy Independence and 9 Security Act of 2007 is amended by inserting after section 10 454 (as added by section 3(a)) the following: 11 ‘‘SEC. 455. INDUSTRIAL TECHNOLOGY INNOVATION ADVI- 12 SORY COMMITTEE. 13 ‘‘(a) DEFINITIONS.—In this section: 14 ‘‘(1) COMMITTEE.—The term ‘Committee’ 15 means the Industrial Technology Innovation Advi- 16 sory Committee established under subsection (b). 17 ‘‘(2) DIRECTOR.—The term ‘Director’ means 18 the Director of the Office of Science and Technology 19 Policy. 20 ‘‘(3) EMISSIONS REDUCTION.—The term ‘emis- 21 sions reduction’ has the meaning given the term in 22 section 454(a). 23 ‘‘(4) PROGRAM.—The term ‘program’ means 24 the industrial emissions reduction technology devel- 25 VerDate Sep 11 2014 22:02 Aug 05, 2019 Jkt 089200 PO 00000 Frm 00010 Fmt 6652 Sfmt 6201 E:\BILLS\H3978.IH H3978 kjohnson on DSK79L0C42 with BILLS 11 •HR 3978 IH opment program established under section 1 454(b)(1). 2 ‘‘(b) ESTABLISHMENT.—Not later than 180 days 3 after the date of enactment of the CIT Act of 2019, the 4 Secretary, in coordination with the Director, shall estab- 5 lish an advisory committee, to be known as the ‘Industrial 6 Technology Innovation Advisory Committee’. 7 ‘‘(c) MEMBERSHIP.— 8 ‘‘(1) APPOINTMENT.—The Committee shall be 9 comprised of not fewer than 14 members, who shall 10 be appointed by the Secretary, in coordination with 11 the Director. 12 ‘‘(2) REPRESENTATION.—Members appointed 13 pursuant to paragraph (1) shall include— 14 ‘‘(A) not less than 1 representative of each 15 relevant Federal agency, as determined by the 16 Secretary; 17 ‘‘(B) not less than 2 representatives of 18 labor groups; 19 ‘‘(C) not less than 3 representatives of the 20 research community, which shall include aca- 21 demia and National Laboratories; 22 ‘‘(D) not less than 2 representatives of 23 nongovernmental organizations; 24 VerDate Sep 11 2014 22:02 Aug 05, 2019 Jkt 089200 PO 00000 Frm 00011 Fmt 6652 Sfmt 6201 E:\BILLS\H3978.IH H3978 kjohnson on DSK79L0C42 with BILLS 12 •HR 3978 IH ‘‘(E) not less than 6 representatives of in- 1 dustry, the collective expertise of which shall 2 cover every focus area described in section 3 454(c); and 4 ‘‘(F) any other individual whom the Sec- 5 retary, in coordination with the Director, deter- 6 mines to be necessary to ensure that the Com- 7 mittee is comprised of a diverse group of rep- 8 resentatives of industry, academia, independent 9 researchers, and public and private entities. 10 ‘‘(3) CHAIR.—The Secretary shall designate a 11 member of the Committee to serve as Chair. 12 ‘‘(d) DUTIES.— 13 ‘‘(1) IN GENERAL.—The Committee shall— 14 ‘‘(A) in consultation with the Secretary 15 and the Director, develop the missions and 16 goals of the program, which shall be consistent 17 with the purposes of the program described in 18 section 454(b)(1); and 19 ‘‘(B) advise the Secretary and the Director 20 with respect to the program— 21 ‘‘(i) by identifying and evaluating any 22 technologies being developed by the private 23 sector relating to the focus areas described 24 in section 454(c); 25 VerDate Sep 11 2014 22:02 Aug 05, 2019 Jkt 089200 PO 00000 Frm 00012 Fmt 6652 Sfmt 6201 E:\BILLS\H3978.IH H3978 kjohnson on DSK79L0C42 with BILLS 13 •HR 3978 IH ‘‘(ii) by identifying technology gaps in 1 the private sector in those focus areas, and 2 making recommendations to address thos [Text truncated for display.
