Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Safe Drinking Water 4 in Playgrounds and Parks Act’’. 5 SEC. 2. DRINKING WATER FOUNTAIN REPLACEMENT FOR 6 PLAYGROUNDS AND PARKS. 7 (a) PLAYGROUNDS AND PARKS OWNED BY 8 SCHOOLS.—Section 1465(b) of the Safe Drinking Water 9 Act (42 U.S.C. 300j–25(b)) is amended— 10 VerDate Sep 11 2014 04:20 Aug 07, 2019 Jkt 089200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H3949.IH H3949 kjohnson on DSK79L0C42 with BILLS 2 •HR 3949 IH (1) in paragraph (1), by inserting ‘‘, including 1 in playgrounds and parks owned or administered by 2 schools’’ after ‘‘schools’’; and 3 (2) in paragraph (2), by inserting ‘‘including in 4 playgrounds and parks owned or administered by 5 such schools,’’ after ‘‘such funds,’’. 6 (b) PUBLIC PLAYGROUNDS OR PARKS.— 7 (1) GRANT PROGRAM.—Part F of the Safe 8 Drinking Water Act (42 U.S.C. 300j–21 et seq.) is 9 amended by adding at the end the following: 10 ‘‘SEC. 1466. DRINKING WATER FOUNTAIN REPLACEMENT IN 11 PUBLIC PLAYGROUNDS AND PARKS. 12 ‘‘(a) ESTABLISHMENT.—Not later than 1 year after 13 the date of enactment of this section, the Administrator 14 shall establish a grant program to provide assistance to 15 States and municipalities for the replacement, in play- 16 grounds or parks owned by States or municipalities, of 17 drinking water fountains manufactured prior to 1988. 18 ‘‘(b) USE OF FUNDS.—Funds awarded under the 19 grant program— 20 ‘‘(1) shall be used to pay the costs of replace- 21 ment of drinking water fountains in playgrounds or 22 parks owned by a State or municipality receiving 23 such funds; and 24 VerDate Sep 11 2014 04:20 Aug 07, 2019 Jkt 089200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H3949.IH H3949 kjohnson on DSK79L0C42 with BILLS 3 •HR 3949 IH ‘‘(2) may be used to pay the costs of monitoring 1 and reporting of lead levels in the drinking water of 2 playgrounds or parks owned by a State or munici- 3 pality receiving such funds, as determined appro- 4 priate by the Administrator. 5 ‘‘(c) PRIORITY.—In awarding funds under the grant 6 program, the Administrator shall give priority to projects 7 and activities that benefit an underserved community or 8 a disadvantaged community. 9 ‘‘(d) AUTHORIZATION OF APPROPRIATIONS.—There 10 is authorized to be appropriated to carry out this section 11 $5,000,000 for each of fiscal years 2020 through 2025.’’. 12 (2) DEFINITIONS.—Section 1461 of the Safe 13 Drinking Water Act (42 U.S.C. 300j–21) is amend- 14 ed by adding at the end the following: 15 ‘‘(8) DISADVANTAGED COMMUNITY.—The term 16 ‘disadvantaged community’ has the meaning given 17 such term in section 1452(d)(3). 18 ‘‘(9) PLAYGROUND OR PARK.—The term ‘play- 19 ground or park’ means an indoor or outdoor park, 20 building, site, or other facility, including any parking 21 lot appurtenant thereto, that is intended for recre- 22 ation purposes. 23 VerDate Sep 11 2014 04:20 Aug 07, 2019 Jkt 089200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H3949.IH H3949 kjohnson on DSK79L0C42 with BILLS 4 •HR 3949 IH ‘‘(10) UNDERSERVED COMMUNITY.—The term 1 ‘underserved community’ has the meaning given 2 such term in section 1459A.’’. 3 Æ VerDate Sep 11 2014 04:20 Aug 07, 2019 Jkt 089200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6301 E:\BILLS\H3949.IH H3949 kjohnson on DSK79L0C42 with BILLS
